Convicted felons forfeit their rights upon conviction of a crime until they have fully completed their sentence and debt to society and then after completion of sentence rights are restored. It has always been that way in state criminal codes but varies between states. Some states don't restore rights while others may partially or fully restore them except for violent crimes like murder or violent sexual assault. So rights can be suspended or given up for a conviction of a crime by the person who possesses them until the sentence is fully served. If you don't want to lose your rights then don't commit a crime. Rights cannot be taken away by anyone but the person who possesses them by law. So don't forfeit your rights with a crime you commit. Don't renounce your rights either by mouth or by writing.

It's B.S. that America does this. It's horrible what America has become. In the 1800's some got out of jail an was given there guns, an gun belts, sometimes no ammo or gun unloaded. It's a shame some lose there guns, for crap they shouldn't. I knew a guy who had a Felony DUI an he lost his guns an his gun rights, made no sense to me. The government don't pay you what your gun is Worth, sometimes they dont give a receipt, the ones taking the guns didn't go through a background check when they take the gun. If they came for mine, with a Warrent, I'd give them the part that's sterilized listed in the Warrent. . Nothing more, nothing less, an im not handing them anything else not listed in a Warrent. An i would demand a receipt for my property, an inwould ask for some compensation for the property taken. .

I have waited 23 years to get firearm rights back from Florida I have all other rights restored back in 05 it was a non violent simple drug position while on vacation in Florida with a group of people! I am a business owner, father and husband never had a ticket since this incident back in 2001 it’s insane that I cannot possess firearms to protect my family( I filed for full pardon 6 years ago with no response!) The system is flawed at best! If u committed a violent crime with firearm I think u lose those rights for 10 years until u can show u have changed, a non violent crime with no victim should never have lost rights

Yeah at worst take them for a period of time not for forever or at best review what they have been doing over the years and if they haven't committed any violent offenses at least have a review board yeah round to assess each individual on a case-by-case basis but have a review board that's year-round and solely dedicated to restoring people's rights I mean back in the wild west they gave everyone their firearms back after they completed their jail sentence no matter what they done that's why we have other laws and if you deem a person that dangerous they should not be out on the streets people that committed crimes deserve to protect themselves just as much as everyone else

Depends on the sheriff. Some sheriffs in Florida like to use red flag gun confiscation laws to take citizen's private guns away for two years. As of 2024, I read over ten thousand red flag orders have been issued across the State to take away people's private guns. I know Marion County rarely uses them. If you live in Florida, live in a county that rarely uses them and get to know your sheriff. Vote sheriffs out that do not defend your rights.

There was a time when you got outta jail, your rights and property were restored to you. Unless you could not be trusted to reintegrate back into society, then you got the rope. Has trump been reduced to the point of the rope? The answer is no, and I would argue that a lot of criminals would be capable of returning to society. Our justice system is broken to the point of rebuilding from the ground up. Also he’s being charged with things that no one else has been charged with, and they have changed some laws so that they could charge him and charge him retroactively with the changes.

I had a young adult living in my house in California that was restricted from being around guns. You have to prove that they are placed in a certified gun safe to have them live in the house. It is pretty draconian. He got a felony from having a fist fight with another kid in high school. To me, that is crazy.

(Strange, how appeals courts dislike it when laws are purposefully misconstrued, ignored, and perverted to punish innocent men merely for the sake of being a political opponent of a corrupt president while also turning the judiciary into a farce and the nation into a banana republic.) If you wish to gain any sort of wisdom, you wouldn't laugh at the situation, lest you find yourself in a similar one someday. I'm sure you've made plenty of enemies through your life, what with your charming personality and all. Would it be funny if one of them became powerful enough to instruct one of his corrupt judges to make up felonies out of misdemeanors to convict you, just to demean you and get you out of the way? That is why the phrase “shall not be infringed, is use. Our founders were very astute men. Who is our government to decide to take something away which was never given by them in the first place. I read one comment from someone who got in trouble for misdemeanor drug related crime, and the judge had ordered the person to go to a rehab, but what's messed up was that the rehab required that the individual was first committed to a psychiatric unit at a hospital to detox before getting a bed in rehab, and this individual several years after this was all over with, tried buying a firearm but got rejected because of the involuntary commitment into a mental institution, and this person said they tried pursuing getting their second amendment rights restored but got the tragic news that there was absolutely no Avenue for a person who had been involuntarily committed into a mental institution no matter what the circumstances were. So basically this individual was sabotaged and unjustifiably got a forever ban on ever being allowed to purchase or possess firearms for the rest of their life no matter what. That's messed up that a person with felonies can get their rights restored, but someone who gets committed into a psychiatric unit even though they had never been in a mental crisis just to wait for a bed and Rehab to open up can never get their rights back. Talk about some unconstitutional bulshit by our government to do this to someone. And it made me feel really bad when they said it really hurt them to see their fellow Americans get to enjoy their gun rights but they personally are not even allowed to get a second chance even though they never had felonies and were never considered mentally defective.

Trump has not been a resident of NY for many years. His NY carry permit has been invalid for many years. He should apply for a Florida carry permit, which Florida will gladly issue. The "convictions" in NY are only in force after sentencing when the conviction is filed. None of that has ever happened so Florida would have no legal reason to deny Trump a Florida carry permit.

Concealed carry permits are a form of gun registration. They know you have a firearm and where to find it. Supreme Court believes in Constitutional carry. Some states enforce open carry. Here in England we obviously deal with different firearms laws but what confuses me is why does Trump have to hand in his guns? I understand in NY he can have a carry permit revoked but why cant he simply gift his guns to his wife? In Florida I understand you do not need a carry permit so why cant he simply gift his guns to his wife while they down there and then she legally stores them in Florida? Even in the UK if someone has their licence revoked (say because their doctor prescribes anti-depressant drugs for instance because our doctors databases are linked to the Police so that is an automatic revoke), they can still "transfer " their guns to any friends who have suitable licences covering those firearms. Confused from England would like to know please?

Florida resident. A felon non violent without the use of a firearm CAN recover their rights, by petitioning the court that convicted them. It is not automatic. You would think the loss of your 2 rights would be MORE of a deterrent. BUT criminals DO NOT care about YOU, your property, or your rights. So, their loss of rights NEVER deters them.

I live in S.C. and I had my rights restored by way of a Pardon through the state probation and parole board. I had a non violent felony conviction like 30 years prior and another conviction for a violent misdemeanor.
