In this lesson, I learned the difference between the Preliminary Investigation and Inquest Proceeding. The purpose of Preliminary Investigation is to determine if there is probable cause for the purpose of filling an information however in Inquest Proceeding the purpose is to determine if there is valid cause for the continued detention. Hello Atty! I am grateful for providing us a informative lesson. In this matter I have learned that the differences between Preliminary Investigation and Inquest Proceeding 1.What are the differences of preliminary investigation and inquest proceeding? Preliminary investigation is the police agency's first response to a report that a crime has occurred, meanwhile inquest investigation is an informal and summary investigation conducted by a public prosecutor since the person is already arrested and detained. As a result, inquest proceeding occurs when the offender has been arrested and detained. 2.When is preliminary investigation proper? - the person is not yet arrested - the person is not yet detained -there is regular filing -determine if there is probable cause to file an information, and lastly there is no warrant of arrests yet 3.When is inquest proceeding proper? - the person is already arrested - the person is already detained - it is summary in nature -determine if there is valid cause for the continued detention -no need for warrant of arrest

I was able to see the difference between a preliminary investigation and an inquest proceeding. Preliminary investigation takes place before the guilty party the offense is arrested, while inquest investigation is done after the offender is apprehended. What is the difference between a preliminary investigation and an inquest proceeding? - In a preliminary investigation, the participant is not held in custody, but there is no justification of arrest, and there will be a regular proceedings and then they will start investigating when there is sufficient evidence, after that they will start making a negotiated settlement as well as data to transfer through into court, and they'll just file a proposal "those who will file a petition again for issuing of criminal charge," whereas in an official inquiry procedure, the person is already arrested and imprisoned, and after that they will summa. What is a Preliminary Investigation? -It is an inquiry or proceeding to determine whether there is sufficient ground to engender a well-founded belief that a crime has been committed and the respondent is probably guilty thereof, and should be held for trial. When is a Preliminary Investigation required? -It is required to be conducted before the filing of a complaint or information for an offense where the penalty prescribed by law is at least four years, two months and one day without regard to the fine. What are the purposes of a Preliminary Investigation? - To protect the innocent against hasty, oppressive and malicious prosecution. -To secure the innocent from an open and public accusation of trial. -To protect the state from useless and expensive trials.

What are the differences of preliminary investigation and inquest proceeding? - The preliminary investigation is appropriate when the person has not yet been arrested/detained/has a warrant of arrest and will be filled out on a regular basis since the objective of it is to determine if there is probable cause to file an information. While the inquest procedure is lawful when the individual has already been arrested, detained, and there is a summary in nature (conduct inquest proceeding) for the purpose of evaluating if there is a sufficient cause for the prolonged detention, you do not need to have an arrest warrant in this case. 2. The preliminary investigation is appropriate when the person has not yet been arrested/detained/has a warrant of arrest and will be filled out on a regular basis since the objective of it is to determine if there is probable cause to file an information. While the inquest procedure is lawful when the individual has already been arrested, detained, and there is a summary in nature (conduct inquest proceeding) for the purpose of evaluating if there is a sufficient cause for the prolonged detention, you do not need to have an arrest warrant in this case. Good day Atty! Thankyou for another lesson. I've learned a lot today. Lesson #27 What are the differences of preliminary investigation and inquest proceeding? The Preliminary investigation will take a longer path. This allows both the complainant and the respondent to refute each other. When the complaint, via an affidavit, is filed, respondent is given an opportunity to file his counter-affidavit. While in the Inquest proceeding, the respondent is already in custody. With the affidavit of the person who personally witnessed the crime, chances are the fiscal will find probable cause. This no longer entails any exchange of affidavits. The prosecutor files the complaint with the court. The court proceeds to trial. When is preliminary investigation proper? • Preliminary Investigation is proper when; 1.The person is not yet arrested 2.The person is not yet detained 3.Regular Filing 4.To determine if there is a probable cause to file an information 5.No warrant of arrest YET. After watching this video, I am able to differentiate the preliminary investigation and inquest proceeding. Preliminary investigation is proper when the person is not yet arrested and detained. Preliminary investigation is to determine if there is a probable cause to file an information. After gathering information from the preliminary investigation, you can now issue a warrant of arrest. In the inquest proceeding, the person is already arrested and detained. Inquest proceeding is also summary in nature. Good Day, Attorney. Salamat po sa bagong kaalaman. Pagkatapos mapanood ang video ay natutunan ko ang pagkakaiba ng Preliminary Investigation at Inquest Proceedings. Sa Preliminary Investigation dahil wala pang warrant of arrest ay hindi maaaring arestuhin at ikulong ang tao dahil kinakailangan ng Regular Filing at pagde determina sa presensya ng paunang impresyon. Good day Atty. In this lesson I've learned the differences between the Preliminary Investigation and Inquest Proceeding. In Preliminary Investigation the person is not yet arrested and detained and there is no warrant of arrest yet. While in Inquest Proceeding the person is already arrested and detained and there is no need for warrant of arrest. I've also learned that the purpose of Priliminary Investigation is to determine the PROBABLE CAUSE OF FILING AN INFORMATION. While the purpose of Inquest Proceeding is to determine IF THERE IS A VALID CAUSE FOR THE CONTINUED DETENTION. Thank you for this lesson Atty. I've learned a lot.

LESSON 18 I learned the differences and similarities between preliminary investigation and inquest proceedings. Both are the responsibilities of a public prosecutor. The difference is that in preliminary investigation, the person is not yet arrested and accused, whereas in inquest, the person is already arrested and held. There is no need for a warrant of arrest for the preliminary investigation, and there is no need for a warrant of arrest for the inquest. Thank you, sir, for another piece of information

I’ve learned in this topic that the differences between Preliminary Investigation and Inquest Proceeding are, In Preliminary investigation, Person is not yet arrested nor detained its purpose is to determine if there is probable cause to file an information and issue a warrant of arrest, On the other hand, In Inquest Proceeding, Person is already arrested and detained without a warrant of arrest because they are arrested thru warrantless arrest, and its purpose is to determine if there is a valid cause for the continued detention.

I gained more additional knowledge today about the differences of Preliminary Investigation and Inquest Proceeding actually the number one and two of them is just a vice versa and the number of three when it comes to Preliminary Investigation is Regular filing then the purpose of PI is to determine if there is Probable Cause to file an information while the Inquest Proceeding the purpose of it is to determine if their is valid cause for the continued detention and the summary of nature, in Inquest Proceeding enter's the three basic when it comes to Arrest the In Flagrante, Hot Pursuit and the Prisoner Arrest. For our last lesson for today, I understood the difference between the preliminary investigation and inquest proceedings. Here is my summary: In the preliminary investigation, the person is not yet detained or arrested. This is where the prosecutor determines the probable cause to file information. On the other hand, in the inquest proceedings, the person is already arrested and detained. This is here determined if there is a valid reason for continuous detention.
