Obstruction of Justice is a real charge and can carry serious consequences. We can compare this to a person falsely claiming to be a victim of rape. We all wish that the person who falsely claim rape could also go to prison for equal time as an actual rapist would; the tradeoff would be too steep of a cost to the persons who have legitimate cases but, could possibly be afraid to report. More than likely there will be hotlines outside of 911 that citizens can utilize to report illegal immigrants and their activities and locations. Ice raids are coming in 2025.

NOTE: I do not work for McBean Law firm: Prepare for even more intrusive tactics than just being stopped at a gas station. Because human being generally has to engage in basic human behavior for example going to the grocery store. These areas are all fair game for ICE and any immigration agent. You will need to keep your papers on you at all times also sleep with your papers close by. Would not be surprised if ICE also utilize the" No Knock Warrant" to locate and deport illegals/ the undocumented/ overstays etc.

Remember the Administration is trying to meet a quota. People with active removal orders will be easy pickings for ICE or local law enforcement.

Note I do not work for McBean Immigration Law Firm: I want to first say that I totally agree with I.P.Freely, 123pb and thetruthhurts. Your friends may soon be back home in Jamaica. I could talk about how the administration will pick up criminals first, but the truth is Tom made it very clear that any and all who are here illegally, undocumented, overstays etc... are on deck to get deported. The idea of quotas in law enforcement has been so effective in the past that many jurisdictions decided to do away with quotas. When it came to say writing speeding tickets etc. The way it would work is the officers would have to write a certain number of tickets just to keep their jobs. Beyond that the officer could make even more money to write even more tickets. The result would be you could just be thinking about speeding and get a ticket. The way this will work for ICE will be the more people they can deport the more money the agency can demand from congress Which will result in higher pay for ICE, Border patrol and even the construction firms building THE WALL on the southern border and local law enforcement that support Border Patrol guarding those walls. No matter if the role people fill are with ICE, the courts or any aspect of participation, they will want to work as efficiently as possible (meeting and going beyond quotas) which will result in more money for everybody involved including the US economy. Detention facilities make more money when they have more physical bodies held at that facility. The incentive to fill those beds and have effective efficient court systems will be highly based around financial returns for those local economies. Even if the persons being held are shipped from all the way across the country. Americans do not mind spending the money when they can see where the money is going or how it is being spent. Just being honest.

If your son was standing before me and I was looking over his physical body just a person: Would I think he is a gang member? Does he have tattoos and piercings? You mentioned you did not attempt to renew because he is running with thew laws. I think what you meant to say is he is running from the laws. Well, I can personally assure you that the administration is absolutely looking to deport such people (AKA gang members). It may be wise for this person to either turn himself in or take personal deportation responsibilities but definitely stay away from the rest of the family. If there is 1 that has green card issues, there are probably others. Sounds like your son has the potential to open a can of worms that you may not be ready to deal with for so many reasons beyond just our son's issues. Remember the administration has a quota and they will be feverish about meeting those quotas. If they can pick up 3 while looking for 1; that would be excellent numbers for quota's that also will result in financial gain for the hunter.

She has explained this in many videos. If you have a strong case that is still pending with USCIS and you are not currently in court for removal proceedings or have an order of deportation against you. You are fine, you’re not on the list of priorities of people the government is ready to deport. The first on the list are people with criminal lifestyles, and anyone else with final deportation orders. Right now immigration officers are getting payed bonuses to deny cases, so work with your immigration lawyer to make sure your case is strong. And don’t get in any type of trouble with the law.

DACA recipient married to a 100% Disabled Veteran with severe PTSD and severe depression. We have two children, 2 and 9 as well as an 18 yr old still attending school. Note I do not work for McBean Immigration Law Firm: I remember watching a case recently where and officer in the US ARMY came home to attend the immigration hearing of his mother who had raised him in the US. The courts decided that she would be the next candidate for deportation and did deport the mother. As I continued to watch I realized that the mother also had 2 grown daughters, the son who was and officer in the US ARMY and several grand kids. None of these relationships mattered to the courts. People do not want to take the hard responsibility and handle this situation themselves. Remember every person will come to court believing that the court can and possibly will show mercy but, I would not bet on it. Not to mention the Trump administration is trying to meet a quota. Anytime quotas are involved that is scary business.

I don’t think approvals expire. You should consider using a credit card for this if you don’t have the money yet. This is one of those cases where you need to dig wherever and find the money to adjust your status ASAP. Ask friends or family members for loans. Specially now tax season is here, people are getting refund checks. Ask someone to lend you money. Enough money for the forms and to pay your lawyer fees if you have a lawyer.

The Electronic System for Travel Authorization (ESTA) is an automated system that determines the eligibility of visitors to travel to the United States under the Visa Waiver Program. Simple answer would be contact "The Dept of Customs and Border Patrol" or contact Homeland Security with any questions you may have. With the new administration putting new directors in the top positions of so many agencies the changing of the Guards will mean new referendums and new agendas. Surely many common knowledge tasks will now be under the microscope. Because of the laxed Southern Border policy of the Biden Administration the potential for terrorist threat from persons now residing within the US borders but originate from hostile anti America countries is at play. I would go ahead and figure no stone will be unturned

Note: I do not work for McBean Immigration Law Firm: DNA testing just sounds like it could be a slippery slope and possibly a long and drawn-out process. Clearly the parents would need to prove their citizenship status, then your DNA would need to match, then medical records (timing), birth certificate, social security numbers and possibly even more documentation just to get the DNA ball rolling. (23 and me probably will not get it) Timing would be a factor for example: one of your parents could have been undocumented while Pregnant with (the child...YOU) and possibly illegal or undocumented for many years of your life. The child could have been born to undocumented parents who later earned their citizenship, yet the child (you) who was not born in the United States would still be illegal or undocumented. Let's say those same parents once citizen in the US went on to birth several other children that are US citizens. Therefore (YOU) the 1st undocumented child may be trying to run a scam and could be prosecuted under the law for fraud amongst other charges not to mention the parents may also risk prosecution for participating. Clearly you would need to be represented by a family court attorney and possibly present your case in the Family Courts vs and immigration setting first. If the family courts were able to prove your lineage you may not even need to take other steps.

Just because your DNA matches a child who has US citizenship does not mean you are a US citizen 🧐. Best way to prove citizenship is birth certificate. Anything that shows proof of where your mother gave birth to you.

@@UnFiltered-Beauty89 I kind of agree the simple answer would be birth certificate etc. However, everyone I know has a birth certificate and there is no way they would ever even need to ask this question. In the USA even when you are a citizen you do not have to take a DNA test to prove you are the parent. So, the question that was asked is more suited for the parents status right? Got it! Like as if they crossed the border and gave birth and now is trying to somehow claim citizenship because their child had citizenship? Now that's pretty wild. If I am not mistaken this is exactly the kind of the thing that the president himself is saying NO to!! Without question. This issue (birth tourism) is so serious to President Trump that he said he will be working to get this constitutional loophole repealed. So surely if the President is trying to take away the citizenship of DACA recipients (President says one thing one day and another the next) and the children that is the result of Birth tourism: Lawd knows those parents are done, done ,done under this administration. Like my mom nor father would never need to ask this question. It is really a weird predicament to be in.

I can also respect the population’s frustration with migrants purposely traveling here to give birth to new citizens. On a human level, I get it. On a political level, it is an issue.

I know someone with a similar case to you. The difference is they were still married when his wife died. The only way you can still adjust is if you were still legally married when she passed away. If she ever filed an i-130 for you, in that case you can ask a lawyer to help continue that process through a deceased spouse. But you said you got divorced before she died, so you don’t have any options through her.

I am highly interested in what answer Mrs. McBean will have for you. Now I do not work for McBean Immigration Law Firm. My advice would be find a petitioner and make sure that the petitioner is a permanent resident or a US citizen. Marrying someone on the fly will not get it done. Remember this administration is quota focused. Many aspects of the immigration process are about to slow way down and other parts are about to be pedal to the medal. I will be honest here. There is a very very good chance that you will be deported. You have to be honest with yourself: Have you been found guilty of anything starting with J walking or littering all the way up to other more serious crimes. Easy deport crimes will be theft, DUI's domestic violence and assault is a sure-fire way to be on the bus.

Simple answer like the person above said, you are out of status. If you don’t have a relative that can petition for you to adjust status ( US citizen/ permanent resident spouse or adult child) then you don’t have an option. Or victim of some type of crime that is provable, it’s called Visa-U. Or a new employer that can sponsor you. Don’t spend years out of status bc you will regret it and it’s a waste of time.
