Hi po Atty, may tanong lng po sana ako. Ang basihan po ba sa counting hours ng Reglementary period (whether 12, 18, 36 hrs) para mag inquest filing ay based on the time of availability ng fiscal or ng judicial authorities? Patulong namn po atty.

To answer this question, I will give an example. If the person was arrested on November 7 which is a Sunday; November 8 - a declared an official holiday; and November 9 (election day) - an official holiday. In these three no-office days, it is not an easy matter for a fiscal to look for his clerk and stenographer, draft the information and search for the Judge to have him act thereon, and get the clerk of court to open the courthouse, docket the case and have the order of commitment prepared. Thus, it neither defends on the time of availability of the fiscal or the judicial authorities but on the reason why they are not available.
