If maintenance can be associated with fundamental right of sustenance, then why should that right be conditional on marriage. Fundamental rights should not be conditional. Is the law saying that an individual has the right to sustenance only if they get married. Why do all the single men and women who cannot sustain themselves be provided the same right. Shouldn't fundamental rights be applied to everyone with fairness and without discrimination. If any right cannot be invoked with full fairness to all individuals then it cannot be called a fundamental right. Because then there is nothing fundamental about it. So claiming that prenups violate fundamental rights is not a reasonable claim.

Well Pre-Nuptial Agreement is essential but I highly doubt whether it will come or not because the ruling party needs to target the women voters and to please them government won’t take any steps against them because of vote. And most of the justices also won’t speak anything because they also have to do their retirement planning. So, in India equal justice was - is - will be a dream. Judiciary System in India has fallen long ago. Whatever it is, for men there is no equal justice. In India, men are treated as an ATM Machine or the golden goose in India and they have to die also to serve others nobody is there to think about them. It’s men’s moral responsibility to provide and provide and in return he should expect only insults, humiliation, abuse and more expectations and these are always being supported by the law. Men are the donkey of Indian Society carrying the load of everyone’s responsibility and expectations and in return he should not atleast expect anyone’s love.

In india marriage is like insurance. Before marriage, no problem. It's not a contract. Later When you go to ask for the insurance money, hidden terms are thrown at your face. After divorce, it becomes a contract (just like hidden terms and conditions). Men, there's no hope.
