As part of the settlement, on November 12, 2021, the USCIS announced that E and L2 spouse visa holders are no longer required to apply for an employment authorization document (EAD) to work in the United States by virtue of holding L2 or E status.20-Apr-2022

That's right. I was confused when he said we needed to apply for EAD. It's automatic work eligibility as of February 2022.

For L2 visa holders in the United States, applying for an Employment Authorization Document (EAD) has been a crucial step for those wishing to work legally in the U.S. The L2 visa is issued to the dependent spouses of L1 visa holders, who are in the U.S. on intracompany transfers. Why EAD is Required: Historically, while L2 visa holders were allowed to reside in the U.S., they were not automatically authorized to work. They needed to apply for an EAD by filing Form I-765, "Application for Employment Authorization," with U.S. Citizenship and Immigration Services (USCIS). The EAD grants the holder permission to work in any type of job, for any employer in the U.S. Recent Changes: However, there have been significant updates to this policy. As of late 2021, a settlement in a lawsuit (Shergill, et al. v. Mayorkas) now allows L2 visa holders who are spouses of L1 visa holders to work incident to status. This means that L2 spouses no longer need to apply for an EAD to work in the U.S.; they are authorized to work based on their L2 status alone. This authorization should be reflected in the remarks section of their Form I-94 (Arrival/Departure Record) issued upon entry into the U.S., stating that the holder is an L2 spouse. Actions to Take: For New Arrivals: L2 spouses entering the U.S. should ensure that their I-94 record correctly notes their employment authorization incident to their L2 status. For Current L2 Holders: Those already in the U.S. might still need to apply for an EAD until their current I-94 is updated upon re-entry to the U.S. or through an application to USCIS to change the terms of their admission. Documentation: It’s important for L2 spouses to carry documentation showing their status and work authorization, especially when seeking employment or when required for official purposes.

Thanks for sharing this nice information. I do have one question that I am applying for L1-B visa for me and L2 visa for my spouse and children. In DS-160 form I have mentioned my intended stay in US till July 31, 2027 and passport of my daughter will expire on September 21, 2027. Please advise how should I proceed, I have already submitted forms DS-160 and have also scheduled appointments for biometric s and interview.

For visa applications like the L1-B for you and L2 for your family, the passport validity of each applicant should generally exceed their intended stay in the U.S. Since your daughter's passport expires shortly after your intended stay, it's recommended to renew her passport before your visa interview. Hello sir I'm a l1a visa holder and my family l2 visa holders. But my elder son (19years old)..is studying btech2nd year online in india but he stays with us in usa..he has to travel india for all the semester exams...can he travel frequently from usa to india and india to usa..or he may face any immigration problems asking why he's traveling multiple times..
