I have no idea what you mean when you say the US has a uniform civil code. For example marriage laws are set by individual states and each state has different set of regulations relating to that, which again differs with race and religious denominations (Eligible ages, statutory minimums and so on). They are quite touchy-feely about their states’ rights! That’s just for the citizens. Coming back to us, I think the idea of implementation becomes difficult to fathom when you seriously consider all the different laws for religions and tribes and states as well, and then discuss and decide inclusively and with some modicum of consent from the stakeholders there, while removing the current discrepancies within those laws and the current criminal codes and fundamental rights violations and striking a balance between what law should be simplified and is acceptable to at least a majority among the concerned parties, what the code should look like. Even that sentence was pretty daunting! Of course, the other idea is to impose the HMA, HSA and so on, on everyone. Then it’s quite fathomable actually! And yes. Sujit, you just did what I wanted, that is someone to unscramble this scrambled egg of UCC. I realised today that UCC means only those personal laws that involves marriage, divorce, adoption and inheritance. The suggestion by the law commission to carefully choose few personal code of different religion and bring uniformity in it in a gradual process. I think it makes sense. BUT this must be done ONLY after the 2024 election. If done before, a perception of political polarization will creep in the minds. Keep it up. Very educating video.

To see everything being equal from a bird’s eye view, things will look beautiful and perfect. Though the Uniform Civil Code speaks about equality, it is something that is hard to achieve. It is hard to achieve mainly because it focuses on an individual’s personal matters - Marriage, Divorce, Adoption and Inheritance. I’m my personal opinion, there is Beauty and Unity in Diversity. If all five fingers were of the same length, lifting even the lightest of object would be a challenge! The Uniform Civil Code should be based on EQUITY and not on EQUALITY. The arguement of "how much the state should interfere in personal matters?" completely disgards the dicrimation against women and children & violation of their rights but our champions of Gender Right activist are absolutely quite and seems okay with it. This question wasn't asked while forcing amendment to the Hindu Personal laws right after independent (AND I'M GLAD, they forced this changes). But my question is that if it can be forced on Hindus and if it is completely fine to do so then why not with other religions whose practises are far more draconian and regressive. Why do Muslims oppose the UCC when it is certain that the UCC does not affect the religious ceremonies/rituals/ worships/beliefs/ celebrations/culture/ language/food/ dress/occupation occurring in the life of a man or woman of a religion/tribe? Because in the name of the stone deity of the Makkah panchayath: 1. Muslim male want to grab the whole property of the parental inheritance. 2. What the law commission has said is the most logical answer to UCC. All personal laws of all religions in India must incorporate certain 'minimum' standards into their personal laws that would ease family and personal life. LGBT issues must also be addressed in those 'minimum' standards. Abolition of caste system must be incorporated into set standards in personal law. That's all the goverment must do and nothing more. Implementation of UCC is time barred according to the Limitation Act.

@@venkatesh1657 sir venkatesh. For clarification and information. Triple talaq is not a part of Islam. Muslim people misused it. In any divorce proceeding there is a procedure laid out in quran. This procedure is similar to the one laidout in the indian family court procedure. Secondly any women after divorce is free to marry another man and continue her life. In hinduism , there is a social issue of women abandoned by tgier husbands, neither divorced and also cannot remarry. . In islam women are allowed to seek divorce and dissolution of marriage as a right.

I have no issues with the UCC. I would like to point out as a Goan. We have had UCC even before we became a part of india in 1962. Its applicable to all Goan citizens whether they are Hindus Muslims Christians et all. Clear provision is all marriages in Goa have to be registered and they come under the UCC. This ensures EQUAL RIGHTS to WOMEN. Property is 50-50. Many who are setting in Goa today get married in temples mosques but go to their home States to register their marriage!!!! This govt am sure will implement UCC. I HAVE no doubt. It is INTERESTING for me to see how they will do so. As the government to date has handled changes n laws in a ham handed manner. De-monetisation, GST, 370, etc. How will they be able to implement 50-50 for Hindu women. Will the male Hindu accept it. What about undivided law n benefits for Hindus. Sorry I'm not being communal but just wondering. Will the govt not get into trouble with hindus as it is their vote bank but implement UCC for all other's And another issue What about the tribes??? Every Street Every village Every town Every city Every district Every state Every country Has different civil code even irrespective of religion. The way people get married are different, can we bring in uniformity in getting married? The way people deal with family and the society sorrounding them are entirely different. The way people do and customs during death are different. The way people deal with divorce are different. Some religions permit polygamy But where it prohibited, people bye pass and get married many women. This is true in case of very high profile businessman, celebrities, Billy wood actors, and definitely many politicians. It happens in lower strata of the society too, in some unorganised human dwellings. But caught in between is the middle class totally confused for re-marriage. As long as there is no problem with the local civil codes and ifvit doesnot disturb law and orders or the individual rights, there is no need for a UCC. Now people are just finding right time with this "Bait" so that people get confused and fall prey to the motives.

Is UCC required in India? India is a country having a proud history of diverse cultures. It is better to be in a country called “Unity in Diversity". Where will this UCC take us? I believe UCC should have been applied equally across all the mainstream religions. This, I believe is one reason why women were left behind in the Muslim community. Once we have given ourselves the constitution, it should override the civil code within each religious text, be it based on religion (like Islam), region (like Goa), groups (HUF). Civil code of religions made for a different time and age and ripe for misuse and discriminates against women.

Before implementation of UCC please demolish all HUF or Hindu Undivided Family laws and concessions. Similarly stop all kinds of reservation quotas for SC/ST/OBC of the Hindu community but which dont apply for Muslim, Christian and other communities as we too have SC/ST/OBC in our communities. Under UCC all Communities from A - Z should be treated equally for anything and everything.! 🤔

First bring or regularise the law of equality for any man, woman, transgender or LGBTQ. All caste, religion are equal. This law exists but not implemented all the time everywhere. Only after this law is regularised, other can be brought in.

Although on paper our criminal law is supposed to be the same for all but is it really so? I don't want to go into details and name names, but I'm sure you get what I mean!

Wonderful editorial. Very well explained from all sides. I personally believe law is made to protect citizens and not to make them behave in same manner. Certain personal things must be left to individual. Otherwise tomorrow they will bring a law that everyone has to wear saffron dress on Tuesday or has to observe fast on Monday. At the same time if women are not protected in a certain community the law must ensure that which I think triple talaq has already done. I believe in what law commission suggested.

As a hardcore critic of BJP, I always wanted UCC to happen. Especially against the polygamy marriage. If polygamy marriage is banned in Muslim the BJP wouldn't be able to manipulate hindu voters in the future. They can't say love jihad, they can't say minorities are danger to the nation. And morally also Polygamy should not be entertained to any religion or communities.

It is a stark reality that strong gender discrimination exists in all religions/tribes in India. Actually it should be called "Gender Equality Civil Code". UCC has many advantages and some disadvantages. It is time we move away from religion based civil code and move to a civil code based on modern value which is in keeping with the times. Since UCC deals only with marriage, divorce, adoption and inheritance, the simple solution is to have UCC as a default civil code with the option given to couples to decide at the time of marriage (say within a max period of 6 months after marriage) whether they would want to adhere to UCC or any other code of their choice for the whole of their lifetime. This should be permitted to the couples only once, even if one or both of them change their religion later. A registrar should maintain this record. If the couple does not register their choice of code then UCC should apply by default.
