@gneeley your so right, many a fellow law school and business school students cannot pass these tests sober. I'm not kidding, this is from multiple grad schools and law schools.

.... and never ever mentioned in the NHTSA 'guidelines' which is universally responsible for such testing. Can you say 'set up' to make it easier to convict because the municipals NEED the money?

"Looking at your feet" is a required instruction in the DWI Detection and Standardized Field Sobriety Testing Manual 2006 Edition Session VIII, page VIII-9. The concept in my belief is that if you are looking down at your feet, it is harder to keep your balance because you are not looking at the horizon. Therefore, it is designed to make them fail. However, the manual gives no reason behind this.

I did it exactly perfect and in my dui case at court before trial the judge looked at the officer and said are you kidding me this young man did ut perfectly with a perfect military pivit at the end best I have ever seen and you brought him in for a .07 not even above the limit case was thrown out no fines I needed to pay and the police department was ordered to refund me the money I paid to the bail bonds company as my payment fir them wrongly accusing ne of a dwi small town law though

If you were a .07 by the time you did the pbt you were almost definitely higher while driving. Definitely a justified arrest

@David-bl6yg I also didn't mention that you can get a dui if you're under the legal limit and fail SFSTs. It's the SFSTs which show the person is incapable of driving. The pbt is just to confirm

Laboratory setting -- perfectly flat ground, no cars zooming by, no wind blowing at you, this guy's not nervous that he'll be shot at, etc.

I cannot do this and do not drink. I'm years old and have bad knees and take medications that make me shake. I'd be arrested right away!

In Illinois you are not required to take the field sobriety test, but if you refuse to blow, you lose your license.

I know that. I was only pointing this out because I have three friends who do have issues that would make it impossible for them to pass these tests and they never drink alcohol.

I know I couldn't pass this sober, I have tried at home. I can't stand on one foot for the count of 30 and I'm not too good at saying my ABCs backwards.

Never take the test!!! Field sobriety tests (FSTs) are voluntary in all US jurisdictions. Drivers can refuse to take an FST without penalty if they are pulled over and the police have probable cause to suspect they are driving under the influence (DUI). However, police officers may try to convince drivers to take the test, and they may not inform drivers of their right to refuse

You will be arrested if alcohol is detected and transported to jail…. Where a breath test will be administered if you try and be a jack ass and refuse to take it a blood warrant will be issued by a judge and you will have blood drawn by the law…. Put plain and simply do not under the influence of alcohol or drugs and drive… and you won’t be arrested. It’s just that simple.

guess what...there is never a black line painted down the middle....the pavement or road is not smooth...there is always noise when the officer is giving directions and ive tried this stone cold sober and cant do it

Interesting, but I decided to take this test, and I can't pass it :) I haven't had anything to drink, and I'm not using any substances! I reach the 6th step, and I start swaying; otherwise, I can stand on one leg for as long as I want without swaying! Weird! :)

@imanerd36 I was almost killed. I chased the driver down to the point he hit me. Now I am down for DWI and Agrivated assault with a deadly weapon. My life is being turned inside out right now. Nobody was hurt. If inches matter I would have been hurt or dead. I did not pass the field but I passed the office sobriety test. I was shaking for the first and thats that. It was not a fair test at all.

@ceethat If a person who is trying to balance looks up at the horizon, they can balance better. If the driver is looking at their feet, the inner ear fluid, which alcohol affects will throw the balance off. If your SFST trained..youd know this.

This test along with the HGN and one legged stand...when done correctly can spot the impaired driver with a BAC of .10 or higher. Its reasonable to assume that any person who is sober and under the age of 65 can complete or pass these tests.

No! It's based on the judgment of the officer. If you "stumbled" according to the officer, you failed. Your version of stumble can be very different than the officer, judge, and jury.

you make it sound like everyone has a medical issue. and even if the officer has reason to believe the person is drunk (even if they are not), they make the arrest and take them back for the Breathalyzer which will show guilt or innocent

The thing people don’t understand is that these SFSTs are a tool to help an officer develop probable cause to arrest. This doesn’t mean that the person is without a doubt DUI, all it means is that the person is most likely DUI. The breathalyzer test will be the determining factor of the DUI status.

@@alexp9470, absolutely incorrect. In a state like CA, there are two laws: 23152(a) - driving impaired and 23152(c) - driving >= 0.08. If you stutter and stumble during the sobriety test, they don't need to give you the breathalyzer or blood test. Their word and video (of your performance) can be enough to convict you. In the eyes of the law, even if you BAC is only 0.07 - but you do horribly on sobriety test, you are impaired under 23152(a).

I have moderate hypertension(low blood pressure). I often can look like I'm drunk because I can stagger when I walk and look tipsy, and can't stand on one leg(a doctor signed off I can drive fine though). I also have asthma so it's hard, if not impossible, to breath long/hard enough to take a breath test. False breath positives are also found in diabetics, and people with autism/Asperger's may have trouble starring at certain objects. Cops should have portable blood test.

no they shouldn't have portable blood tests. Police officers are not medical staff, they don't know how to put a needle painless in your body. But if you want to volunteer that's fine for me.

Just tried to do this at home, barefoot on carpet and failed. I have not drank alcohol in 15 years. When I used to do yoga, I felt like I had better balance. For example, I could easily stand on one foot with perfect balance. That must have played a role.

Why would you have your DUI look at his feet? Its not because he might trip or whats the concept behind this? I never tell them to look at this feet. Was there any changes to this test, it so, show me the resource or site.

What if you're just plain'ol too fat and have weak knee joints? So what is the officer supposed to do instead for this test and the one leg stand test?

They take you to the police station and do breath test in that case. Or if you can't do a breath test it will be a blood test instead.

They can still check your eyes. And if they think you're impaired, you'll end up giving breath, urine or blood.

I'm 70 years old with numerous old sports injuries to my knees and ankles. There's no way I could pass this test. And if I refused they'd simply haul me off to jail anyway.

@@pgo2372 lol wtf? He said he would fail this test even totally sober because of his injuries… do you think that the only people who get pulled over and asked to do sobriety tests are drunk people? Cops pull people over all the time for suspicion, and they aren’t actually drunk… How is that not common sense

​@@RicardoRoams then if you found yourself in this situation tell the officers you want to skip the field sobriety tests and instead go straight to the breath test at the station. You'd really only go to jail if you refused the breath test, refused to give urine or had a bunch of DUIs in your past.

Even in this lab demonstration the officer gets an instruction wrong. At about 28 seconds in, he tells the subject, "Do not start the test until I tell you." The test had already started. According to training material from the NHTSA, a correct instruction at that point is, "Do not start to walk until told to do so."

This test is simple. Period. You are asked prior to testing about medical issues. If you fail to mention a chronic condition you've had for years. Oh well.

Youre correct..I am not a doctor. I am, however, a police officer with 12 years experience. And TONS of drunk driving arrests...all supported by field sobriety tests. Theres a reason that we ask some questions at the beginning of the exercises. So...with that being said...I know something, there internet warrior. Its REASONABLE to assume that any person who is sober and under the age of 65 can complete or pass these tests.

This may be a little late but the rule is if they bring their arm 6 inches from their side and even if they do it would still only count as one clue. They need to exhibit 2 out of 8 clues to show signs of impairment.
