When money is involved, it changes people (greed). Be very careful about who you think you can trust. Like others have said, create a trust and have a will.

You can be angry at your uncle, but you should most be angry at your late father. He was stupid to trust his brother with so much money that was meant for you kids! Since minors (under 18 yrs) CANNOT be listed as a beneficiary on assets, the father SHOULD HAVE put all his assets (savings, 401K, etc...) into a TRUST, with the help of an estate lawyer, in which each child is named as a beneficiary with a certain percentage of the inheritance and the TRUST will only pay out each child's inheritance to him directly once he reaches a certain age, say 25 years old (as an example). If done this way, NOBODY can touch that money except for the children who are listed on the TRUST! Your father was a fool....your mother would have more than likely taken better care of that money for her sons than that greedy, irresponsible uncle!

Hopefully, more parents are learning about ways to protect their children's interests in the event that something happens to them so that the children are not at the mercy of unscrupulous relatives like in this story! Trust the laws to protect your children, NOT relatives, especially in the Hmong community since Hmong people DON'T have a good reputation/track record when it comes to caring for orphans!

😢 I hope you and your brothers can forgive your uncle even if he doesn't apologize. Your uncle knew your Dad trusted him but your Uncle betrayed your dad's trust and failed all 4 of you immensely; but it's alright. Forgive and continue moving on with your life and with your family.

All 3 are at fault, dad, uncle and grandma. I believe your mom was your late father's rib. After they divorced everything went downhill. Glad you are all doing well and you have a good mom who stepped up!

You have your dad’s diary, you can use that as proofs that those money are rightfully yours. Hmong people need to learn to use the legal system of putting money in trusts. Your dad shouldn’t have trusted your uncle. The court could’ve assign legal guardians to manage that money for underage children.

Its not too late to report him to SSA for misused of your funds as a representive payee for you brothers. Let SSA go after him. If you contact SSA, you will know how much survivor benefits each of you brothers were getting. As a payee he cannot use your money for himself at all.

Minors CANNOT be a beneficiary. The father should have created a TRUST with the help of an estate lawyer so that all the money goes into the TRUST and only when each child reaches a certain age (determined by the father in this case----mid to late 20s is generally a good choice since the kids will be old enough and hopefully responsible enough to use their inheritance wisely) will the TRUST pay out the child's share of inheritance money to that child, no one else.
