US code says USA ships have to be under threat for the navy to take sanctioned anti-piracy action. But the charter of the US navy, in its very first article, says the US navy's primary purpose is to protect ALL shipping from pirates. Particularly state-sponsored pirates. Which principle takes precedence tends to depend on decisions made on the high seas by ship and fleet officers.

As I recall, a principal reason why the US hasn't ratified UNCLOS is that (at least one version of) UNCLOS contains provisions on mineral rights in international waters (such as in the middle of the Atlantic or Pacific) which seem inconsistent with US interests. EDIT: On pirates vs privateers, privateers have letters of marque issued by a governmental authority.

No. A "privateer", is simply any Pirate that operates with permission/contract of a gov't entity...In this case, the pirates contract with whatever local warlord is "in charge"; Then, get a cut of the booty..."When you do it, you are Pirates;/When we do it, we are "privateers"...It's still illegal, and historically punished by death...

The 1856 Convention of Paris outlawed privateers. The United States also refused to sign it as they recalled how effective privateers were in the War of 1812 and planned to issue letters of marque if they ever got into war with the UK again. Ironically, 5 years later the USA tried to join the treaty, because the Civil War had started and they feared what Confederate privateers would do to their own commerce.

The US then complained about the UK building a warship for the confederates (even though they didn't arm it) and the UK ended up paying compensation (which is rather hilarious).

and the US navy is still actively involved in piracy/privateering (I consider it to be the same thing, plus privateering being an act of war). Remember the US navy earlier this year stealing an Iranian oil tanker? yeah.

I've studied the role treaties have in U.S. law. I think I understand why we are so reluctant to sign them even though we often studiously stick to their terms. Like the Constitution and federal laws passed by Congress, _a treaty can override federal and state laws._ On the surface that seems unimportant, but that's not true. That's an indication that treaties can cover more than relations between nation states. In some circumstances they can interfere with and even override federal and state laws personal individuals and their personal rights. They transfer decision-making from our people and their elected representatives to distant bodies that can dictate the meaning of those treaties.

Agree. The U.S. is very hesitant to sign any treaty that can take away their authority. Except Israel. Israel is a tiny nation with no strategic importance to the U.S. Still they run the U.S. foreign policy in the ME. And they are masters in manipulating American elections. The American public go crazy over the 'fictional' Russiagate, but cheer on Israel. Why? 100 Million evangelical Christians living in the bible belt.

The U.N. lawyers have a tendency to redefine things, and in 5 languages which don't always translate into perfect agreement. The U.S. Navy should operate under U.S. laws not the laws of Luxenbourg or in Russian or necessarily under the minimal ones that all members of the U.N. can agree on. From what I understand, for example, terrorism was left off from crimes against humanity. The U.N. is not a responsible body in the normal sense. What is the approval rating for the U.N. boss, when do I get to vote for or against him? I guess when I chose between Biden and Trump. The U.N. has never expelled members who refuse to follow legal norms so these members are part of "the U.N." and U.N. regulations.

In this context, a privateer would be if say Canada issued permits for Canadian carjackers to come to the US, steal cars, and then drive them north of the border to be sold/chop-shopped/whatever.

Excellent work. You are the best Sal. Why is there no Active Advisory for Venezuela while the state department currently has a DoNotTravel Advisory? Crime and violence is off the charts down there yet they somehow manage to offer vacation packages to foreigners who mainly visit Los Roques via Yachts.

As an old Navy veteran, this whole problem annoys me. The vagaries of the international laws and/or treaties supposedly governing such criminal acts are clearly being exploited or ignored. In reality, the distinction between pirate and privateer is essentially meaningless when the acts are carried out in recognized international waters. The fact that any rogue government can authorize so-called privateers to engage in piracy in recognized international waters should have no effect on the defensive response of the vessels under attack, or the forces of their own or other nations. Piracy is piracy, however it may be obfuscated by diplomatic jargon, and should met with whatever armed response is required. Ok, Rant over.

@@ayadlammar Yes, I remember it well. During the 6 Day War in 1967, Israel misidentified it as an Egyptian vessel and fired on it, killing American personnel. Israel subsequently apologized and paid millions in compensation to the families of the dead and wounded.

@@ayadlammar it endured better than US liberty as a whole, ill tell you that much. Wasn't piracy was military action. I have heard versions both supporting the version it was mistaken identity and negating it. Each coming from sides with their own narratives to push and im not sure how to verify which is truer. The idea that it was a false flag to drag america into that war makes little sense because: a. If true, it didn't work. b. The IDF won that war handily by itself in a glorious quick victory remembered for ages. US military involvement was not only not needed, but would detract from that. If they could have pulled such a ruse, 1973 would be the only time they could have been desperate enough to punk the mightiest military on earth at the time, belonging to a nation they relied on it's support. Speaking of naval incidents and false flags... What happened to the USS maine? That's an interesing case. What happened to the kursk submarine? Even rival nations sometimes prefer to hush such incidents up and work it out behind the scenes, before their populations cry for war. Some should not throw stones. p.s. nevermind, you are not even a concerned american, just an islamist spamming about israel. Idk which coutry are you from, but the glass walls of your house are probably even thinner than both americas and israels.

It sounds like the gentlemen in question had a skill set that was no longer marketable in their home country and therefore found work elsewhere. If the ship is registered in Liberia could they deal with the prisoners? Or maybe dropped there and told to walk home?

The legal status of pirates is 'Hostis Humani Generis' - loose translation, 'Enemies of all humanity.' Not only does every nation have jurisdiction over any pirates they capture regardless of who they've been attacking or what country their ship is flagged under, but every nation has an OBLIGATION to all other nations to exercise that jurisdiction and prosecute them. And that status is completely unique. No other kind of criminal is regarded as 'Hostis Humani Generis.'

While aboard _GREEN BAY_ in pirate infested waters in 2011, we had serious talk about using the abandoned VLS space for captured pirate housing. Those San Antonio ships were designed to have VLS cells forward, but this was cancelled, yet the void space remained. A literal gaping, unused space forward of the pilot house below deck. Interesting times.

Thanks for this. I've always wondered about this and concluded decades ago that legalese and unenforceable agreements mean its not worth the headache for a "law abiding" nation to deal with piracy the way a "rogue" or uncaring nation will. Kind of like how some people will not argue and simply knock somebody out, not worrying about getting sued while a reasonable person will conclude doling out instant justice isn't worth the potential legal headache. However, one will make the perpetrators think twice now and in future, while the other essentially emboldens the perpetrators. Its a shame. What good is turning the pirates over to Yemen?

This wasn't a coast guard cutter. Also for the coast guard to actually have law enforcement authority there needs to be a treaty and then this needs to be the waters of the country we have a treaty with that we are enforcing really that nations laws (I Believe for example we recently did do this with Philippines due to Chinese issues where we say we will help Philippines patrol and enforce Philippine law in Philippine waters) Or they perhaps must have committed the violation in those waters and then fled to open water where we pursue or something.

Yes, that's the distinction between a privateer and a pirate. However, a privateer from another nation is considered just another pirate by the target nation. The letter of marque only carries legal power in the issuing nation and any allied nations that choose to recognize it.

What is the value of UN treaty that would provide greater value to the US Navy and the USA? I am seeing a UN command structure to authorize action based upon the treaty, when we can already engage hostile vessels on the high seas. We had similar issues during the war on drugs in boarding stateless vessels who were pushing to make Mexican waters while we were trying to get the vessel declared “stateless” so we could board.

What about UNCLOS part XI? this seems to go beyond piracy and into how states can mine the ocean. Perhaps if they move that part to a different treat the the US would sign unclos. Can you expand on specifically why the US should not be concerned with part XI?

Part XI deals with ocean floor mining beyond a nation's exclusive economic zone; so basically in international waters.

The Naval Act of 1794 established the US Navy with the expressed purpose of combating piracy. Signing another treaty that says the same thing is unnecessary.

The issue with the treaty is that in American law a ratified treaty supercedes the Constitution. This is so the United States could accept terms of surrender if we lost a major war and our opponent made demands that violated the rights of Americans. While countries like China can sign a treaty and then ignore it at will , we can't. So America is very reluctant to sign any treaty it doesn't absolutely have to.

I think that absent a lettre of marque and reprisal claiming to be a privateer is a way of admitting to piracy and a lettre of marque is only valid in a declared state of war and from a recognized state so some of these defences would not pas muster.

1:20 this sounds odd, but actually acts of aircraft piracy is real thing, and famous example (at least in middle-eastern Europe) was abduction of Rynair Sun plane by Alexander Lukashenka (president of Belarus) regime in may 2021. Ryanair Flight 4978 was an Boeing 737 on route from Athenes to Vilnus. When the plane was in Bielarussian air space pilots recieved information about bomb on board, and the plane was forced to land on nearest airfield near Minsk in bielorussian Mig's-29 "escort". In fact there was no bomb, and the plane was indirectly hijacked by bielorussian regime, only to arrest bielorussian journalist and oposition activist Roman Protashevich, who was on passenger list.

Send 'em to Davey Jones' Locker. Easy and cheap and discourages other pirates. Also, the US hasn't ratified the clause because they don't need to. The UN is not the US, and the US doesn't need the UN to tell them what to do when there are already MORE stringent laws in place in the US. Not only does the US not need to ratify it, they legally can't without changing their own laws, which are clearly more developed and focused on self-interest than common-interest.
