I really don’t think you’d lose a legal battle- they’re within no right to take footage of you and put it into an advert, especially when you aren’t even using their product. The argument would be that people who know who you are could buy the product, believing that you endorse it, and then their trust in you would be damaged when it’s not the product quality they expected~ damaging your career and social integrity.

But I have to say, these video adverts on facebook and pinterest are easier to sue than in example wish that took your palette and copied it.
