I just found your video, good information! I already have a LLC in Washington state. I was doing some online selling like Amazon and eBay, but I stopped the operation last year but I still keep my LLC. Now if I want to buy a rental property under my LLC(trying to get in real estate business), do I need change the business classification under the department of revenue? Now my LLC is under the business code - retailing, what business code should I pick if I do need to change? Thank you for free info!

Thanks for the question! The answer to your question depends on what the rental is going to be used for. For short-term "transient" rentals (less than 30 days), the DOR considers it lodging in the same manner as hotels/motels, in which case their B&O classification is both Retailing and Service and Other Activities. In this scenario, rental owners are responsible for retail sales tax as well as applicable lodging taxes (both at state and local level). If the property is to be used as an Airbnb-type rental, there's a guide for "online marketplace" lodging here: dor.wa.gov/education/industry-guides/lodging-guide/online-marketplaces-and-property-managers But, if the rental income is from "non-transient rentals" (more than 30 consecutive days), then it's exempt from B&O tax and thus has no classification. Note, the city might have an "other" classification for their tax purposes. Business activity can be updated with My DOR online or by filling out the Business Information Change form. Contact the DOR if any additional steps need to be taken. The quick answer is that LLCs came about in the 1970's as a solution to the double taxation faced by corporations. Corporations offered limited liability just like LLCs do (which makes it so the individual owners are legally separated from the business) but their taxation structure wasn't the best match for many businesses.
