I would argue that gag orders are an inherent violation of the First Amendment. A lawyer can advise you to keep your mouth shut, but the courts should never be able to punish you for speaking or expressing yourself. Edit: A lot of people are pointing out that threats are not protected by the 1st amendment. That is correct, but those are already criminal charges with no further need to place a gag order. If he threatened somebody, charge him. Don't just continue to slap him on the wrist with more fines. He made no actionable threats. This is courtroom persecution. Simple as.

While Trump's lawyers could have requested a jury trial, it would have been summarily refused and they would have had to litigate the matter separately as an argument against either the long-standing 63(12) or against the provisions for equitable remedy in the New York constitution itself, which would have extended their time in court for an issue that judge Engoron was explicit in saying would have been a waste of time and money. Trump's lawyers even thanked him for clarifying to the media, but of course your yellow journalism sources don't really care about explaining background truth when emotive clickbait gets your more invested.

He doesn't say he did nothing wrong in his court filings - he just says he did nothing wrong to the public as is his 1st Amendment right - but in court filings he just argues that even if he was breaking the law he was allowed to as President. The Judge even had to take time at the start of session to say yes Trump can defend himself, yes Trump can testify and say anything he wants while on the stand - all he CAN'T do is attack the employees of the court and their families. If he can't prove his innocence without insulting the wife of the judge I'd say he doesn't have much ground to stand on.
