Joint ownership. Stay without rent depends upon the nature of property and other person's objection. Get the property partitioned

During the pendency of suit .. suit was transferred to one person and that person purchased that property without knowing the fact of the suit which was pending in the court.. suit got decreed against the person who transfers the proper to the purchaser. Q. wat will be the position of purchassr and what right he can claim sir ???

Receiver gets the title of the seller. He cannot get better title than what the seller has. If the seller title is defective, buyer also gets defective title. The remedy for the buyer will be to proceed against the seller for damages, for conveying defective title.

Sir, i have a one doubt in section 44. If one joint-owner of land wants to sell his property right whether he should get consent from all other joint-owner's or not. here consent means what? signature or oral. concent?

44. Transfer by one co-owner.-Where one of two or more co-owners of immoveable property legally competent in that behalf transfers his share of such property or any interest therein, the transferee acquires as to such share or interest, and so far as is necessary to give, effect to the transfer, the transferor’s right to joint possession or other common or part enjoyment of the property, and to enforce a partition of the same, but subject to the conditions and liabilities affecting at the date of the transfer, the share or interest so transferred. Where the transferee of a share of a dwelling-house belonging to an undivided family is not a member of the family, nothing in this section shall be deemed to entitle him to joint possession or other common or part enjoyment of the house.
