For those that don't know how one can take out a 2nd on a mortgage, it depends on several factors. I work in mortgage banking. The act of applying for a loan (1st or 2nd) and putting someone else's name on it is a felony in and of itself. How i think this happened is the sister convinced Evander to take out the loan (the promisory note). During this process, a title search is done. Everything looked on the up and up, so the loan gets funded. She then gets Evander to add her to the title after the loan got funded. She probably said something like "Hey, this is a good way to protect the property because it won't just be you on title, it will be us." I'm going to assume that Evander doesn't really know much about contracts, loans, title, etc., so he agreed. Just my opinion, but I think he got took by his sister and he is probably too embarrassed to admit it which is understandble. But at the end of the day, the sister cannot just simply apply for a 2nd loan in his name because that kicks off a title search, and if she's not on that title, the bank would have called Evander.

How are people thinking they’re paying off their homes only to find out a scammer has taken out an equity loan on it? Serious question I’ve seen the headlines in the news but to hear how this could happen from someone who was in banking would be good
@exquizit_d
@exquizit_d Жыл бұрын
@@skeezix8156 Just in general terms, not related to Holyfield’s situation, doing this scam is very difficult today because we store original documents digitally and we have all kinds of computer software that allows a bank to monitor the loan. Back in the day, people were told to store their docs in a safe or a safe deposit box because anyone can forge a signature, make a copy, and then apply for a loan. For example, in California the co-mortgagor can take out a 2nd loan (a loan against the equity of the property) without the other co-mortgagor knowing or giving consent. So, if you own a house and I got access to your docs and put my name alongside yours, I can apply for a 2nd. Today, this is damn near impossible to do because docs are imaged and stored on computers. Applying for a 2nd automatically triggers a title search in which they’ll see the original docs stored on computer software, such as AS400 or Fiserv, etc. It’s so difficult to do, many banks no longer require training courses for this type of fraud. If there’s anybody out there still able to do this in our digital age, I’d be very interested to know how they did it.

The Builder definitely inflated the price of materials & labor & " bestowed " that price . If he actually had the house properly appraised after the Builder ripped him off , it would've been in the 16 - 23 million range for 90's construction .

The estate is better off in Rick Ross's hands. He's already added to the property. It's bigger than it was. Also, Rick Ross hosts fundraiser and charity events as well as car shows and baseball leagues, etc.
