Just trying to keep your eye on the tip of the pen can cause a lack of smooth pursuit. The tip of the pen isn't a distant slow shooting star in the sky. It's a tiny up close item almost in your face controlled by a error prone human. What if the officer isn't being smooth and is actually promoting a lack of smooth pursuit.

I wouldn't trust the average optometrist or ophthalmologist to pick out eye movements and pupil sizes on the side of the road decide whether or not to send someone to jail... and they look at eyes all day long. I dont even know if I would trust a neuro-ophthalmologist to especially being on the side of the road with someone being in a highly anxious state.

fatigue can cause failure, caffeine can cause failure, lighting can cause failure. As stated above i wouldn't trust anyone, not a cop that wants to bust you for sure, Not only that, these tests are voluntary. That is never disclosed.

@@Hazel66781 As a recovering alcoholic 11 years sober with 8 drunk drinking prior to quitting i am well aware of the law. I thought i made it clear i was speaking to Field Sobriety Tests but if i didn't thanks for the correction. In saying that The police also need a lead up or a reason why they wanted to give the breath test or blood test etc.. & the field test is the perfect avenue to get there. Peace.✌

You will be arrested period… as long as we detect alcohol you are going and will be breath tested and if you refuse a warrant will be issued for your blood. And if it comes back will alcohol you will have a very bad day.

Over 40 different things are known to cause horizontal gaze nystagmus. This test is highly inaccurate. And no you don’t have to take it if asked !!!!

Danger Inc incorrect. There are over 40 types of Nystagmus. The only thing that causes Horizontal Gaze Nystagmus is impairment to alcohol, central nervous system depressants such as Xanax, inhalants, and dissociative anesthetics such as PCP. All other forms of Nystagmus would be visible when looking straight ahead, and if resting Nystagmus is visible the HGN test should not be performed and medical attention should be sought. This test has been scientifically proven to be the most accurate standardized field sobriety test that can be performed

​@@haydenlindquist7006 WRONG. There is physiologic gaze-evoked nystagmus and pathologic gaze-evoked nystagmus. This from neuro-ophthalmology text: Most normal individuals will have jerk nystagmus that fatigues with prolonged lateral gaze of about 30 degrees. In extreme lateral gaze of 40 degrees, some normal patients will develop sustained physiologic nystagmus. Note this is in direct contradiction of the video "check for nystagmus prior to 45 degrees." Not only do cops not know what to look for, even trainers administer the test incorrectly. Often performing the test when people are in upgaze (see video) and/or going out way past this 40 degree threshold. The video also says to check for vertical nystagmus. Here's what the text lists for causes for upbeat nystagmus: Chriari type 1 malformations, foramen magnum mass lesions, platybasia, spinocerebellar lesions, congenital, hypomagnesemia, B12 deficiency, west nile encephalomyelitis, and phenytoin, carbamazepine, alcohol, lithium, and opiate toxicity. And the list for down beat: MS, infarction, cerebellar degeneration, tumors, and smoking I find it laughable that you expect someone (police officer or their new "drug recognition experts") who do not look at eyes all day and tell them you can detect if someone is on drugs or alcohol by performing these simple tests. Oh yeah, I trust the average cop to see enough eye movements to know the proper angular velocity to move a target and to/at what deviation and evaluate and differentiate between pupil size/reaction, smooth pursuit, saccadic and nystagmus eye movements and interpret if they are within normal limits while testing a highly anxious person on the side of the road often in darkness with let's just say less than standardized light control.

this is a terrible demonstration, studies have shown that holding the pen too high on the horizontal test results in bad results
