@Ryan Hogue Passive Income one of my friends is a lawyer who specializes in trademark and other intellectual property law. I asked him about these attempts to trademark the phrases "Black Lives Matter" and "I Can't Breathe". He said that his best guess is that the USPTO will eventually reject the trademark applications because the phrases have been so widely used and because there is no way to tie them to one unique brand. Therefore they cannot function as trademarks. IANAL but if it were me I'd prepare to have any "Black Lives Matter" products I was selling be removed from Merch by Amazon once those trademark applications are rejected by the USPTO. Or I'd come up with a phrase that could be trademarked and sell those instead.

Hi Ryan, what does it mean when you're in the process of submitting a t-shirt design to Merch and some of the keywords are highlighted in orange? Does this mean they're not ok to use AT ALL? Or does it just mean they are trademarked for things other than t-shirts, so you can use them on T-shirts? I have your Merch Keywords Chrome extension and that has not highlighted any of the text fields. The Merch Informer trademark alerts tool says my highlighted words are not ok, but when I look into it these trademarks are not to do with t-shirts! So can I use them? Other people are! Newbie here finding this such a minefield.

What are your thoughts on splitting key phrases apart within descriptions etc. Say, for example, it was Star Wars (assuming the design itself didn't infringe) and your bullets contained 'be a star at your next party . . . . . . don't have wars with your friends over who had the best t shirt'. Silly example, but you get my meaning. a) is this enough to avoid being flagged by Amazon, and b) would this have a positive effect on search results ?

i was watching another video earlier about how disney and other big companys are SUEING! because they are useing mickey or disney etc keywords on there product description, title or keywords or hashtags, this i know is for a fact important for Redbubble, Teechip (owned by RB) and Etsy, u can upload a white circle and tag it as star wars, and redbubble instantly pulls it for review so keywords and copyrighted keywords are very harmful or beneficial to your account. I basically label my posts as plane as i can while still kinda describing my product,then on FB and Instagram and Pintrest i use the big no no words lol that way its easier for costumers to find yet safe to use,

Etsy should be sued by Disney. That would make my day, they allow infringement on Disney's IP to run rampant on their platform, yet they punish sellers like me that didn't actually infringe on anything! 😟

Hey Ryan, informative as always👍🏻 On your screenshot, 2 out of 3 trademarked under 025 was “LIVE” at the bottom. It should be live shouldn’t it?😃 Also, how long in average does it take for a trademark to go fully live? My questions kinda sucks but just trying to get some insights. Thank you!

I might not understand the first question. But in my experience, a trademark going live can take 6-8 months. I had my family help file my first one, and currently have a second pending.

no, eventho there is gonig to be a intermediate difference in shade like bright yellow and shirt left outside in the sun for 2 days yellow. but no no need to do all that work. people go to redbubble for cheep good designs not high quality print thats going to last a long time and be hand made for quality.

I tried to upload to Amazon “All lives matter “ and it was rejected ! I’m based in UK 🇬🇧 Also I am just starting so I am on trier 10 and every single design goes under review for a day or longer. It doesn’t happen automatically as you say( unfortunately) thanks for great content 👌

Sorry about that. Merch is a tricky beast. Sometimes it can be a single word in your bullets or description that triggers a rejection

ok but for example "Black Lives Matter " is protected but should we still search for "blacl lives matter " or "black lives matter 777" or even "black lives matter no to racism " to see if they are copyrighted free especilly on trademarkia.com , merch informer or even the USA government site btw are these three sites show the information internationally

I'd stay away in general as most approvals algorithms aren't smart enough to know that you what did was OK

Some people reported if the trademark has 3 words or more, the amazon algorythm also reacts on variations. Example: "Black Live matter" is trademarked, amazon algorythm would react on "black live matters additional-word"

In my first year, probably 10-12. In the past year... probably 3-4. I stopped typing out additional keywords in bullets/description if I wasn't 100% sure they were safe
