An unincorporated association has been judicially defined as: “[T]wo or more persons bound together for one or more common purposes…each having mutual duties and obligations, in an organisation which has rules which identify in whom control of it and its funds rests and upon what terms and which can be joined or left at will. The bond of union between the members of an unincorporated association has to be contractual.” (Conservative Central Office v Burrell [1982] 1 WLR 522, 525, Lawton LJ)

Quick question, just in regards to a charitable trust, how would this relate if in the will they stated that they want it used for a specific set of members, i.e only for women but the organisation specifically supports all genders

I thought that a church could be a non incorporated trust, that could hold property?

The church has historically been outside the jurisdiction of the courts. Christians are stewards or trustees for Jesus the beneficiary. I believe what you seek can be properly set up, but I'm not sure what the proper terminology would be. The Bible clearly teaches that God owns all the land, and as the steward of God's land, there should be a proper way to express this to the world and any government. Not withstanding all their problems, the Roman Catholic Church most likely has books that have been written on "owning"/managing property for God .... they know how to handle property.

Please explain. The purpose of an unincorporated association would be to avoid having to deal with laws and regulations that only apply to corporations or other dead entities?
