Can you explain a situation with loss of capacity grantor hasn't passed yet but they're incapacitated so there is now a power of attorney in. How would that work between a power of attorney and a trust if they're not the same person trustee agent but the bank accounts are in the trust in the agent needs to pay bills on your behalf. Can the power of attorney go in and make changes to your trust fund that you didn't intend? How can you prevent that? Do you need to leave one checking account outside of the trust to be able for them to pay the bills?

Trustee, and other Trustee. Grandmother has two houses. One Trustee placed grandmother in Psychiatric Hospital. Then sold one house, to prepare Grandmother’s Death and that trustee moved her self and 7 persons in, purpose of selling house to live because husband unemployed due to Covid two years later trustee move grandmother back I’m only house because she could not be count why grandmother is paying hospital and having to pay water, electricity, gas, storage, trash pickup. Trustee does not pay rent, nor insurance as homeowners or taxes or rental insurance, as other trustee I’m weary 😓 exhausted think about it.

Is there a way you can bypass probate and not go to court for that at all any documents that can be signed for that

Good Afternoon- my ex-husband passed away and my daughter didn’t receive any of the beneficiary (he remarried but I don’t think she received any beneficiaries it’ll either ). His sister is/was the POA. Is it possible or legal to remove a child or wife as a beneficiary?? Not sure if it matters but he was retired from the military.
