Unwanted Roommates

The plaintiffs rented an apartment to the defendant. They claim the plaintiff threw parties and left garbage everywhere. The plaintiffs say the defendant is trying to use the security deposit to pay for her last month’s rent. They’re suing for rent and additional expenses. The defendant argues the plaintiffs were always at her apartment, and she didn’t enjoy that. She’s countersuing for overpayment of rent.

The plaintiff doesn't know what "a couple" means. Her husband admitted he was there 4 days out of the week. They were very deceitful people and can't seem to be honest about much. I wonder if their daughter was actually involved or if they pretended to be her via email. I know desperate times call for desperate measures, but I don't think I could ever get or become a roommate with total strangers. That has to be one of the most uncomfortable living situations ever.

The defendant should have filed for fraud against the plaintiffs for how they lied in the ad. Not to mention how the dad stayed much longer than default lease requires. I think she would have been awarded if she did had claimed fraud.

Plaintiff woman is a liar! Says her husband was there only a couple days a week for a month. He said it was 4 days a week for 2 months. At least he was honest. Defendant should have called the police the minute she found a man hanging out in her apartment. Then, if necessary, she could move out for breach of lease. This reminds me of a house i rented in the past and then the landlord not only moved a man into the garage but the landlord started sleeping in the unfinished basement frequently even tho he was married with kids and lived in a whole other country. I left after the one yr lease was done.

I usually agree with everything judge rules but I think she's wrong on this one. These people were not supposed to be in the apt at all. If it were the other way around and the tenant had a man in the house 4 days a week, would have their been some recourse? I'm a landlord and this shit would have pissed me off if my parents were doing this in my apt with my tenant. And I agree, the dog was probably stressed with a man in the house. A lot of dogs don't like men. She should have gotten at least the rent from when the bad thing happened in November when the male creatures was there. False advertising big time. Even if she is a slob, that's not a reason to tell her to take garbage out every day. Bet it was like having her mommy and daddy around 24/7.

You can't dictate to a person paying rent that they can't leave a dish in the sink and that trash needs to be taken out EVERY DAY... GTFOH... I think the plaintiffs were definitely crummy and deceptive. I'm curious why the defendant stayed. find another place to go if you're not comfortable. not blaming her, but if I was in her situation I would have got the hell outta there as soon as I found out it wasn't what they initially told me. people who lie about one thing tend to lie about more stuff. its also not a stretch to think they are also the type of people to start other problems.

I rarely comment on these court cases, but this case is absolutely pathetic and I have no idea how the sleazy, lying plaintiff was awarded a dime. First off, she clearly stated that it is her daughters apartment and that they agreed to pay 1/2 the rent so the daughter would not lose the place while out of the country for military training. For all we know her daughter could have been in jail or prison for one year. 2nd of all the plaintiff was NOT the landlord, so how was she able to file a case? The furniture in the home belonged to the daughter so how was her mom able to sue for damages? The CL ad was false and misleading. I think the nosy plaintiffs intentionally went to the apartment to keep an eye on the tenant. It's obvious the plaintiff is a busybody with no life of her own. The husband smoking in the apartment and being there 4 days a week interfered with the tenants privacy, peace and enjoyment of the property. The Judge should have given the tenant a rent reduction for all that she went through, but in my opinion the case should have been dismissed because it was not the plaintiffs apartment. I am sure they have been doing this to other tenants and getting away with it. They intimidated and walked all over that poor girl because she's very young. Not everyone would have tolerated their BS.

Sometimes you know your landlord will screw you out of your security. I lived in northern California. Great tenant. I did everything right. I've had 12 landlords from 31 to 48yo. I used my security for last rent because the landlords did not follow the laws. I'd I moved into a property that bed bugs untreated with sewage coming into my shower. They blamed me for those issues that was not disclosed. Also, another landlord had her worker man in my rental without my permission for no reason. Muddy sho prints and black grease in my sink. I had a male friend stay for four days and she called the cops. Legally, I can have a guest for two weeks. I don't like landlords that don't know tenant/landlord rights and responsibility.
