Tanners and leathersmiths have been dissecting designer and no name bags for years, and have told people time and time again, they are just not worth the price tag for the materials. You're buying the name. If that's your thing, that's your prerogative. (I have a few brands I love too) But don't think you're getting leather, hardware or sometimes even craftsmanship that's all that much superior. It's all clever marketing and folks eat it up!

I ordered the popping yellow and it's absolutely beautiful!!! I will be wearing it in the Spring. Some of us can't afford an authentic Hermes Birkin Bag, so until then... 👜

If it doesn’t have the Hermes logo then it’s not a counterfeit. It’s a bag copying the design but as mentioned by other comments this doesn’t seem to be patented or protected by Hermes.

This bag is made by KAMUGO and sold via Walmart. I purchased 3 bags from Walmart - Jan, August and November. It was already a popular bag back then as there were times that it was sold out. If you do get the bag, enjoy. It’s a nice bag.

I am pretty sure that the issue isn’t in the design itself, it’s that some of these bags have the Hermés logos stamped onto them. THAT immediately makes it a legal issue. Not all of them had the logo, but some did. I’ve noticed that has caused this confusion (12:14) on social media. Walmart, and Amazon, use to sell the equally popular Daisy Rose LV inspired pieces on their sites and they stopped selling them. Yet, you can still get these pieces directly from Daisy Rose at no issue.

This. Years ago the brand Ainifeel made dupes of popular Hermès, Givenchy, and Celine bags. They had an Ainifeel logo or no logo at all. They blew up on social media. They eventually got pulled from Amazon. I heard rumblings that the brands complained. The same for other random brands that sold dupes. You see them one day, and they're gone the next.

So normally fashion dupes are perfectly legal because fashion is *very* rarely protected by copyright. The Wirkin would only be “counterfeit” if it actually said Hermes on it and they were selling it *as* an Hermes bag. Dupes and counterfeit are two different things. However… The Birkin bag design *is* actually trademarked, I came to find out! It’s kind of rare. For example, Valentino only jussssst recently got protection for their rock stud design. Louboutin has protection for shoes sold with red soles. Tiffany has protection with their specific shade of blue. But in many, many other cases dupes are legal, as long as the brand name and brand logo is omitted from the design. I’m sure that Walmart and/or the third party seller received a cease and desist. And this is sort of hilarious and ironic because in two seconds, something from Walmart is almost as rare as something from Hermes😅😅😅

I heard about this bag going viral a few weeks ago. I bought one a year ago. I was looking for something else on Walmart and the bag popped up. It's a nice bag for what it is. Walmart actually had on their website, dupes of the LV Speedy 25 in Damier Ebene and I almost bought it since I always wanted that bag and it was a lot more affordable. However, I was curious about this Walmart Birkin and I went to the website just to look. I was shocked to find that they sell pre-loved Birkins on the website! I had no idea! I did see the Walmart birkin in the site a few days ago, obviously, but I was stunned when I saw Hermes Birkins being sold by them starting around $25,000 or so!

Here's some insight from nosy me that does like to go to certain websites to see what's being faked and how it differs to the originals: These third party sellers are usually just distributors that don't control the production of the many quality variations fakes, you will usually have the factory doing the whole photo-shoot and presentation that then sellers use in their listings which in turn and depending on the traffic they get will eventually get taken down to avoid being easily tracked by the authorities or the brands. So the store you've shopped a few times will suddenly disappear but it really won't matter to the bottom line because there are already other 15 stores selling most of the things they were selling with exactly the same pictures and descriptions, so this seller disappearing form Walmart is probably just that and not necessarily a C&D. Being banned from selling your fake birkins at Walmart is not the end of the day when you still have other websites that do sell worldwide, including Instagram Further context, my local Walmart does sell Book Tote inspired bags in the palm leaf print with the word Summer instead of Christian Dior and those are produced by Walmart via one of their in house store brands

If you use Hermes name on the bag or if there is anything on the website that infers that its like a Birkin then there is potentially a legal trademark infringement . This is not just Walmart but there are other sites like DHgate, balaber etc that does this but uses Hermes packaging and labeling when they sell to customers. In France if you own a counterfeit bag you can be fined for it.

US trademark law - I have been told that if a company doesn't "defend" by legal means their product/trademark/patent etc, that they have legally forfeited it. There are other designer bags that are similar to the Birken but far less expensive. Designer bags do not hold their value. There are so many good quality leather bags out there that that will save you so much money. I think that WalMart as the sale platform will feign ignorance and say that when it was called to their attention they pulled the listing. They would be all about making the $$$ but would definitely NOT want to battle Hermes in a suit they would lose. Hermes copyright for the Birkin is VERY specific and describes the bag to the detail. A dupe is different from a fake/counterfeit. My understanding is as long as no trademark or copyright has been violated I think it’s legal. I do suspect Hermes will sue or has, at least, already threatened Walmart, which is why it’s no longer available on their marketplace. The pattern for the Birkin is probably trademarked which I think could be the basis for a lawsuit. But, I’m not an attorney.

I had my order cancelled, as well. I was getting it as a lark. Walmart pulled that seller. You can't even see it now. Walmart is a $640,000,000,000.00 business. Walmart does not want the Department of Justice to come down in them for knowingly selling counterfeit anything and the fuss about probably made the Walmart "Birkin" uncomfortable enough to pull the seller. If there was not a fuss, then the bags would still be there.

Doesnt matter that those bags do not have Hermes stamped on them. Hermes has the Birkin and Kelly trademarked; design aspects of the bag such as the closure, the sangles, the lock and the general design of the bag. These bags are not "inspired by" bags. They are replicas. Since this has gone viral I would think Hermes is going to take legal action. Walmart is a huge company in the U.S. and their legal team should have known this. But they probably didnt predict it wouls go viral. I'm sorry but if Hermes takes legal action, the company making these bags prettty much asked for it.

Certain countires where fakes are mass produced dont care about these laws. So i think it would be difficult to win those.

Havent all these stores had dupes? That colorful LV in the '90s everything. And the money the counterfeits makes per month probably rivals even walmart. Watching those import busts is insane. One shipment was, i think the cop said, worth hundreds of thousands (its been awhile since i saw it). And these are the bags u see on the streets and in shops in New York. This happened to me with labubu I bought 6 sets and when we sold one set the customer said are these real . All I could say was i bought them from Walmart and then later realized what your saying is so true

The Walmart Birkin just proved how much a Birkin is really cost to make, just like the Dior tote which cost $60 then retails for over $2000. The Birkin from Hermes costing at a ridiculous price because Hermes is controlling the accessibility. DeBeers diamond is the same. DeBeers was controlling the price of diamonds. Now we have lab made diamonds which is a lot cheaper and more accessible. Let me say it again for people at the back, no bag is ever cost more than $10 000.

I’m in support of Walmart selling the wirking because there’s no Hermes logo on the bag. I don’t think the lawsuit would be legal because it doesn’t try to pass it off as a Hermes. It’s not illegal to have the same design but only illegal if you use other business trademark. So I think it’s perfectly fine because it does serves the other people that will never be able to afford it. The seller of wirkin should sue Walmart because they are not doing anything illegal!

I am sorry but Hermes deserves to be rattled a little bit. They were too snobbish ,arrogant ,discriminating and rude to too many customers ( their right perhaps )Maybe this change them a little bit. I didn’t know any this Wilkins until now but 2 weeks ago I came into my Hermes’ boutique who usually ignore me and to my surprise an SA was was introduced to serve me right away… I served drink and cookies (d’ance butter cookies)…I got to buy some Items…were given some sample of perfumes …in general very well treated and for the first time enjoy my visit at the boutique. Could this has anything to do with it?

Despite the "popularity" of Walmart in the US, there are many of us who don't like the family's politics or business practices as it relates to their employees. I choose to avoid Walmart for those reasons. I would fully support any action Hermès might have taken to protect their brand.
