I know there's hidden context around "No harm no foul" but not a drop of sarcasm in explaining it. The judge may like to think he's alone, but there is an audience, a literal jury watching. Never know who might need a clear up in the background.

The alleged bias was due to Will (the other defence Lawyer) fouling him in a lawyers and judges basketball game. So they intentionally used that term to provoke him
