This is excellent. I'm not even all the way through and I'm so glad I found and am watching it. You break things down in an easily digestible way. I'm a lawyer, but not an estate lawyer, and I wish all lawyers were capable of this kind of presentation.

Well I arrived at this video by accident as I was investigating financial investment trusts but I've learned about another type of trust that I've been pondering for a while as I need to put something tangible in place before its too late, even just a simple will. I was unfortunately mesmerized throughout by the beautiful styling of this ladies hair, pure class. Hopefully I'll not be sued for saying that as I'll have no assets to put in my trust if that happens 😢

I took notes, thank you for clarity on the basics of Trusts! No probate! I now can explain exactly what I want my rule book to say with the help of my lawyer. I am loving the idea of TRUST automatically shifting control for me and my spouse if we get sick or upon death. God bless you!

This lovely lady explained this SO concise and simply I could cry. I took a wills and trusts class and I had a basic understanding of it in general, and though I liked my teacher so much she convoluted things a bit for me. I dont think I fully understood the materials. This was explained so well that a ten year old would be able to understand it. THANK YOU so much.

@@FamilyAgingLawCenter Lol - an excellent and relevant point (real life v. exams). I plan (and pretty much have a job waiting for me) to work in the DA's office in Alaska (where I was stationed and still have a house) - and I mention that because this isn't going to be my "field of expertise" - but, that said, having an experienced and articulate attorney break it down so that even a layperson (or, worse, a law student, lol) can understand, was very helpful. I wish you the best in your practice and look forward to seeing more of your videos to help me better understand this important aspect of the law. Thanks for your reply and your kind wishes.

@@FamilyAgingLawCenter To add: I retired from the military and gave great thought to what I wanted to do. For brevity I'll keep this short: 1) I wanted a job that elevated my life. 2) I wanted a job that would help financially secure my future. 3) I wanted a job that when I came home at night if I told my wife what I had done that day that she would look at me with pride and think "this is the man I married" I then picked "Working the DA's office" - and we plan to return to Alaska (our home) and that will be my second career until I finally "really retire." I thank you for your kind words, and as my 2L year closes I now know "I'm going to make it" - and, yes, I am also very hopeful as to my future and glad I have made this journey. Thanks again for making this video - and I'll keep an eye out for more that might fill my brain with useful knowledge. Be well.

It’s vital to set up a proper estate whether it is an revocable trust or irrevocable trust and a living will.

Lawyers will always always come up with a list of reasons to get an irrevocable trust. The truth is is that they just want the fees to change it when you need to change it. Revocable has worked very well for me. Because I can switch anything out with out the cost of a lawyer.

YOU was Removed from owning anything from 1933 and all people born after 1933. This Lady is tell everyone LIES and the people watching this nonsense , has no clue that they are being LIED too. SHE IS LIEING to you, it is sad to see that people commenting have NO CLUE , what they are listening to, and refuse to do their own research to verify that she or any so called Trust lawyer is telling you the truth, The Blind leading the Blind as they say.... ?? THEIR is NO estate Trust that protects one's estate because YOUR so called estate has NEVER been recorded or registered properly on the land. How can you verify this information shared, by looking at your Property tax bill and the Fictitious name on said property tax bill. #.1 pay attention to how many acres you pay tax on? Land is property, if you see ZERO acres of land that you are paying taxes on, that is a MASSIVE red flag? . #2. The name as written on your Property tax information is NOT YOU another MASSIVE RED FLAG. Your FULL LEGAL NAME includes in the following order... Your Given Name and your last name. Your given name is your first and middle name IS your given name, then your Last/fathers name. Does not matter if you are married or single. So for example, Your displayed name is Louisa Keddell, now if your name was written in all caps e.g. LOUISA KEDDELL - this all caps description is not you, it is a fictitious name created by someone else, and it is fraud against you. If you have a middle name? lets say your middle name is Clair?

Thanks for the awesome, simplified overview. After watching numerous videos to acquire info, this one definitely clarified the most info. May I suggest for the future you identify jurisdiction and how broad your info applies geographically? States and countries vary widely I've now learned.

This information is generally applicable to how trusts work in the United States. That being said, I would never advise anyone to try to draft a trust themselves or to do it online without specific legal advice from someone qualified in their state.

When it comes to second marriages with 3 daughters on one side and one daughter on the other, what is the best type of trust for protection for my one daughter,? We often do separate trusts that are fully funded for situations like these. Of course, you need specific legal advice from a competent attorney in this field for the "right" answer for you.

In a case where a fraudulent Trust was created through Undue Influence & Lack of Capacity: Let's say the document is determined to be VOID by the court and the valid pre-existing Trust is accepted as the correct one. How do the beneficiaries then collect their rightful inheritance? Does the probate judge order the stolen assets to be returned and distributed according to the valid Trust document terms? How does that work? It gets extremely complicated when there's a 'bad Trustee' who is adversarial towards the beneficiaries and steals all the Trust assets.

Appreciate the video and the way you presented it. But.... 401K and IRA beneficiary designations allow for a rollover and conversion to a death IRA which keep it from being taxed at a higher rate, no? Life insurance I agree should go to the trustee of the trust but I would caution not planning for high tax at a lump sum distribution...

The distinction is in whether or not the trust is a qualified designated beneficiary for IRS tax purposes, and whether it allows for the trustee to choose a conduit or accumulation trust, or even bypass altogether. These are obviously quite advanced topics, but the point is the trust can actually be a very important part of receiving even qualified funds.

I want to make a trust with a clause that it will change according to my will when I pass. The reason is I want to be the beneficiary whilst alive (property trust/holding trust) but upon my death, I would want to change it. So, do I go for the revokable trust then? For now?

So im in a situation here. My grandpa own half a house in Arizona and put the house in his trust to give to his family. Now he has passed and the other owners of the house claim they own 100% of the house now. Is that possible?

My mother’s husband recently passed. They have a trust and she and he were both Trustees/Executors, I believe. In his will he passed on cash money to my mother and his siblings. Your funding of the Trust comments resonates with me because that’s what my concern is. Is there a window for funding the trust before things go into probate. I understand that "funding the trust" is important as beneficiaries would gain from it. I do not understand why would a home that is worth 500,000 would not be an asset listed in a trust. Please explain.

In Michigan, a home held in a trust is not an exempt asset for Medicaid.

I have most of my CD's set up with a payable on death clause. The cash is going to a charity I support. I do have some money set aside for my brothers. I also have a corporate executor through my bank. Speaking of trusts, I am a co-trustee for my Mom's Estate. Unfortunately, the distribution is not going smoothly. One beneficiary is upset about the amount of money that she is receiving, another beneficiary has his money in a spendthrift trust where he only receives so much per month.

what if you already had a will made but now would prefer to to have a living trust. Can you have both? I prefer the house to not go through probate as my invalid sister is living there and would like her to remain as she is one of the 3 beneficiaries.

In almost all instances, even when you have a trust, you also have a will. However, it is usually a specific type of will called a "pour over will." This is something to discuss with your attorney!

can you create a living irrevocable trust with a bank account number already established with say $10k deposited, the trustee and beneficiary established and all the rules of the trust (e.g. pay out annuity style to beneficiary between age 30 and 67) already established so upon death the will just deposits the money into the already established trust bank/routing account number?

hello your video is very interesting and easy to understand the initial process of a trust. I have a couple question if you could clarify, my appreciation in advance. 1. I read that in a Irrevocable living trust changes are not allowed. Is that true? So, if I have a property in this kind of trust, I can not sell the property or make any change to it? what kind of restrictions are included in this kind of trust? 2. If husband and wife do a trust can they be the trustee of each other in a revocable or irrevocable living trust? Can one be the beneficiary of the other?

In some types of irrevocable trusts, you can make changes. This is a specialty area that attorneys like myself can help in. Spouses can be each other's beneficiaries, but it needs to be set up properly if you are trying to achieve asset protection.

Do a trust, now. Avoid probate unless you love lawyers, judges, and endless delays.

How can we tell if my mother had a trust? My brother is the executor of her estate and refuses to share any information or provide paperwork. Also, If my mother’s IRA and bank accounts only have my brother listed as the beneficiary does that mean he gets to keep the money or does it go to part of the estate I’m not sure and I am not sure how to find out.Thank you for your time

You need a lawyer now to write a letter to the jerk brother. You must see all the info. All that money goes to your brother, yes. But he is supposed to divide it with you.

Welcome to my world! My older sister works for an attorney and she had my parent’s Trust “updated” a few months before my Father passed away. She had my brother’s name removed from the Trust so he wouldn’t lose his inheritance to the bankruptcy case that he was currently involved in where he lived out of state. Her boss, the attorney had no idea that my Father no longer had the capacity to make sound decisions, since his office was 4hrs away. To make a long story short, she had control of everything, she laughed at my copy of his will stating it meant nothing! I did receive a few items, mostly things that no one else wanted. My three boys have been told by their Grandpa that they were going to receive certain things when he passes, they received junk no one else wanted. My siblings had been discussing things for months behind my back, unfortunately they are now dead to me. I work with several people who have went through the same exact thing. Same story with different people.

You might talk to an attorney. I went through probate today and they asked if there had been recent changes and if my dad was in sound mind when he set up the trust. I’m sorry that this has happened to you.
