As we were getting back to the mothership from stone crab hunting I saw a vessel coming up behind us and a voice yelling out asking if we’ve ever been boarded by the Coast Guard.

The Coast Guard aren't the police, who get their authority from the legislation of the state or district that they're in. The Coast Guard gets their authority directly from the Constitution / Department of Homeland security. They do not need a warrant, probably cause, or anything else that a police agency would need to do an investigation or search and seizure or inspection. They bypass the 4th amendment entirely. They'll usually hit you on the radio with "prepare to be boarded by the United States Coast Guard". If they ask for permission, they're just being nice.

14 USC 89 has its roots in the Revenue Service Act of 1790 which provided “all collectors, naval officers, surveyors, inspectors and the officers of the revenue cutters . . . to go on board ships in any part of the United States . . . for the purposes of demanding manifests . . . examining and searching the said ships, and the officers shall have free access to the cabin and every other part of the vessel . . .” This statute was passed by the first Congress, the same Congress that enacted the Bill of Rights, including the Fourth Amendment with its guarantees for citizens to be secure against unreasonable searches and seizures. By enacting the Revenue Service Act, the first Congress showed unequivocally that the Coast Guard’s significant law enforcement authorities to board and search a U.S. flag vessel anywhere in the world, as well as vessels intending to call on U.S. ports, were consistent with the Fourth Amendment.

How many miles were you guys off the coast with more countries it's 12 miles with the United States it's 24 miles off the coast they can search you yeah it's b*******, I'm not sure if it matters if your boat is American flagged or registered in America or another country but no matter how you slice it it's b*******😎

Try reading the Revenue Service Act of 1790. The US Coast Guard is authorized to halt, board, and inspect all vessels in US territorial waters, and all US vessels anywhere in the world not the territorial waters of another country.

It IS an invasion of privacy. The notion that they can stop you for no reason and search your home looking for a violation rather than needing to have probable cause or a warrant is abhorrent.

We didn’t mind much. It was just bad timing with us being soaking wet and hungry. I’m just glad to have it over with. We probably needed to have an inspection done anyways. I think the 2 younger ones were trainees maybe in their fist year. They were all nice and it was best to just cooperate and let them do their thing.

Coast guard have been very professional in my interactions with them. It’s comforting to know they are out on the water, they are the ones we can call on in dire times

@@Dhjkv Sure. They're very professional. Are you OK with the police randomly deciding they're going to enter your home and "inspect?" You're watching Disney Channel with your kids and there's a knock on your door. "Police inspection!" They say. They come in, look through your house for violations. After half an hour or 45 minutes, they PROBABLY leave, maybe with a list of violations you now need to fix. But they're VERY professional. Polite, too. All good.

These are the guys that work very hard to stop drugs from entering the country. Besides every boat owner knows no matter what country's waters you are in their coast guard has a right to board you.
