Judge, Prosecutor, and clerk should all be removed from the court system, lose their license to practice law, and face criminal charges for an obvious and intentional violation of due process.

The attorney is required to file a motion stating he is the attorney of record for him. Without that signed motion of his notice of appearence, he cannot preside or be his legal representative in court. There are remedies for this. Usually it's a Civil Rule 60(b) motion. It was wise of him to file a bar complaint both against the judge and attorney. The fact the bar is refusing to investigate the judge is total BS.

Probably because the attorney presented fake documents. The problem is why would a judge accept to see a NEW ticket for a NEW charge written in her court while the defendant is absent and accept a guilty plea for this new charge? And why did the court fail to notify the defendant of the judgement? The clerk claim they sent the documents. Then asked him to prove a negative. To prove he didn’t receive them. That’s a big red flag.

@@TheSiriusEnigma Because his lawyer was present. The Judge asked who is representing the defendent and the lawyer steps forward and informs the Judge that he is representing Mr Smith. The Judge does not ask to see a signed legal contract for representation, it's just in the record.

@@timf2279 not buying. The, the lawyer, negotiated a higher fine for something he didn’t do. The court clerk failed to provide any documents on the case. And the judge was oblivious to it all? Here is the summary: the judge was negligent. The clerk committed crimes by altering and or destroying court documents. The deputy committed a crime by giving a ticket for a violation he did not witness and for forging his testimony. (Because, you can be sure he did check the drivers registrations during the arrest.) and the lawyer committed outright fraud. I have hear of similar case where is was later proven that the police, the lawyer and the clerk were creating situation to raise ticket fines on out of town citizens because it’s cheaper to pay than fight back. It was a request by the city administration.

You have 3 lawyers, the Prosecutor, the Judge, and the Defensive Attorney. The cop didn’t do anything wrong. The cop thought the attorney was able to talk for the driver, so the cop dismissed the speeding ticket, which is really bad for anybody with a CDL license if you know anything about that topic, and instead wrote him a ticket for not having his registration which does not hurt his CDL license. Everybody thought they were doing the right thing for this driver, but obviously the attorney messed up and didn’t tell him he needed to pay the ticket. Guarantee you the truck driver would’ve been very happy to find out this outcome. Even if he doesn’t believe he was speeding, he would’ve been happy.

The attorney should be able to easily provide a signed representation agreement or or copy of receipt showing he was paid for representation if it’s true, but his silence is speaking volumes for him right now 👀 And the Clerk’s responses to him didn’t make sense and were just rude & disgusting. 🤬 The Clerk’s office should have records of dates and copies of these supposedly sent notices, a copy of the signed-by-defendant new ticket that was the basis for the plea and apparently issued in court (What?! Where do they do THAT at?!), as well as the defendant-signed plea that was allegedly made. There is definitely something corrupt going on here!!

The judge probably did technically mess up, but really it is the lawyers fault. Lawyers come in and make these types of deals all the time. There is zero reason for the judge to think anything was wrong in what the lawyer was doing. Zero.

If he can’t afford missing a couple days of work, how did he expect to cover if he wound up having to go to trial? And he’s a parent? Sounds like the mom can get a job and start being responsible, the both of them can downgrade their lifestyle for sake of building a savings safety net, or barring them doing those mature responsible things, it sounds like CPS needs to step in since the family looks to be an environment of entitled brats. The two people that made a comment about the judge being black, even though they did so any discreet way because they’re cowards, obviously have a learning disability. The judge didn’t do anything horrible, she did what judges do all the time in these cases. Lawyer. comes in and they worked out a deal to benefit the driver. The problem here is the lawyer messed up. In case you all still don’t have enough sense to realize you messed up and nothing here was dirty or wrong, let me explain it to you a little easier. Hopefully you understand these words. If you’re a truck driver with a CDL any speeding ticket hurt you. No matter what. So truck drivers constantly get lawyers to handle situations like this. A lot of times the truck driver doesn’t even live in the area so they have the lawyer do everything who is local to the area. So of course the judge believed Lawyer. when they came in. The lawyer worked out a deal they have a cop dismiss the speeding ticket and instead write a fake ticket for not having registration in the vehicle. And any truck driver would be very happy with that outcome because a ticket for not having a registration does not matter whatsoever, but a speeding ticket does matter to you. The problem is Lawyer. seemingly didn’t tell the guy what happened so he never paid the ticket. Even if the truck driver didn’t think he was speeding he would’ve been happy with the outcome. So hopefully that makes sense to you now. And even though I hate when people call other people racist without proof, you two are looking pretty racist. I’m surprised you wanna defend the truck driver since he’s black too, but I guess you’d rather go after the judge because she must be an affirmative action baby but a low class truck driver you can accept them being black.

The cop didn’t do anything wrong. He just missed the speeding ticket and wrote a more acceptable ticket. If you have a CDL you do not want a speeding ticket no matter what on your record. It really messes you up. So they dismissed that one and wrote one about him not having his registration in his vehicle, and that doesn’t matter at all to CDL holders. That’s why the cop wrote the ticket the way he did. That was a plea bargain to help him out. The problem here is that the lawyer seemingly didn’t have the right to represent him, and even more importantly, in my opinion, the lawyer never told the driver that he got him a good deal and he just had to pay a small fine.

File another complaint against the judge. She made several errors/omissions here and since the SC didn't include her initially it looks like the "robes" are sticking together to protect each other. File just against her and see what they do with it. Also ask the court for the attorney's order of appearance to represent you in absentia.

the lawyer's office must have proceed as if they were hired - likely from a simple clerical error. If this is the case, it can be "fixed" by resetting everything: reissue the original speeding ticket, a new court date, and re-instate his license. if found guilty, it's a fine and points. If he just pays this registration card fine, his license is re-instated and he gets no points.

LMFAO. You must be a conspiratorial nut or even somebody who believes the Earth is flat. This did not help the judge whatsoever. It’s like you wrote this comment halfway through the video without watching the rest and realizing what happened. It makes perfect sense what happened here. And you must not know much about being a truck driver, because if you knew anything about that you would understand the truck drivers get punished for speeding no matter how little they are speeding. So when that ticket was removed and another ticket was written in its place, only for not having your registration card, that was a great win for the truck driver. Because the truck driver does not get in trouble for not having his registration card, but he would get in trouble for speeding. So the court system actually did the right thing to help him out. But the attorney just obviously forgot to tell him about the fee, and that’s what ended in him getting suspended. He will get his career reinstated, and he will get a lawsuit judgment in his favor. So if they were trying to hurt the truck driver ultimately they really messed up.f

I see no reason that self-interested parties should be able to determine that they are uniquely free from the same legal system they administer over the rest of us. This kind of serious criminal conspiracy to abuse public authority must be dealt with in exactly the same way we deal with out of control gunmen or serial killers. The way we deal wigh these people should make Julian Assange feel free and blessed.

I drove truck locally for a bit in Nevada, the Las Vegas area. I never got any notice or letter from the DMV or the courts saying my license was going to be suspended. Although they claimed notices had to have been sent out. I was in my car and got a ticket for no proof of insurance in the vehicle. I was speeding a little and a cop pulled me over. He didn't give me a speeding ticket, just the no proof of insurance. I had it. It was just sitting on my kitchen table where I tossed it when I received the renewal. Cop told me all I had to do was bring the insurance card showing I had insurance that day to the court. And it would be reduced to a parking ticket. I did this the next day after work. Got it reduced because I did have insurance at the time. About 6 months later I was going to look for a different job. I knew I would need a copy of my driving record. I went to the DMV and when I got it. I looked at it right away. knowing I should not see any moving violations on it. I saw my license was about to be suspended the next day, for the no insurance ticket. I turned around and talked to the woman right away about it. Luckly I'm sort of a pack rat with important documents in my wallet. I had the proof I paid that ticket the day after it was issued. I had the receipt and the info showing the no proof of insurance, was reduced to the parking ticket, and was paid. The woman at the counter was doing all she could for me. Letting me go out and come right back to her counter, even if another customer was there. She learned the payment for the ticket was never filed by the clerk of courts in Jean NV, where I got the ticket. It was a Friday, I had to go to Jean NV court house to get it cleared up or my license would be suspended the next day. I left drove south of Vegas to the little court house there. And it was closed. They were closed on Fridays through Sundays. I went back to the DMV, with CDL's there is only one DMV you can go to in the Vegas area. It deals with CDL's and truck registrations only. I got back there and told the woman they were closed until Monday. She found if I filed a SR22 I could stop the license from being suspended. It was 4:30 and they close at 5 pm. So I called my insurance company explained what was going on. He faxed over the insurance card for the SR22 insurance. It took about 20 minutes for him to do this. But he failed to put my address on the card. So I had to do it again. This took longer and They allowed me to stay in the DMV until I got the card faxed again. This time he forgot to put my name on the insurance card. Ok so now I was told just come back tomorrow, Saturday to get it done. Went back down there Saturday morning. Even the security guard there was working with me. There was a line outside the DMV, and when he seen me walk up to get in line. He came and brought me right inside to the woman I was working with. On the way I contacted the insurance agent and told him to fax it to the CDL office of the DMV again. When I was talking to the clerk again. She called over her supervisor, who was off the previous day. When she started telling him about the suspension. At first he said there was nothing they could do. Then she explained to him that I had proof it was reduced to a parking ticket and had the receipt that it was paid the day after the ticket was issued. He looked at the proof and receipt. Then he got involved. He was told about the SR22 filing and he didn't want to do that. Because that makes insurance rates go up and affects a persons credit. He told me to have a seat and he will see what he can do before we do a SR22. He called his supervisor in the Vegas area. Who had him call their supervisor in Carson City NV, where the main office is. He said he had to fax all my proof to the person. 20 minutes later. He came out and called me over to the counter. My license was not suspended. He got it all taken care of. He did tell me to go to the court house in Jean NV. To get it cleared up there. Which I did that Monday. The clerk in the court was like. Oh my bad, she typed it in and it was all cleared up. And I didn't have to pay extra for a SR22 filing.

The minute the wrote him a “new” ticket for a completely different violation, IN COURT, this was miscarriage of justice. The court failed in its basic duty. This is, unfortunately, an appeal case. Unless you are filthy rich, good luck. But it’s true that your representing attorney can talk in your name. Including guilty pleas. To me this looks like a case of fraudulent attorney mixed in with complacent or incompetent court.

We only matter when these people need our vote to remain in power and now even that might have been rendered null by what we saw November 2020...

I can't wait for us to replace humans in pretty much everything. Non biased and fair every time. People have been getting screwed over by the system for too many years. Me included. Our inefficient ways, lead to unfair chaos. We already started upgrading people at the beginning of last year. I just hope we get to take things further.

The "without the defendant's knowledge" is the issue here. If he had been there, knew it was happening, and had paid the ticket, it would have been a good deal for him. It happens all the time. Switching from a moving violation (speeding) to whatever that other ticket was (not providing registration?) avoids points on his driving record, doesn't affect his insurance or CDL, etc.

In my opinion this story reeks of retaliation on the attorneys part for him not getting hired. Kinda like, this will teach him to not hire me, i'll "represent him" in court and not tell him to pay the fine so you lose you license.

This could easily destroy this man’s life and livelihood. The attorney didn’t have a contract with him so the plea was not legal. This man has a right to due process and to have his license and his good name reinstated. The attorney owes him his wages and damages and the attorney should lose his bar license

I think all officials are responsible and subject to be suid to full extent and those that have access to the ghostly made up files be removed from office do to my taxes don't pay for their childish attitude and mistakes . It should be like if I make a mistake on unemployment I have to pay it back.
