Hello all. I want to thank Fred for giving me the confidence to go through the online wedding process. I have my tickets/hotel reservation for my trip in May. Once I'm back in the USA, I will continue the process with Fred to complete my spouse Visa.

Hey Fred, nice to hear from you again. I have a question please. My k1 visa was approved by NVC last year in June. Since it was taking too long, I had to go home to get married. 3 months ago, I sent I-130 back to USCIS and they sent me the notice that they working on my case. Do you think my case will take the same amount of time as everyone? They approved my I-129F already but I adjusted my case from I-129F to I-130. Thanks Fred!

Sorry, but US immigration doesn't work that way. You don't submit a fiance visa application, then "adjust" it to a spouse visa case. You abandon or cancel the fiance visa case which you are no longer eligible for. Then apply all over again, and pay filing fees all over again, this time for a spouse visa. Once you get this resolved and submit a new case. USCIS will treat it just like any other. No reason to expect that previous work done by USCIS on your abandoned case, will affect the timing on your new case.

@@Visacoach i did submit I -130 and paid the fee for it. I didn't know that I should abandoned my K1 visa by sending USCIS the form( I-470 abandoned case) When I filed I -130, I enclosed a letter explaining to them that I changed the status. Am I going to be in trouble for not filing the abandoned case form?

Glad to hear you have applied separately. For case specific advice on what you should do now with your ongoing case I suggest you reach out to the consultant or attorney who is working on it.

@@Visacoach Thanks for your time and quick respond. I contacted NVC, they told me to submit them the marriage certificate and they will contact me as soon as possible also they will let USCIS know. I hope NVC will update my case instead of sending it back to USCIS because the case is at NVC. Thanks

For up to date travel and quarantine information best is you follow the immigration service and their related announcements for the country you wish to travel to.

An spouse is eligible to apply to enter the Philippines. It is no matter when where you were last together or how you got lawfully married. For medical restrictions do contact the nearest Philippines consulate for their requirements.

So it basically sounds like if you are already married to your Filipino spouse, then everything is going well for you. But if you are trying to get a k1 visa, then the hell with you and you k1 applicants are no longer important because there is no hope for any of you guys. I’m so damn sick and tired of k1 visa applications getting sh#& on all the damn time. If no one wants to help us k1 visa applicants out, then just say so and quit wasting our time. This is too damn much. Only married people Matter for the Philippines. But if you only engaged, then you are not important to the Philippines or lawyers or anyone else. This really pisses me off and I’m sick of it. Why don’t we just get rid of the k1 visa process since no body gives a sh#& about them anymore.

It seems that the issue you really have is how difficult it is to meet the in-person meeting requirement during Covid. Well Covid, angers us all. And hopefully with time, medical science and herd immunity it will be behind us, just like the Spanish Flu of 100 years ago raged, then passed, then was forgotten.
