You have it wrong. They do have a right to a speedy trial, but they elect to allow the process to go slow if they expect a conviction. If they can do 12 months and county and then get an 18 month sentence, then they're only doing 6 months in prison because they let the process take all that time. They could exercise the right and speed it up, but then they're just doing their time in prison instead.

That’s crazy ! In Canada if you don’t get to trail within a reasonable amount of time (usually about 18 months) . You actually have legal ground to drop all charges . I can’t believe they can make someone sit in a jail cell for 5 years (in tax stone case) , and not take it to trail . That’s so backwards to me I can barely wrap my mind around it 🤯

It's supposed to be like that here at the states! Each state having their own little twist on the time constraints! Where I'm at at Washington state it's allegedly 120 days from the date of the charge/charges being filed. I learned that after a friend of mine who was out of custody on a possession of a stolen vehicle case who was found sleeping inside a stolen truck came to me one day and vented about how long the courts were dragging her on and on without a trial date, so I did a little research and found our about the 120 day thing and I went to her next court appearance with her and when her public defender shows up at the courthouse and asked her to step out of the court room with him to have a little pre hearing huddle up I stepped out with them and before I could say anything he said sir this attorney client confidential please return back into the courtroom and I said it's attorney client confidential if she does not want me to be present! He turned beat red and then i said I have no problem returning back to the courtroom but while your having this confidential meeting with your client, my friend will you please explain to her why it is there has not been a trial date set yet per the 120 day from filing day rule and why the court has been continuing her hearings for over two full calendar years since day of filing! Well he blew a head gasket and got all flustered and scattered and went in front of the judge and asked for another continuance that the judge granted and that next week on Monday my friend got a call from the public defender saying all charges have been dismissed!

As time continues someone will eventually break. It sucks, but the court system does use this tactic it's a whole different ball game when you are granted bond and you're able to fight your case from the outside.
