Never tried to contact him about it, seemed like a lost cause. I can’t believe he literally did the same thing to you, small world when it comes to getting screwed by this guy. Anyone defrauded by Derek Barnes should: 1.) File an initial police report with your local PD. If they tell you it's out of their jurisdiction, tell them you want a non-criminal incident report or "police info" report. Even if you are out-of-state, the report will get his name and information into the NCIC, which can be important for the filing of warrants and liens. 2.) Contact the Alabama State Attorney general. 3.) File a complaint with the CFPB. 4.) File a complaint with IC3 (FBIs Internet Crime Complaint Center). 5.) If a credit card was involved, do a Chargeback for the full amount.

You can buy from a small independent dealer if you are buying cheap cars that are cheap to fix and factor in the they are full of shit percentage into the negotiation. Otherwise walk. This Range Rover? Bad idea. On the flip side I have had major dealers try to screw me and have had to threaten the AG's office on them. It's all relative, and like the saying goes, you can tell a car salesman is lying when his mouth is moving.
@tr1llwill6 жыл бұрын
@@drgonzo767, very true. I recently had a large dealership in the same town attempt to screw me out of several thousand dollars on a extended warranty that I had 30 days to remove. I didn't feel like haggling with a finance guy so I let him put in on the price knowing full well I had 30 days to remove it and be refunded. Only to have this shitty finance guy not turn in any paperwork I went in and signed to have it removed and for 3 months gave me the run around until I did finally report them to the AG. Funny after that I was screening their calls from a general manager who was sending in refund checks with overnight delivery.

You have to look at the dealers reviews and see how long they have been in business. Just because a dealer is independent and smaller doesnt mean that they RIP people off. I've dealt with more honest salesman through independent dealers than I have with a major dealership where they have quotas and bogus add on services to sell. The secret for independent dealers is that they typically buy used autos through auctions. This is how they make most of their money but they usually offer some kind of short term warranty in the event that the vehicle turns out to be a lemon.

I've learned over the years this golden rule of transactions and interactions: In addition to financial loss, one must also take in to account the possibility of lost time to hassle and frustration. So, even with an ironclad contract, one must take in consideration the risk of losing time via hassles and frustration if things don't go well. Ask yourself, _"If I do this and/or in this way, in addition to financial loss, what level of hassle and frustration is possible and likely."_ If too high, move on.

My story was of much smaller stature...found a expedition on eBay in Atlanta from a small local dealer. It had all the stuff I was looking for at a good price, much cheaper than in NY where I am. Was assured all was alright, it was a "no excuses" truck. Flew down to pick it up and it had a cracked windshield and an inop rear entertainment screen. This was July 3rd and he was closing 45 min after I got there. Test drove it, ran and looked great aside from those things. He was in a hurry to leave and "assured" me he would make arrangements to fix it after the holiday. I paid and drove it home to NY. I get estimates to fix the glass and to replace the screen. He puts it off day after day saying he could find it cheaper. After a week I'm pissed and start blowing up his phone, cell and business...calling/texting him 30-40 times a day... If he didn't answer I'd let it ring and tie up his phone, I filled his voicemail to.etc. Keep getting "I'm busy" or "I don't want to pay full retail for the repairs ."etc. Told him that what he wanted was unimportant to me and that I was going to make it my mission to make his life miserable and spread this issue all over if it wasn't fixed in the next 48hrs. Told him I had researched his name, got names of his family and where they worked and places they were associated with, found web sites that dealt with promotion of local business and community around him, various ratings websites, BBB etc etc...and that I was going to be the parasite that made his life miserable. Funny, problems got fixed in less than 48hrs.

There's a dealer near me trying to sell a Geo Tracker for $5000 that's been sold for salvage twice and has had the odometer rolled back by ~100k miles (still says over 160k though) - gotta love dealer fraud.

I purchased a used Pathfinder once, that seemed to be running well. Despite the dealers strong encouragement I didn't get an extended warranty that would have covered it for another year. After a couple of weeks there were two oil drips on my driveway. I took it to a Nissan dealer that found several major issues, including the valve cover, suspension and brakes. They wanted more than $3,000 for repairs. I was very unhappy, because I did research and selected this vehicle for it's service record and my needs at the time. I took the opportunity to buy a Chilton's Repair Manual and did a lot of the work myself for less than $1000, including buying some tools. I also repaired some extra things Nissan didn't see. I only had to have them pack the wheel bearings because I knew I didn't want to do that part. Eventually, over the time I owned that vehicle, I learned how to replace, valve cover gaskets, rear break drums, rear shocks, front control arms, spark plugs, the panhard rod (had to track down the name before I knew what it was) and the various fluid changes. Doing my own auto repairs was very satisfying, because every time I turned the key I knew, I made it go. So yes VINwiki guys, you take the risks and find the opportunities for fun. Thanks for sharing your stories.

Ed, I always try to figure out where I went wrong when I make a mistake to help decrease the chances of repeating the bad decision. When I listen to this story the key was when the seller said if there is an issue, don't discuss it with the driver, take the car and we will deal with issue later. That was the "tell". The seller absolutely knew of the issues before you called him to discuss.
