I try to claim my back pain this year is on my medical records in military and sent them civilian records too I get out 2013 still get denied. I got no nexus. I got plan to claim supplemental add more evidence like nexus letter I might pay a big money then add some personal statement maybe Buddy letter

I entered the Army in June of 1976. I never never heard about about the VA much less a C-File. I made a copy of my medical records before I retired, did not look at it for years. During that time when you got out that was it. I did apply for Tinnitus back then and it got denied, then I just said F-It. I learned a hard lesson over the years about what they do to you once you are out. I have been dragged thru the system for many years. Within the last 6 years I have received a little movement in the claiming process. I got a copy of my C-File in 3 weeks and it has change things for the better. Thanks for all the help and the patience that you show to your fellow soldier. I have passed the word about you to many vets.

That's how i got my my HLR rated! I had already received an HLR decision letter saying my denial was overturned and service connection made. After waiting almost a year for a rating, i called the hot line and stated verbatim, what you said in the Hotline video. I had a rating within 2.5 weeks...100% P&T!

Great show. It took me 13 years and 4 months to win my case! It was a challenge every time We even won twice in the court of veteran appeals in DC and they still said NO. Finally two nexus letters and we were back on the VA hamster wheel. The final decision by them was equal evidence, which a tie goes to the veteran. Education is super important in the process. I am at 70percent and researching TDIU. Never quit.

Dewayne thanks for the videos. I wish we had the TAPS program when I got out in 2005. We were given a crappy presentation and check this out...we were told NOT TO FILE for hearing loss because we were supposed to wear our earplugs while on active duty when needed to... I hope things changed for good for every single man and woman who served in the military

Thank you for the nugget. I have been waiting for seven months for my FOIA request for my C-file. I did exactly what y’all discussed in this video two days ago and have the process started. The person on the phone appeared to be fairly knowledgeable about the process. When I get that callback from the VA regional office data center. I will post that on here. Thanks again for the nugget. I did a request for my military records from NARA and it took about five days which included the weekend to get it electronically processed, but of course it had no service treatment records in it. So I have done a follow up request through NARA for all of my records. Their canned statement said my medical may already be at the VA if I have filed a claim. So why can I get a FOIA request through NARA in five days and can’t get my C-file in seven months from the VA?

It’s funny when the BVA judge hasn’t gone through your file properly, but you have I have had the same judge twice. The first time she only looked at one thing because she wouldn’t let me talk and the second time which was today now she’s claiming if she’s has jurisdiction And has to go through my entire file. There is another appointment with her next week, but something doesn’t sound right about what this judge is doing. I have never heard about a BVA judge having jurisdiction issues over an appeal. should I call Washington DC and file a complaint and get another judge? Or is this something that happens?

If they know I met the criteria why deny me and write that. I'm confused on one issue. You mentioned the White House VA hotline but that hotline supposedly went away a couple of years ago and the number was merged with the other VA call center numbers so are we saying if you call the VA call center you can get your C-file faster and without filling out a FOIA request?

The number did not go away. You still need to fill out a FOIA request to get your C-File. The process Mr. Kimble talks about is a method to possibly speed up the process. It’s not guaranteed to work but it’s one that can be successful if you try it.

I saw your videos about obtaining C-File, I was medboarded from Army and nearly 5 years later I had a favorable C & P exam. Fast forward 3 years later, I have never requested my C-File or filed for any Disability claims. I am a bit confused if me having a C&P exam but never filing a claim affects the process of who I am requesting it from. I have filed for and have been getting CRSC for nearly a decade though. Would me filing for and getting CRSC affect how I obtain C-File?

Hey Dewayne, I could use some help. Submitted intent to file I have an Asthma, COPD maybe a ILD diagnosis 52% of predicted FEV. I was told since I smoked, I might not get service connected. Does being stationed next to the 03 sulfur mine fires in Iraq help my claim? Are inhalers considered high dose steroids for 100% rating. I have to use 3 of them daily at maximum dose. Provider considering prednisone or other for long term use. Should I file now or wait for final diagnosis. Thanks for what you do.

Can an anyone help me VES scheduled a C&P exam on a day that I specifically told them I couldn’t attend and didn’t want to reschedule so they sent my case back to the VA regional office. I have been waiting for two years for this exam because of an appeal and a HLR. Now the VA rep said it’s up to the VA if they want to reschedule me for another C&P or if not make decision because I didn’t make the appointment when it clearly wasn’t my fault I couldn’t make it that day. If that happens they said I would have to appeal again. How can I file a complaint to the office of the inspector general or what can I do. Don’t want to wait for another appeal.

You can call the VA at 800-827-1000 and send in a VA Form 21-4138 stating as to why you couldn't make it and if they can schedule it again. Your rep could have done this for you if they knew what they where doing. If they deny it due to failing to attend.
