there are some tricks that are perfectly acceptable as they help the examiner ferret out when someone is faking. For example, as a former RVSR myself, I saw a C&P exam report once where a veteran claimed to have significant back pain whenever moving/bending and claimed to have almost no ROM of the hip and knee. The examiner had the veteran sit on a table, then took their shoe off for them, stating they were checking nerve conduction into the foot. After many minutes of grimacing and wincing every time the examiner asked them to do anything, the examiner concluded the exam and told them they could put their shoe back on. Thinking the exam was over, the veteran hopped off the table, sat in a chair, bent over to pick up their shoe, then put the shoe on and stood up, all with no evidence of restricted or painful motion whatsoever. 0% for painful motion. Also, I've read numerous reports from a particular doctor at the VAMC where I lived who would wait until the veteran left the exam room, then step into the hallway without the veteran noticing, to observe how they walked after they thought the exam was done. Limping with a cane coming in, and walking normally without the cane going out = 0% for painful motion. We should all strive to get what we're rightfully entitled to, but when so many vets try to game the system, we end up where we are today.

The trick is they don't fill out the form or they leave crap blank or they put false info.. Just had mine CP exam and because the doc didn't check a box they denied my aide and attendance. So now I have to get a new DBQ and Nexus and do a supplemental claim..What a joke. How one Doc can mess up and all the work of 5 other Docs is no good, is beyond me

Had this happen to me, the C&P examiner stoop 6 feet away using the gonoimeter and eyeballing the measurement. Went home and use a Carpenter angle finder and appealed the decision and won my appeal

@@DewayneKimble Hey Dewayne and fellow vets... Thursday 2nd Oct. The examiner at c&p appointment he will process my s.c conditions. But Migraines and Tinnitus he said is not s.c. but he will assist in me getting increase for Back,Knee and Skin Disorder. So I'm now gonna work up my med evidence for claims that got denied. For a whole yr with a personal doctor then go back and attack the v.a. with more medical evidence,nexus and DBQ gonna get filled out. Btw. He used the measuring tool. For back n knee

This happened to me. However, the nurse practitioner did use the goniometer on flexion for a split second! He did not use the goniometer for extension or rotation. Frankly, there was no rotation test. He told me to sit down, and we were done. Two months later, I got a letter that he said, "The veteran refused to make attempts at range of motion to allow for measurement. No baseline can be established." I'm floored and pissed! I wrote a letter to the VA requesting a reexamination and higher-level review. I assume I did the right thing.

Yup, they don't want to measure extension because that is where you will get compensation with as little as 10 degrees of LOM. They're happy to measure flexion because you have to basically be in a wheelchair to get any compensation. It's too coincidental that this seems to be the way it goes. The fix is in to screw us. Fight them to the end. You need to appeal either through HLR or Supplemental appeal claim.

Thank you for the video, but we have to take this some steps further...If ever examined without the proper equipment, it MUST be reported to VA Claims. Cause those underhanded examiners will say "it's not VA approved or calibrated" and they will not use it. Report them and get them out of the system! Video tape them!!! Get your local and State reps involved in this. Congressional investigations pull their chains..

Went to leave a google review and there were hundreds of reviews about the Doc leaving stuff out and putting false info on purpose.. Im filling a complaint tomorrow and calling my congress person

I filed to increase back issues with a VA MRI diagnosis of DDD and spondylitis that was a long time coming after repeated denials. After a year from filing , I am scheduled for a foot exam and general physical and pact act melanoma scar check. The foot check doesn’t make sense and I have diminished confidence in the system that has neglected to do the right thing for 23 years. I have always had radiculopathy but the VA would refuse to investigate. Finally after a 16 year hold on trauma induced sleep apnea that I appealed and won, the service connection has been established. Dental was also repaired after 15 years of waiting. It is really sad how veterans are treated. I lived in poverty during the best years of my life due to service connected injuries that were not addressed and I’m sure I am not the only one. My QTC doctor examined me for two hours, and used the Goniometer. She them had me go next store to get x-rayed. Three weeks later, I was rated by the VA at 100% P&T.

Great topic! I just had that happen last Thursday. Lesson learned: don't assume anything. I recommend calling C & P examiner ahead to verify the use a goniometer. And, bring a goniometer with a copy of the VA mandate to use goniometer that Dewayne shared -- just in case. During your exam, I would also ask the examiner to repeat your range of motions (ROM) and other pertinent info out loud, because they can make errors. My previous examiner entered the endpoint of 90 deg for Forward Flexion(FF) instead of my usual ROM of 20-25 deg. That single error caused a denial because (FF) Range of Motion is what will get you rated or rejected in most cases. You can also use your goniometer (with the help of another) to see what your range of motion(s) are. Be prepared and get it right as do-overs can take months to get approved and scheduled. I bought a large goniometer on Amzn which has 12" arms.

Just did a C&P for sciatica. Doc used a godiometer (5% all around for me) as well as used what I can only describe as a vibrating tuning fork to test for feeling sensations in my legs.

I had just gotten out of the hospital from surgery and still using a walker to even get around. I almost ready to give up because I'm physically exhausted..

I reached my boiling point when an examiner commented that I experienced phantom pain the way that amputees do (filed for an increase after a failed allograft due to a complete rupture of the quadriceps and patella tendons). I now have 20 years on all of my ROM disabilities with my back being the lowest at 20%. I’ve cut my losses, and won’t be bothered with those exams ever again.

I figured my personal statements and medical evidence were enough and pointing it out on my STRs proved my contentions. There's a lot of help here if you take it.

Good morning Dwayne, I just heard from the VA hotline that my claim has been sent to VERA and they are waiting on a medical opinion and that no exam is necessary. The claims are for HLR for my lumber and cervical spine. Is this common for back claims. I was thinking they would do another ROM test.

This is true. I am a medically separated, disabled Army Veteran with nearly 19 years of service. In the service a 65D (PA) with Infantry and CAV units. On the civilian side I did 3rd party C&P exams, but also was a trainer of other providers who were hired to do these critical exams for my fellow Veterans. It is a regulation that a goniometer MUST be used per the VA and all medical providers hired by LHI were given goniometers by the company to use. So there is NEVER an excuse to not use the goniometer for ROM measurement. A difference of 5 degrees can be the difference in the next level in the schedule of ratings for the claimed condition. Those providers who fail to do this part of their job are lazy and unethical. No one I trained was ever told to "eyeball" any ROM. If your Examiner refuses to use a goniometer, report them immediately, and report this violation to the VA claims personnel as well that very day to preserve the integrity of their claim.

Yes!!! The C&P exam forms/DBQ's are now all electronic/computer based. The question about using the goniometer is a check box. If the provider were to be honest and admit they did not use a goniometer, the exam would be kicked back automatically by QA for correction and re-exam. That is if the current form even allows it to be electronically signed with that critical error. Most providers just lie to get the form submitted. Sir, your videos are on point. I did my own VA claim in 2020 because I had knowledge of the system and obtained my 100% P&T on the 1st try, but I fully know the hurdles my fellow Vets face, with our without help. Keep up the good work educating Veterans and their families!!!

They're stealing from the US by taking money and not doing a proper evaluation. This happened to me in 2014, knees, and back. I was told to walk on tippy toes and that’s it. You can have seat, I was profiled when I entered the room. Sad that veterans are treated like this. Also it’s not just 3rd party, the VA does this too, because that’s who did it in 2014.

I had my exam for cervical spine on October 7. I asked if she was going to use the goniometer and she replied it is not used on for the neck due to the size of the device. I told her ROM is how the VA rates back and neck pain so it must be used. After looking online for a few minutes she said ok and broke it out. Not sure how accurate the measurements are that she took but I guess I will find out if the VA ever finishes up my claim...maybe next summer.

I just went to a 3rd party examiner yesterday for my back exam. He did exactly what you said. I even asked if he had a goniometer. He said he didn't need it. I tried calling IG today, but no answer. I'll keep trying first thing in the morning to file a complaint. Shame on me for trusting them in the first place.

Do this instead. Call 800-827-1000, inform them to note on a 0820 what you just stated (to include that the exam is insufficient and the rater should request another exam before rating your claim), submit a VA Form 21-4138 stating the same information, and call the VA White House hotline and let them know the same thing, do not give your email address and ask for a call back from a supervisor. Make sure you pick up the phone from any odd numbers. Inform the supervisor of the same thing. Guess what, ask them to look at the C & P exam to see if the examiner stated they used a goniometer. It wouldn't suppose me if the answer is yes, the examiner noted they did. this way you can get ahead of it. I did my homework for my mental health C&P. I wanted to make sure i didn't forget to mention ALL of my symptoms that coincide with what their looking for. If you're not an SME on conditions you have it's best to understand then in their terms. The rest is unfortunately in the hands of thr examiner. At least I did my part and didn't forget anything. Could just be my own paranoia, but on my increase for my lumbar spine strain I didn't bend beyond 30 degrees because that is where I felt pain. Not extreme pain, but pain. My C&P insisted that I bend as far as I can. I told her I feel pain and do not want to go further. She later asked me to remove my boots. I sat on the table and picked my leg up to untie my shoe. I feel like she looked at me to observe that I could do that. Some days something as simple as putting boots on hurts my back. Sometimes the pain is instant and sometimes it occurs later. I have X-Rays, medical notes, diagnosis, and nexus letters so common sense would tell me the VA would take all this into account over her noting I could tie my shoes. Thoughts?

Why would they take a nexus in account if you are already service connected. Also, does an Xray or MRI show the forward flexion in degrees, that is the requirement for an increase.

First and foremost the C&P examiner should be reported to the VA IG and if a contracted examiner report to VA IG and the Contracting officer for the contract.

Dewayne my only thing with this particular 38 CFR is the wording leave's some wiggle room for not having one .. and it’s the part that states that the examiner should have one of these but what it doesn’t say is that they’re REQUIRED to have one and that’s the part that needs to be addressed …

This happened to me for my knees. Examiner didn’t use the goniometer and it was just hanging in a wooden basket on the wall. I asked if she was suppose to use it and she told me her years of experience allowed her to eyeball exams. It sucks because I was denied.

Had a C&P two weeks ago. Back conditions and neuropathy secondary to multiple knee injuries. No goniometer. Tested my reflexes four times until he got the result he wanted. Never tested numbness. Naturally, my claims were denied. Also got denied Sleep Apnea for missing an appointment that is still two weeks in the future.

I feel like my examiner lied about my range of motion also. She put forward flexion at 70 degrees but i measured it myself and it's only about 20-25 degrees. I claimed TDIU and they did another C&P for my back and one for my SSD and as a result of my C&P exam my spine rating was lowered from 20% to 10% and my claim for TDIU is pending but based on the back rating being lowered I am not confident the TDIU will be granted. Who do I report the inaccurate C&P exam to?

I just had an exam a few weeks back for an increase in my Neck and Shoulder and they never even had a measurment device in the room, that I could see. She winced when she heard my neck crack when I made movements and said she'd seen and heard enough. This is kinda local for your area because my rating area is the St Pete VA. My exam was done at a short term office for a day rental place in Lakeland.

@@DewayneKimble The Email I sent you had the name of the contract company that did my "exam". I know what the criteria for ROM measurments. I've had two previous ones, over the years from the same company, also the past 20 plus years that I've been periodically going through physical therapy and chiropractic care for my problem. She didn't have one and didn't use one on me. When my wife and I left the room and got into the elevator, I started telling her what should have happened during the exam. I've been a Paramedic, Combat Medic, and on into a Registered Nurse since 1989. I've done a lot of PE's on Marines at sick call and assisted the Orthopedic Surgeons I work with in the civilian world. This was definitely one of those cases where I was actually just a little bit shocked at what had just happened and decided that I wouldn't ruffle any feathers, but I made a couple of quick notes that I put with the papers I had to present to the examiner so that if there's "no significant findings" r some other reason not to rate my condition higher, I'll make a fuss up the chain.

My brother had his C&P exam last week. He is confined to a wheelchair. He has no upper mobility, i.e can't bend at the waste, and no lower mobility can't lift legs, only can move feet a little. The examiner said he'll document "no range of motion". He couldn't/didn't use the geniometer. What is to be measured if a person is immoble? So if he didn't use it and reported a result, how will the VA know if the reported result came the the meter?

I had a C&P Exam 11/07/2023 she didnt exam me or anything, the exam was through QTC. All she did was place a metal supply on my leg and asked me if I felt any tingling, she didnt ask if i could bend, forward or backwards. I did file a complaint through the VA Hotline. Because its not fair.

This happened to me for exam for knees and lowe back. Not only didn't she use the tool on my exam she was nasty and distasteful. As soon as I step out of her office I contacted VA and reported this Dr. I also dow loaded the necessary form that governed my complaint and fax off my complaint as well as mailed a certified to VA. I was given another C&P exam soon after with another facility. Walked away with a 40% for lower back 20% bilateral for radiculopathy and 10% bilateral for knees!!

I just received a decision on a secondary claim and what I found after reading the decision is alarming and worth making all aware. Please stay engaged with your claim from start to finish. First the claim was denied but I’m not disturbed about that, I disturbed before the Person working the claim changed the nature of the claim and did not address the claim in its entirety. I claimed obesity, hypertension, Gout secondary to osteoarthritis (service connected). The claim was changed to read obesity secondary to hypertension and no mention of gout. Subsequently nothing was tied to OA. All my relevant medical records in hypertension, obesity and gout . It appears to me the person altered the claim and to end the note it appears the person may have been a trainee. Be Educated !

from what I read in CF38 it doesn't say the goniometer is required for ROM, all it said is it's indispensable. Only requirement for geniometer is for joint issues. As an example lumbo strain is not joint.

It is obvious that nothing is nothing is ever consistent with the system. Some veterans are having to sign documents to state that a Goniometer was used. Some examiners do what they want to do because they know some of the inexperienced raters will take their word over the vet.

Went to a C&P with OTC. The doc had the Gonameter in his hand never used it. He asked about my neck pain. He the pain in your neck goes to your shoulder and he made the motion. From neck to shoulder. I looked and said no the pain comes from here put my hand on the back of my neck and moved my hand down my neck to my left and right shoulder. He smiled and said yep. I read it? It was like he was testing me to see if I really was experiencing pain. If I agreed I guess I would have failed. Then he checked my feet for ples plantus and for the surgery done on my foot. He noticed the long scar going across my foot and said what did they do the went inside? Your scar is calcified. I didn't even claim this scar so I'm thinking now I have to go back and do a new claim on the scar. He asked me to stand up. Looked at my feet and said ok. I will be writing this up and you should receive something from the VA in a few weeks or a month. The appointment lasted maybe 7min. No real exam outside of him looking at my foot and finding a few surgery scars and couldn't determine the other area he said because the skin was discolored. I felt like I wasted my time. I guess I will need to get one of these companies you have to pay to get DBQ's and real doctors exams to submit for the VA docs to try to argue against and then the process is started again with higher lever review etc... don't k ow this is existing and depressing as a veteran that has sacrifice his body for our country and this foolishness.

Hey! I had a C& P exam for sinusitis. I told the examiner about other issues related to it. The examiner documented the additional information from my private physician's notes. My sinusitis was increased from 0% to 50%. The additional documentation may work in your favor.

I hate to tell you, but he was actually getting you to not focus on your neck anymore to “Truly” assess your cervical (neck) range of motion. When he redirected your attention to your feet, you likely gave him ALL the evidence needed to accurately assess your ability to flex your neck and look down, likely without experiencing the same pain you were previously talking about when you were focused on your neck. Unfortunately, it was to get you to forget about your neck and something tells me you bent your neck forward much further because you were fixed on the conversation about your feet. 🤷 sorry, they may have got you on this one.

When I went to the examination, I was not seen by a doctor. The individual never got out of her chair. She had me move my neck from side to side and up and down and that was the extent of the examination. I was given 20% for my neck.

The problem is the examiners have a million reasons they can just use at their leisure to give you any rating they feel like and if you bring your own goniometer and then start spouting off regulations I fear they're likely to do what you ask and use it, but they'll also make a mental note to themselves to "find" a reason to deny. Hopefully this won't happen in my up and coming C&P, but the last time I had a back C&P they made the claim that I wasn't a paratrooper when I was and they also stated I didn't deploy even though I did and then they refused to service connect me. My first claim was in 2008. This new C&P is only happening because I filed a supplemental claim and I made the VA aware of the inaccuracies in my first C&P, and also informed them that no goniometer was used, so they ordered a new C&P. Unfortunately my experience shows me they'll find a reason to deny and I won't know what that is for months, simply ridiculous.

Wished I knew this before my C and P exam. For copd and bronchitis, they only used a little breathelyzer thing. I wasnt going thru an episode, from Gulf War experiences. So, he sarcastically said, I dont feel any reason for service connection. But, he was rude and adverserial, and tried to dress me down. First question he asked me, walking into room, "Are you feeling Suicidal, today?" I brought all my evidence, and my Cpap machine, inhalers. He didnt want to see anything, and he " knew " everything about my records, he said. They ( QTC) called me in 6 days early, so I was thinking, how was he able to go through 1000+ pages of VA medical records, pulmonary specialists records, personnal physicians ( covid restrictions at VA hospital) records, and cast judgmental verdict!

Me. Kimble, community care physical therapist provided documentation to me which I submitted and took copy to the exam and the contact dr and Va clinic didn’t measure the ankle but only measured the knee and I read the notes by that individual and saw that he gave me five for all five flection on the ankle but the documents stated three of the five have a zero and still in appeal currently any advice? and I requested a second opinion examination to be done cause evidence by none government clinic found cuz but government individual claims or fudge numbers, have experienced dr take 8 measurements and not write one down until returning to computer. Any advice on medical claim it not them it benefits and benefits claiming that the evidence isn’t available when medical put like but more likely not the reason?

This happened to me last month. She just told me to move every body part, when she told me ke touch my toes, i already knew to not move past pain but im worried since she didnt use a goniometer, the decision will be unfavorable

Dwayne, Great video! However, your video visit a deeper concern without intentionally doing it. If C&P examiners are doing this then one must also consider the following. 1) An examiner can use a goniometer an STILL write incorrect measurements for mistake, purposeful, or other reasons. Veteran can still be screwed with no way to dispute it because its my word against theirs🤨. Why can't their be a neutral party in the room that checks the ckecker? 2) If you challenge them like the video suggests, I think that the veteran should just end the exam and request a new one because now you've probably pissed the examiner off and the examiner will employ what I states in #1 above.

I've never measured it but I would think a smaller one would be used for the wrist opposed to the back.

how about dropping a fedex at 10pm to be at a location 40 miles away at 8am and the nurse np was not expecting me. plus i allege my va psych doctor played a role in my non combat ptsd moral injury being denied and the day my claim closed she sent me a message. I encourage you to consider psychotherapy! madness

I’ve already done the C&P for my back and the examiner used her thumb aligned with her eye, no goniometer. What can I do? Should I call The VA to request another exam?

Call the VA at 800-827-1000 and inform them that the examiner did not use that tool, send in a VA Form 21-4138 saying the same thing. Also, inform them that the exam is insufficient and another one should be given to obtain the correct ROM. OK. I'm 100% P&T as of 2021. But I keep getting an email saying that a Supplemental claim I filed years ago back in 2017 is still pending and moving up in the docket. I ignored it because I thought it was just spam. So, a week ago it gave me a date for a virtual hearing exam for migraines 16-January 2024. So being that I know it could be dangerous for your benefits if you miss an appointment and I don't trust the VA, I decided to call and find out what was going on. Low and behold. I was set for an exam. So, I called the VA immediately and I explained to the lady on the phone that that was before I became P&T. I don't want or need a C&P exam. I'm done. So, she put me on hold and confirmed. Then she said she'll make a note to let them know that I don't need another exam. She "assured" me that everything would be fine. Just carry on nothing more to worry. Is that be something I should be concerned about??
