Procedure of Registration of Sale Deed( Part-2)
Friends , vieweres, Subscribers :- In part -1 we have learned the legal provision of Transfer of Property act with respect to sale , definition of sale etc. In this video
Sale Deed Registration Process: - The Registration Act, 1908
What is sale, provisions of transfer of property act , in the part -1. link has been provided in the description box. In this video we will discuss, the provisions of The Registration Act ,1908 and procedure of registration of sale deed before office of the Sub Registrar.
1. Requirement of Sale Deed :- Mandatory as per section 17 The registration Act, 1908.
 Immovable property
 Buyer
 Seller
 Sale Consideration
 Execution of Deed in Writing :- The draft should be in writing mentioning the entire property detail
 Two Witnesses
 Registration before the competent sub registrar office
2. Time for Presetting Documents :- Section 23 The Registration Act, 1908:- Subject to the provisions contained in section 24,25,and 26, no document other than a will shall be accepted for registration unless presented for that purpose to the proper officer within four months from the date of its execution:

Place for registering documents:- Section 28 of the Registration Act, 1908:- Place for Registering documents relating to land:- save as in this part otherwise provided, every document mentioned in section 17 , subsection (1) clauses (a),(b), c , d and e, section 17 , sub -section (2) insoa\far as such documents effects immovable property. and section 18 clauses a,b,c and d, shall be presented for registration in the office of a Sub Registrar within whose sub district the whole or some portion of the property to which such document relates is situate.

Original Signed Sale Deed in Two copies
Map of Property
Photo of Seller
Photo of Buyer
Pan Card of Buyer
Pan Card of Seller
Aadhar Card of Buyer
Aadhar card of Seller
chain title documents of Property photocopy
Adhar card of witness
5. Stamp Duty and Registration Fees:-
 Deposit in cash before the office of the Sub Registrar
 Deposit in the form of Stamp
 Deposit stamp duty online
 Deposit conveyance charges
6. Be aware from Deed Writers:-
 Not having updated Knowledge
 can Misguide you
 They always charge fees in percentage
 please fix their fees and obtain receipt
7. How to present sale deed before office of the sub registrar:-
 Fill the form
 annexed the Original Deed duly signed by both the parties and two witnesses
 annexed all the documents mentioned above
 pay complete stamp duty and conveyance fees and annexed challan
 present buyer and seller
 present witness
 submit the deed along with stamp duty
 sign before the office of the sub registrar
 thump impression of the buyer and seller
8. Verification of Stamp Duty and Enquiry after presentation of documents:- Section 34 The Registration Act, 1908
 The office of the Sub Registrar used to verify stamp duty and conveyance fees
 if it is presented on the less stamp duty, they used to demand stamp duty or fees
 if it is fully paid , they call the seller and buyer to put thumb impression in their presence
 They can ask certain question, in order to verify the geniuses of seller and buyer and witness
 They used to click pics in their presence
9. Certificate of Registration:- section 60 The Registration Act ,1908
 They endorse a certificate on the document that the document has been registered with them under the book number, volume number, page number and a copy has been kept for record in book number, volume number, page number .They also provide the receipt of deposit of amount
 They provide the original documents and kept themselves one copy in their record
 parties and any other person can obtain certified copy after depositing the prescribed fees from the office of the sub registrar, Jaipur.
