It’s gloves off as soon as you walk through the door. They will be looking at body language and motions. From how you look down to reach in your pocket for your ID, sitting the chair you sit in and the desk the examiner sits at a 90 degree angle, and how you close the door when leaving.

​@vaclaimsacademy I just found your channel, and I am currently my husband's battle buddy ... I am the force behind him getting the care, and this entire video is my life .... my husband is at 80% currently. He has the numbness in all limbs now more frequent than not. We already went through the podiatrist to get shoe inserts and that didn't help. He is in pain management and has been for years with little to no relief. We have been to spine surgeons .. currently being referred to neurologist to see If there is any relief for the nerve damage. The migraines ... the numbness .. (hands and feet, arms and legs) he has had both shoulders operated on in hopes that this would help alleviate pain / numbness in the arms and hands and then we have the mental. .. we have had some serious dark conversations in the last few months as the pain escalates. I will not give up on him ...he is currently trying to work a full time job (aircraft mechanic) and it's getting beyond physically difficult for him to continue. He misses works more often now than ever due to pain levels and its become a point where it gets so bad he now always has an upset stomach (vomits quite often) ... I don't know where to start ... he was rated 80% in 2018 and I fear if we try to push the rating higher he will lose benefits, not gain .. he is age 52 .. so I am not sure which path to take. We have copies of all military medical records during service (this is a unicorn file lol not sure how he got the entire thing but he did) along with all records from outside docs in community care ..... where do I start ?

Yes I’m thankful for old vets pulling me aside at my 10 yr mark and schooling me up. I went to the doc every 6 months leading up to my retirement.

Most of my claims I never went to medical for, you can service connect, however it sounds like you need a VA Disability attorney, call Berry Law they're great.

@@realtuffhuff3193 That's the plan. I went through the VSO and they really weren't any help. Waiting on this current claim to finish and I'll go lawyer. I don't want to wait years like some people did fighting for things here and there.

I've been out the Marine Corps since 97. I've denied a few times for disability and gave up. I tied again after watching your videos and got my first 10% for tinnitus a day before my 50th B-day. I wish these videos were out way back then. Next is Migraines and a service connected back injury.

Sound like me.. I got out the navy in 2005.. I finally was approved 10% for tinnitus in January 2024. I currently have 3 claims in now for injuries in the military..

Man, that is great news. I am 40% for a lumbosacral strain. I am now feeling pain in both legs. It feels like needles are in my feet sometimes.

You and combat Craig are simply amazing. I was sitting at 60% at the beginning of this year..I’d been out for almost a decade..started going to the VA docs..then filed my claims for increases on a bunch of zeros in April..sitting at 100P&T today❤🎉 I love how you give us the info STRAIGHT because it’s literally what the C&P examiners look for..no more, no less..some will try to trip you up but so long as it’s in ur file and you know what ur talking about, you’re as good as gold to get what you’ve been owed. Thanks for the knowledge; it gave me the courage and confidence to file and win my claims!

@@jonievans5453No US military remained in Iraq after the 1991 Gulf War and the US didn't invade Iraq again until March 2003. If you are claiming Iraq service in 2001 you will likely be denied. Might want to check your dates.

Problem I had is I didn't know how to talk medical to my private Doc. Most of my records said unspecified and interested in stretching, or headache or runny nose prevention. After vids like this and learning VA symptom terms, and language like very severe- my claim is becoming bulletproof without hundreds of pages. In the VA I also learned mental health and presumptive diags open doors to secondaries. Wish me luck to be 94% after four months of care for 7 claims on Aug 9. My mistake is I ignored my complaints for decades trying to suck it up and ended up being that grumpy vet tyring to hold jobs. Channels like this are gold. Services like this from other vets are worth the investment to learn the beaurocratic puzzle and language. My advice is get help with personal statements from date of injury/ illness are the key. Another point I heard but haven't verified is any complaint, treatment, diagnosis, or disease is sufficient for claim. Treatment notes define rating level.

Thanks, I broke my back on Active duty. then crushed my right lumbar a year later after an explosion. I'm still fighting with the VA now. My 3rd appeal for back problems, my rating sits at 60% still when I should really be at 100% T&P. I also retired in 2017 from the US Military.

To get 40% for the back requires: "Unfavorable ankylosis of the entire cervical spine; or, forward flexion of the thoracolumbar spine 30 degrees or less; or, favorable ankylosis of the entire thoracolumbar spine". With the back injury that is in this video it would be 20% or 30%. That said, you would still get to 80% rounded. Also, 20% bilat on all limbs is 65% total by itself, with the bilat factor included.

Yes, but if you feel pain when you unhinge your back from the upright position, during your C&P exam just explain that to the examiner and don’t lean forward too much into pain and you should be within the 30 degrees. That will be rated at 40%

@@isaiahrasmussen8601 during my CMP exam I barely moved forward a fraction of an inch and the CMP examiner said I moved 60°. That is absolutely false because if I did actually do that my back would’ve flared up then on the repetitive motion estimate she gave me 40° and estimate during flareups she gave me 20°, so it’s easy to say oh don’t bend that far and you’ll get 40% but it actually goes by what the CNP examiner says. Everything else on the exam I feel was excellent. I think she was fair as could be. I just don’t understand why she said I moved 60° forward on the passive and active range of motion test that is just wrong not even close to what I moved, she did use a goniometer. When they rate me I hope it’s rated on the flareup as that range of motion was 20° and that would give me the 40% back rating. I’ve read on several lawyers websites that are all accredited and they say they have to account for the flareup so I should get the 40%. hopefully I will know soon.

But your coaching of when to stop at the point of pain…..and to mention the radiculopathy. Results… no increase for lumbar strain..10%… Left side radiculopathy 40% Right side lower radiculopathy 40% Bilateral factor…?? Told my VA primary dr that my back has been hurting for years, told my PA in active duty my back hurts, years from wearing the issued gear, and the wear and tear they put on your body. His response was that his son is older than my dad and works at a desk, turned and took notes, and then asked what else hurts…last time I went to that prick

Make sure you have an updated diagnosis showing that you are still getting treatment. Other than that, you’re good to go!

Thank you for the great information. I’m sitting at 70% currently. I have 40% for back pain and 20% each for lower L/R radiculopathy and 20% for an umbilical hernia. Question: My neck constantly hurts, my right shoulder hurts, and I do get tingling in my hands and arms as well as headaches and I can’t sleep well. Thats a lot. Should I file a secondary to my back pain for all of these? I heard you should only file about two or three tops for secondary conditions however I’m really hoping to get to 100% and want to be sure. Thanks for your service and advice.

I just stumbled upon your videos and I really like how you break it down so the average person can understand it. I'm an older vet who left the military with reoccurring back pain and other issues from injuries and general work environment some documented and some not and some that should have been documented but don't show up in my medical records. Now I can't hardly get out of bed in the morning without extreme back pain and your 100% correct as goes the back so goes the rest of the body. I was denied recently for SCANT evidence although I have at least 2 documented back issues and was on muscle relaxers for my back the day of my separation physical. I'm appealing their decision with my VSO who seems like a decent guy but not overly helpful. Is there a VA disability for dummies book out there? I've learnt more watching a couple videos on KZbin than I have in 3 years of dealing with the VA.

I appreciate the kind words Rod, it seems like you have a proclivity for visual/audio learning like many people. An appeal is probably the wrong route to go, firing the VSO and doing a supplemental claim with well written personal statements is nearly always the better option. VSO's dont really know anything about lay evidence so most wont be really helpful

Good question can I piggy back off this same? While in service I went to sick call for my back pains long story short can I submit a claim after being out 20 ➕ years? But I got denied 6yrs ago C&P examination saying not enough edvidence between 2001 and present.

@@genebuchanan7878 I got a letter from my ex wife stating that the problems started in the military and continued for at least til the time of our divorce about 14 years after I got out. My vso seems to think it MIGHT help but isn't real sure about it. My problem is that I waited until the pain got bad before I started getting any medical treatment, I got out in 85. More and more I'm thinking about talking to a lawyer , not real sure what my next move will be or even if there will be one. If I hear anything I'll keep you posted.

I have a question. While serving, I had several back issues, simple walking upstairs, moving a couch, and lifting weights each are documented in my health record. Now, 5 years after I retired, I ended up with 3 herniated discs in my lower back, which have been repaired since I was also told that I have degenerative disc disease. I should note that I still have back issues. Do I file a claim for back pain and degenerative disc disease?

I just last week had a C&P after 17 years (retired 2006). Back and neck focused. I was there for 2 hrs, that could be a good thing. They did my BP when I left, 164/100 I was in pain. Now, I am waiting for the decision to come back. Thanks for the videos.

Coach, First loved this video! Currently at 90%SC (true 85%), In 2016 I was awarded 20% SC on a lumbosacral strain, They denied a cervical strain, due to lack of diagnosis. I have no rating for Radiculopathy. However, I do have physical coming which I plan trying to start the process to achieve a diagnosis for the cervical strain. It's clear in your video, if I can achieve the diagnosis, I have a clear pathway to 100%. THE PROBLEM IS THE VA DOESN'T LIKE TO GIVE DIAGNOSIS'. What's your thought I getting the VA to actually diagnosis?

I’m at 90% on my disability rating. I served with an airborne ranger co. During the Vietnam war I served two combat tours and was medivac’d back both tours and was awarded 2 Purple Hearts. 50% is for PTSD. with the other 40% awarded for other issues. None of my service related back injuries have been related to any back pain. I’m now 75 and am desperately trying to get that last 10% 7:44

This past year I've been working on getting medical paperwork trail for my lower back, finally got a MRI scan and my cartilage between the disc on lower back is going away, and is also causing me knee pain because of the nerves going down into my legs. I was told i need to get it diagnosed to help me get it claimed better. After seeing this video i hope to get claims for what your saying because it is true. Being in pain sucks, i oray every veteran can get the benefits they deserve.

I did what you said and then the doctor was like “ well let me see if I do this and this,” he applied pressure to make me bend forward and back side to side and I made him stop half way through and told him he was starting to hurt me and to please stop. He apologized and said they VA makes them apply pressure, it’s part of the evaluation? I’m not sure if I was right and he was wrong?? Any advice Thank you

Just had my C&P exam for my lower back and plantar fasciitis on 10/23/23. Waiting on decision now. I ensure to stop as soon as I felt pain, and disclosed the numbness and tingling that shoots down both my legs.

Yes, granted service connect on November 21 for Back, plantar fasciitis(bilateral), tinnitus, and radiculopathy both legs. Combine rating 50%. But I submitted a new supplemental for flatfoot on 12/4/23 and the VA updated it to an increase for Plantar fasciitis to include flatfoot. Had C&P exam for flatfoot on 12/11/23.

I just got out and received a 40%. I was unaware of multiple other issues that I was experiencing and was told not to bring them up. But they are genuinely affecting me, should I pursue a supplemental claim?

Absolutely! File for anything that is connected to your service, or secondary to what you already receive 40% for. I have been out for 22 years and just filed my first claims and am already at 40% with lots more in the pipeline. Don't be like me and lose out on 22 years of compensation that you earned by destroying your body for your country.

If you have the diagnosis in your service treatment records especially yes. Otherwise getting strategic with secondary claims is a great option to explore

C & P examiner reported a perfect 90 degrees of forward motion, when I actually leaned forward no more than 20 degrees. I haven't been able to bend forward more than 30 degrees or so within the last 5 years. Is there a way to challenge that or is it best to go to another MD?

David, this happens far too often. The best thing to do is to report the examiner ASAP after your exam, at this point however a supplemental claim is likely your best bet. Cheers

Recently separated, no STR's, have back pain with VA X-Rays with some findings, in Florida. I can't find anyone to do a DBQ. I really don't want to leave it up to the C&P examiner, any tips? Definitely the most underrated VA Claims channel, my favorite by far.

Im confused what to do over a 15 plus years in the reserves and guard with two tours in Iraq and tons of training exercises over the years. I submitted so much and all I have SO FAR is 50 percent for PTSD. My body is shot, I went and got x rays and MRI of my lower back. I got x rays and a letter from my chiro from my neck pain, my neck has lost its natural curve which shows in the x rays. Denied for the neck pain. I just added the MRI from my lower back where it shows I have a pinched nerve and bulging disc and resubmitted that. I wish I would have resubmitted for the neck pain too.

What percentage do you get for a degenerative or herniated disc? Does each disc count separately? I have several.

You could have 10 vaporized discs for all the VA cares, they’re gonna rate you based on range of motion in the C&P exam. They treat everyone the same, which makes them predictable and easy to beat

I received 20% for degenerative disc and 10%each lower extremities radiculopathy but in process asking increase for the radiculopathy .

I tried claiming neck pain secondary to lumbar strain, and they denied due to case law that lumbar strain or pain does not cause neck issues, which in my case was degenerative disc disease.

What about Flat Feet that led to Back Pain? I had a Flat Foot Waiver. In the Marine Corp they stop doing the sit ups. I use to complain about a popping and ping sounds when doing the 100 sit ups.

It depends on if the doctors did there job and actually wrote down what you reported to them. The diagnosis needs to be in your records, if it is, we’re in business

I been denied service connection twice for bilateral pes planus. I reported tingerling. Up and down my legs and feet pain in my groin area. Back pain. This info was never written down I checked my records . I was diagnosed with lumbar spine curvature and degenerative disc diease. After this vid on the back pain I'll now claim the back pain. The point is the VES doctor should have told me to file for back pain . But the doctor gave me no help. Dude have your back checked out with a MRI

Oh yes I been diagnosed by VA with bilateral flat feet. I been issued sole inserts. VES even confirmed my flat feet. But no luck I claimed it as a secondary connection to my knees and hips.

It was diagnosed I had flat feet. That’s why they gave me a waiver. I also had to be in light duty a few times through out my 4yrs. They told me I had shin splits off and on back then which was written down. Since 2009 I have had the X-rays to show my back has been declining. My first chiropractor was just a regular chiropractor, but my second chiropractor is a VA certified Chiropractor along with his staff that’s the extra reason I picked him. I’m sure he would love for me to get approved then I would have to see him all the time so it’s a benefit to him.

Also for the lower back/legs you should claim the femoral nerve separate from the sciatic nerve, if you have the appropriate symptoms. Basically pain for sciatic and numbness for femoral. I would recommend claiming these when you file and not wait until C&P to mention them to the examiner. For me I was awarded 20% IVDS thoracolumbar spine, 20% radio. lower left (sciatic), 20% radio. lower left (femoral), 20% radio. lower right (sciatic) and 20% radio. lower right (femoral).

I followed everything you said got 40% for Back and 20 % per leg radiculopathy. They didn’t give me bilateral. What did I do wrong or what can I do?

i did a C&P for my back was getting 10% after retirement.. lady totally screwed me over.. could barely walk r bend and yet she said i passed.. what a joke!!

I had my C&P examl for my back. The Examiner indicated radiculopathy in both lower extremities. The VA didnt rate me for radiculopathy, only my back. Should that rating be counted as well?

Question: What if you’ve gone to sick call and there is a notation of lumbar injury and years later it turned out to be spinal stenosis and required lumbar decompression fusion surgery. What do you believe that should be rated?

I have 10% for LUMBOSACRAL STRAIN and throughout the years the pain has been getting worse. So I can do this but where do I go or who do I contact to get my rating review to increase? Do I call the VA or hire an attorney?

I just got a phone call from my vso stating I will be getting 60 percent for my back pain.Thank yes I did what you said do it works I was at 10 percent would it be 70 percent.

I believe i claimed back and neck. i dont think i claimed SSD. From what i was told, i have 90 percent so SSD will probably give me my 100 hopefully. Im medically retired today so waiting on the fine print raring.

My initial claim and supplemental claim for my low back were put under my already neck diagnosis which has been sitting at 20% since 2019 and diagnosed in 2013. Both c&p exams were for my low back and radiculopathy. No where near my neck. The supplemental claim did add 10% radiculopathy left but doesn't say what body part nor did it add my right left leg even though it's in my nexus and medical record. Now its sitting at higher level review so maybe the third times the charm.

A good personal statement is the missing piece here, this is a classic example of what I often talk about. In reality, they probably skimmed through your medical records and didn’t read the part about radiculopathy. The key is to anticipate the laziness and give yourself a voice to exert your interests and influence over the process. This is where bulletproof personal statements come in ♟️

Great video. I hurt my back and shoulder when I fell after getting electrocuted while working in The Navy. I was young and figured it would get better but now at 50, those old injuries from that day are coming back to haunt me. Is it to late for me to be able to file a claim?

I mentioned ridiculopathy to my c and p examiner because I have low back pain and a degenerative arthritis in my lumbar spine. She never asked any dbq questions only asked for a brief history of what I filed for. I checked the examiners note and she marked me as a no for ridiculopathy. I mentioned it three times. She said she’s not doing any additional diagnoses. Is this fair? Still waiting on my claim award letter.

so what happens when you have been denied previously? I got out in 2012 and was told put in claims for this and that, which I did. Had back xrays from the va and whatnot and they said unremarkable with mild straightening. My back is significantly worse now and I want to apply for increases, but I'm afraid I screwed myself with my uninformed claim when I got out. Is there any hope? for context I was in the 82nd and spent almost a decade on jump status.

I was in a car accident while on AD i was back home when i got into the car wreck does this count for service connected? Ever since that car accident my back been bad and had bad whiplash as well. Would you mind guiding me Which doctor is best for back diagnosis? I am seperationg from the military and I have chronic back pain, The Doc in the Base told me to do some urine and blood test to try to make the diagnosis as arthritis after 10 sessions of physical therapy. All people in my age has arthritis. so i decided not to go with that doctor.. My body is in pain after years of working in the military and I am a female. As i am writing this I am crying getting emotional. Thank you so much for your videos.

So how do you get from 80 to 100 it’s been a 8 yr battle no dental you have to be total or unable to work, so I quess you have to wait for your dental problems to affect other issues before they see your dental problems caused other health issues so how does that helps the vet? This is something that really needs to be looked into if it hasn’t already and probably has with no positive results, I’m sure it will change at some point when enough vets are dead from issues that came from dental problems.

I just got my c&p exam done on my back for an increase (currently 20%) in the first week of Jan and the np woman pushed me farther than I could, I had explained to her I cant bend over without pain she said “this is what the va requires “ so tried and she pushed me down and threw my back it is 3 weeks later and I’m still suffering in more pain, i absolutely hate the va.

Totally off subject. I was exposed to agent orange in Vietnam in Danang and also òperating offshore in Gulf of Tonkin. Diagnosed with esophageal cancer in 1998, surgically removed in 1999. Chronic thoracic pain since then. Radiated chronic pain to neck C2 thru C6. Surgery in 2015 damaged nerves chronic pain since then. Prescribed opiods since 99. Kicked opiods in 2018. Take multiple supplements and prescription pain meds to deal with pain. Had 5 month hospital and rehab stay 8/22 to 2/23. Have lymphedema since. Can i connect these dots for a VA claim. Had agent orange registry exam in 2015 but was rated level 6? 7:46

For lower back, if my forward flexion was between 30-60 but my range of motion is more than 120 would my rating still be at 20% or would it be 10%?

I've been out of service for 14 years and have lumbar DDD service connected at 10%. I have plenty of neck issues documented in my medical record from the last 3 years, but nothing documented from time in service. Do I file the neck as secondary to my lumbar DDD? This is something I'll need a nexus letter for to tie the two together? I have a feeling that would be a tough battle with the VA...

Thank you for the video it is eye opening. I am just now doing a VA claim for my neck and lower back after being out for years, I have been getting injections both lower and in my cervical spine; will I need a nexus statement saying the pain is due to military service?

The diagnoses need to be in your service treatment records, otherwise it will be quite some work to get service connected Gwen

Your personal statement with a service incident and a current diagnosis will give you meat on the bone. If all fails call Berry Law they're great.

I hurt my back in the Army went to sick call several times had X-rays done given paid medicine and instructed to use a bed board and during this time MIR technology was not yet out, all this medical instruction was documented on my medical file while in the Army. My case went to the BVA after I appeal my deny been waiting now for 3 years. It was sent back remand and a CP was done my total ROA was 85 and diagnosis with degenerative arthritis that was on my CP report.What is your opinion on my case with the information I have given??

What exactly needs to be going on with our necks in order to make a claim? I have chronic neck pain that inhibits my head movement to each side. It constantly feels like I slept in a bad position. Is that enough to make a claim? If not what does neck pain with that rating look like?
