The problem is your selling a 40 or 50 grand car with a million miles on which is just going to break constantly and the 6 grand customer who can't really afford to run a car like that is expecting a new car

You are 100% on the money. The first and second owner are in a different financial position than the final owner buying a car with so much technology it has become a money pit to run. A 50 grand second,third or fourth hand car still costs as much to run and service as when it was brand new. Probably even more so if you want to keep it running like its brand new. There’s a reason they are cheap and that the backstreet type garages are flogging them with worthless warranties instead of the main agents keeping hold of them. Once the owner has had a load of hassle getting this problem resolved the next problem will follow and it will be a bottomless pit of problems. It’s a spaceship with millions of miles on the clock. You can tell you’re going to have issues when the guy in the vlog even admits that they tried several different types of air suspension pumps before they found one that worked because clearly they are out of their depth with the technology themselves.

I think that makes a big difference. If you are mechanically minded and enjoy the maintenance side of ownership as well it’s not such a problem. I have enjoyed maintaining my motorbikes over the years but when it comes to cars I haven’t got a clue what I’m doing and would be reliant on the dealer or my mechanic to help me out. Buying anything with space ship miles is always going to be a bit of a dice roll, you could get lucky and buy a we’ll maintained vehicle or could end up with a right lemon.

More likely her mate’s mate Dave “who knows about cars” has had a look and given an “informed” opinion. Dave used to work in some generalist garage and has “seen this exact fault hundred of times before.” This is of course despite Dave having never worked on a Q7 but has worked on Land Rovers. Dave knows any Audi dealer would charge £168 to diagnose it so he’s saved her a ton of money!

I think the 'perception' when a buyer spends £6.5k on a car is it should be functioning and faultless. But you have to balance that with the age and mileage, it's a 2007 car with 146k miles on it, it's a 16 year old car, so it's quite an old high mileage car, it's not going to be perfect by any stretch of the imagination and things can be fine at the point of sale but a fault can easily develope after 3 months or so, where do you draw the line of liability for such faults? My 2006 ford focus has just 128k miles on it and I paid £550 for it 6 years ago, for some odd reason its now worth a lot more! I've had 6 years of faultless, trouble free ownership, if it developes a fault, do I take it back and complain? No of course not. To be fair, I personally wouldn't pay anywhere near £6.5k for a 16 year old car with such high miles but I guess some models hold their value and people will pay for them. I just don't see how they can complain when they go wrong because inherently anything mechanical will eventually go wrong!

I've had a nightmare situation as a customer with Ford on a nearly new top spec Focus that had been in a flood unbeknownst to me, after 6 - 7 months of constantly returning it and them not being able to fix it, and them also not being able to find a like for like replacement I still just paid the difference from what the shortfall was on my trade in and walked away. I could have made the dealers' life hell, I could have kicked up a huge fuss but at the end of the day they had tried a couple different routes and weren't able to sort the problem, and I was happy to part with some money and walk away without a car for my own peace of mind. It baffles me when I hear these stories that people have the energy or spare time to go through these hearings and court procedures, life is short people. Cars are just metal and rubber at the end of the day, and sometimes they go wrong, end of story.

Independent witnesses/inspectors/experts can cause havoc, I remember when my parents' fireplace front glass exploded (and I mean exploded) in front of me, taking out the TV and other furniture. The independent glass expert said that it couldn't happen with this particular glass and we lost the court case.

Should have been thrown out at that pre-trial hearing, look up 'privity of contract' ..... the judge had no right to 'give options' he/she is not there to give legal advice, to either party. IF she pulls out, be sure to counter-sue. Refuse the direction for an 'independent' survey, they NEVER are!

7 months isn’t outside the consumer rights act 2015 though. They just have to prove it was there when they bought it and if it’s part of the same issue Ie the suspension then I’d imagine they would be sided with at court. Also a log book isn’t proof of ownership. Surly they would want a receipt of sale? Unless that was in the aunties name?

This is laughable. I would be mortified if I were her. It’s amazing what the general public must think. This should be put to bed immediately, even if you were still willing to work with her (and probably repair the fault) after any warranty/guarantee period says a lot about your business and how you like to look after your customers. This lady does not deserve anymore of your time, you’ve dealt with this perfectly! This stuff goes on day in day out and yet a lot of people still think dealers are the cowboys and conmen. I had something very similar ,while working at a garage , Customer called in and asked if I could fit a water pump on his 3 series BMW ,he booked it in , The car turned up on a toe truck which I did think a little odd ,as most people we see drove there cars in ,even with major leaks I fitted the pump bled the system had it running and checked for leaks and temperature which was all fine I told the customer to keep an eye on water levels and temperature,,as we had done the job asked ,wealso did a block test ,but everything was showing ok at the time ,but because we didn't know the history of the vehicle and how long he had driven with a fault ,and even told him to pop back anytime so we could just check over if he was unsure Customer collected all ok , 4 months later had court collection officers turn up to take goods in the value of 4k ,got onto my head office which payed the money but also disputed the claim We then had to appear in county court ,where the customer,turned up with his mum , The car had supposedly broken down ,been toed to another garage where it had been diagnosed with a head gasket blown , The judge turned to us and asked about our warranty procedure,which we explained was 12momyhs ,and we had not been contacted about inspecting the car or repairing the fault if it was down to us When the judge turned to the customer and said will you let them have the car to do the work under warranty if it was a fault caused by us The customer replied we can't because we don't own the car anymore , The judge replied,so your trying to claim money for a car ,you don't no longer own ,they replied yes but we didn't get the full value for because of the head gasket ,The judge then asked who bought the car , family or friend ,the customer replied No the other garage who diagnosed the head gasket Judge then gave them court cost also asked myself and my area manager if we were out of pocket for the day which we just said no , We were told to leave don't know what happened to them after we left the room

Problem is people see a once £50k Audi for £7k, and expect £7k car running costs. I'd love a 330i, and I could afford one that's about 5-6 years old. But when I think of the cost of services, the cost of any repairs it might need I realise it's not the right financial decision, however when I move up the ladder at work, I definitely plan on treating myself to one.

Independent vehicle inspectors are not to be believed.... Brothers camper got run into by a car. Car left his tyre marks on the side of the camper. We could see by the marks that the car had turned into us yet the driver claimed we steered into him. The inspector said you can't make that assertion by the marks. We tried to explain the physics behind it but he got more upset that we were proving him wrong.

I don't really understand this story.. I've bought many cars in my 45 years experience cars simply go wrong. Give you couple of my examples back in 1986 I bought from a Ford main dealer a ford Capri 2.0s came with a warranty (which I don't think its worth the paper its written on)I had to pay for a wiper motor replacement. The bill was around £60. Would never trade a car let alone buy a car or van from a dealer again.. But saying that I did buy a Ford Transit high top van from a main van dealer in South Wales.. Basically I had wheel bearing issues. I learn about mileage /parts needing repairs, and concluding my wheel bearing replacement was to last around 35.000 miles, only fronts go and one other item was the outer belt connects the water pump alternator and whatever, snapped at 100.000. The van had 77.770 miles on it. had it nearly 6 years on finance. But my anger was the van never lasted till its first installment payment. On rocky budget lack of work, low pay bla bla bla. 3 month or 3000 miles whichever, the garage screwed me out of £200 to repair. My van for December payment cost me well over £379.14 (van payment £179.14)Then my expensive insurance £141.25 and my loan repayment of £224.50. I started with a LOAN of £2500 of which £995 +a years van tax and a deposit on insurance.. I also bought a car recently within last 2 years and mainly my own fault because I should never have bought it.. A lovely Audi A6 2.7 TDI.. some service history, my concern on purchase was the tyres.. But evident my front tyres was in a shocking state.. That cost my £400 for new tyres Avon's from National tyres I expected them to last lots of miles. I had car serviced at a garage where its history was showing.. On mot (my 1st)it flagged oil leak from sump plug. It really never bothered me as on Audi if your car needs something your dash light will flash. So the next MOT I told garage the oil leak issue. Never in all my servicing days have I had a car loose its oil on service..(Why fit a non standard sump plug)? VAG One kind of sorted it my oil low level came on after 30 miles. I am getting bored of my problems with my cars and van, my choices when it comes to trying to save money on general wear n tear items.. My £400 pound tyres were cracking in there tread pattern..? Going back to your car sale, You repaired it, the customer wasn't happy, Sod court Offer them a refund, be smart charge them a kind of rental charge in lieu of ownership. Most issues are sensor related.

I had a customer that never paid me or many other contractors in town. he had the audacity to ask me to refinish another floor for him. I took my 6HP drum machine with a 24 grit belt and carved a giant Union Jack flag pattern in his oak living room floor about 1/4" deep. I was ordered to pay 7400 dollars to the customer by the court system. It was worth it though. Normally i would feel bad about ruining antique oak, but the place was such a dump anyway.

When I worked at a Ford main dealer in the 'eighties we had a guy come in who had just bought a new Granada. He boasted to my colleague that he had just had a full refund from Volvo on a two year old car and that he would do the same with Ford. When I left two years later that was exactly what happened due, apparently, to an unresolved brake judder.I am a gentle person but he had a manner and face that caused hostile thoughts when you saw him.

Send the claimant an N266 (notice to admit facts), and ask for the diagnostic report, + itemised details of all that's being claimed for, and costs of same. It's VERY unlikely that there will be any sort of response to the N266, and if there isn't you can apply for the claim to be struck out as an abuse of process. Not a good idea to get "experts" involved, as this will be very costly and can probably be avoided if there is no response to N266.

CPR r. 32.18 doesn't apply to the small claims track.

@@badwolf4058 I wonder are you legally qualified? Justice Eady seemed to think the N266 does apply in the small claims track, and issued an unless order, in respect of a claimant who ignored an N266. Ultimately, the claim was struck out as an abuse of process, for failing to comply with unless orders.

I spent several decades in the retail trade, and one thing you can't fix is stupid, My favourite was someone that bought a pentax camera in the late 80s, bought it back 6 weeks later dead as a dodo, he wanted a new one but we sent it back to pentax, that returned it as sand contamination that voids the warranty, he takes it away then comes back and says he is not disputing the sand is in it but..... wait for it.... the sand got into the camera after it was faulty, i nearly laughed at him, but this was a spoilt 20 year old i realised this because his mummy then took us to a small claims court, the judge then says to them go and get a report that proves it, of course they couldn't mummy comes in to tell us that they are dropping the case and her, her family and everyone she knows..... that's about 4 people will never buy a camera from us again, she spent more than the camera was worth and still has the doorstop no doubt :)

Nope, wouldn't stand for that! Maybe 3 weeks and 600 miles since repair, but 4 months and 7000 miles is where I'd flatly refuse to deal with a customer. It spells trouble! 7000 miles is a years commute to work and back for many people. Customers like this, who get away with it, probably try this trick all their lives and cost all other motorists a higher repair bill for the garages to cover costs, a bit like how it was with uninsured drivers causing accidents. Leeches!!

Name on v5 isn’t proof of owner , it’s only keeps name . Judge not sure of the laws in ownership of car,

Just seeing this video now. The other party sounds dishonest and obstructive from you what you said, and I don’t think they will come back with the judges options as it all sounds fraudulent of why it was put in her aunts name, it will not go anywhere
