She's doing this to avoid him filing for a retrial based on not knowing his rights and the charges against him. She did a great job being patient to avoid his theatrics getting him another trial.

He admitted to not knowing what a criminal complaint is, yet believes he would be best served defending himself against a State-brought criminal complaint against him. He literally doesn't know what he's signing up for or committing himself TO. I think she'd be best to deny his motion to protect him from himself. However, I am not sure that's enough for her to make that decision. Arguments can be made against whichever path she takes now, as a judge. And it's really whether or not the Appeals Court believes he should be able to represent himself given his stated ignorance of what a criminal complaint EVEN IS. So maybe she has the appeals court judges on speed dial, or maybe she's going to try to 'divine' what they will say in this matter. They're either going to have to deny him his right to defend himself, OR they're going to have to let him defend himself and play games for a little while longer. In my mind, he has the right to 'adequate' representation. He's inadequate by his own statements.

Wow. I thought Attorney Zachary Witchow was way more experienced as a prosecutor & trial attorney. He’s extremely good at what he does. Especially how he listens to the cross examination, doesn’t take many if any notes, and yet is on point with every single follow-up question & presents exactly the right exhibit at the right timing to illustrate his point.

I’m not being silly but do you know anyone who works for the d.a? My oldest child’s father works for the d.a and although he is certainly older and has more experience I can assure you that not just anyone will be hired to be a d.a. He has to have at the bare minimum 4-6 yrs of trial experience. What I’m saying is he’s far from a brand new or inexperienced lawyer

What's he's doing is about control. He already knows no matter what he's going to spend life behind bars, wether he represents himself or not. This is him stalling and finding ways he can be in control and it's just pathetic. No remorse for anything. Lock him up and throw away the key.

Whilst he says he understands, his responses suggest otherwise. The Judge needs to order an evaluation and let the mental health experts determine if this defendant is competent enough to defend himself in a manner that is subject to the rules and procedures of the court to adjudicate this case for trial. Apparently it's not a death penalty case for 6 counts of 1st degree intentional homicide in this state and should be imo.

We do not have the death penalty here in Wisconsin anymore. It was permanently abolished way back in 1853. I wish we did have it though for cases like this punk!

Hi I won hundred percent agree that he knows what he’s doing, but isn’t he playing a risky game? With these answers that he doesn’t understand the simplest of statements by the judge, looks like it would be grounds for her to deny his request to represent himself. At this point I think he still believes he can represent himself and have standby counsel to help him with the legal questions. She has made it abundantly clear that you either have an attorney to represent you or you don’t! You have no access to an attorney other than the jail house attorneys who have given him horrible horrible horrible advice all the way through this trial.

Also, it's important to note the power struggle here...not at the surface, but at a deeper level. He is getting off on having the Judge, a perceived person of power, bend to his questions and non answers. He makes it go as long as possible before he gives in any, simply to have those blips of power he wants to feel in this situation. If he perceives they do not see him in that position of power, he then throws Latin legal phrases out to make him feel he's back on their playing field....even if the phrases are obviously irrelevant to the questions being asked. He does not want to lose power. That's why he wants to represent himself, and bait this judge as long as he possibly can. After this moment in the spotlight, he has nothing and knows it.

The real show will be when he has his audience. When all the grieving family and friends fill the court, his sole objective is for them to see him still having power....(another reason for self representation) despite everything he took away from them. He wants that more than anything else. It's not enough to do the crime, it's about the continual gratification they get seeing the ones they hurt still in a state of pain because of them.

@@briane173 the withdraw request was filed because the defendant insisted to his attorneys that he wanted to represent himself, it wasn’t because his attorneys themselves requested to withdraw (although I’m sure that they were both hoping by some miracle that the judge would grant the request, but also knew that there was no chance that it would even be a possibility)

A real attorney doing that stuff would face sanctions because they know it’s all b.s. They can’t claim to interpret laws differently than the courts (including the Supreme Court) and expect to retain their law license.

The judge is repeating herself and explaining everything as best she can so there isn’t an easy appeal. He will most likely try and claim he didn’t get a fair trial and didn’t understand the charges so he can get a retrial, appeal approval or some other crap.

This is so painful to watch. This Judge is doing a fantastic job breaking things down patiently and refocusing him. This type of behavior/attitude is what many teachers have to deal with all across America. We need to start front loading our society with support by including self awareness "therapy" for students K5-12th grade. Life and emotions are complex. America needs to set kids up for success and we won't have so many broken adults!

Every person in that courtroom (besides the sovereign citizen of course) had to have gotten a massage, overly imbibed, taken relaxants, demolished a punching bag, and/or soaked in a hot bath after their day. The level of professionalism and patience each of them exhibited is outstanding.

And had to repeat all those measures to stay sane throughout the entire trial as he has become more & more difficult. Interesting that his acting out increased significantly as the trial got closer to starting. He settled down at the start of the trial & as it got closer to him having to present his defence his acting out is amping up again. Just a spoilt, bratty, petulant yet very evil child in the body of a man

I've read several comments and I can't add a thing to what has already been said...everyone has such valid points in what they have seen and heard thus far!!! The Only thing I can say is "that I feel very sad for every professional in this courtroom!" The Judge, each Attorney, each Staff person, each Deputy. I even feel sad for the walls! I really haven't the adequate words. Just feel so sorry for all of them...not to mention all the people/victims awaiting justice!

Mark my words, because I've seen this before, she will admonish him over and over for trying to testify while he's asking questions of the witnesses. That is if she even lets him do this, she's trying to let him, but he's not playing ball and she can't let him say he doesn't understand and have a means of appeal. It's going to be interesting to see how this turns out.

If she concedes abruptly to his request to represent himself she imperals the sanctity of the verdict. The small investment in time to make absolutely crystal clear to the defendant that he understands the ramifications will pay off at the end. She's like a surgeon encountering an unexpected complication.

@@D1it4FN rational people understand the ramifications. He is not going to admit to understanding. He is enjoying the attention and will not cede the spotlight. His playing ringmaster to the court puppets (in his mind) is so rewarding to him. Ultimately though, the gears continue to turn whether he complies or not.

It’s called Due Process and it’s a right afforded to literally every citizen in America. And if you were ever wrongly arrested, charged, and convicted. You’ll be glad you had that right. Justice will be served, but it needs to follow a specific protocol. It’s people with higher intelligence who understood the ramifications of mob mentality and the lack of intelligence of the masses 😊

@@Arminsaf2 but he’s not a Citizen of America. He’s declaring himself a Sovereign Citizen. By definition he does not accept that the laws, authorities, or governing bodies apply to him. My point is, he’s going to drag this out and garner attention because he can. In my opinion, in a nutshell, he’s playing games and he’s making the court play them too. No panties need to get twisted, nobody is neglecting his right to due process but him. Maybe you should help his defence, they’re looking to be excused. 😂 jk all due respect personally for the legal process and you’re right its important.

Yep. she is making sure that no court of appeal will be able to find that this guy was not aware of the ramifications of his decision. I suppose it's a matter of decorum but I kinda wish that she just would have said "do you understand that those 3 attorneys and their staff are going to do everything legally in their power to throw you in jail for the rest of your life and that you will be entirely on your own in preventing that from happening".

The reason why Brooks will *never* say "I understand" is because that is against Sovereign Citizen philosophy. They teach that it means you "stand under" their authority if you say that, which violates their basic beliefs.

I had to search for this after rewatching the trial for a second time. I'm currently up to the closing statements and also jumped and watched the 50min rant by DB.. He definitely was walked through his challenges of defending himself greatly by the judge and prosecution. They made very sure he couldn't back step yet he attempted to try and say he should have been offered assistance at the bench and being so head strong on not having a lawyer represent him. I hope he watches himself on trial one day from start to finish and maybe see what a bafoon he was and possibly may still be...

To a sov cit, “understand” means to “stand under” or to submit to the authority of the court or, alternately, to admit guilt. That’s why he keeps saying “aware”. The judge finally caught on to that. However, it won’t stop all his other sov cit nonsense, like pro per vs. pro se. He thinks if they agree to pro per, they are admitting he is “sovereign” and his sov cit b.s. will have to be recognized by the court. Like that’s going to happen.

@@tj6930 There’s a whole universe of crazy out there and there are a lot of people who cover it. I like Van Balion, Tones Overthinks It and Marc Baggett, among others. For some even grander delusions, try Truth Science151, who covers the wacky world of the Moors, an offshoot of the sov cits. Most of what these folks cover are traffic stops and other low level issues. You don’t usually get anything like Darrell Brooks, thank goodness. But there are tons of people out there who are totally deluded about how life really works (“The Supreme Court says I don’t need a driver’s license!”). It’s entertaining but at the same time makes you despair for the future of our planet. Critical thinking is just a rare talent, apparently.

I love how the defendant tries to use semantics in using the wording of “aware” in lieu of “understand” in order to potentially try to file for a mistrial at a future point in time. The judge showed much more patience than most would have with a murderer before her playing games and delay tactics. The defendant states that “I will be better served without representation”… Grave mistake as he’s toast either way, but it’s not going to end well for him in this case, especially without counsel. Death penalty is definitely on the table and if I was juror, there would be no question on what I would decide…

There is proto-Indo European evidence that "Under-Stand" is to stand beneath in observance of an authority's vested power over you. I am not bothered by his insistence on the use of 'aware' so long as it's a sufficient answer to the question being asked. Death Penalty is not on the Table unless you know something that I do not -- "Wisconsin is one of only 12 states which does not have the death penalty for murder and other serious crimes."

His refusing to say he understands something (in this case, he claims to not understand anything) isn’t helping him to be able to rep himself. He doesn’t understand that she’s asking what she is to determine if he’s capable of representing himself. His claiming to not understand the case, the charges and in his own words, the ‘cause’ of those charges isn’t going to get him what he wants. I don’t think he gets that if he represents himself, it’s *all* on him, it’s just him. Those lawyers, or any others for that matter, won’t be there for him *at all*

"Etymology 'UNDERSTAND': By mid-14c. as "to take as meant or implied (though not expressed); imply; infer; assume; take for granted." The intransitive sense of "have the use of the intellectual faculties; be an intelligent and conscious being" also is in late Old English. In Middle English also "reflect, muse, be thoughtful; imagine; be suspicious of; pay attention, take note; strive for; plan, intend; conceive (a child)." Also sometimes literal, "to occupy space at a lower level" (late 14c.) and, figuratively, "to submit." For "to stand under" in a physical sense, Old English had undergestandan."

Now that it's over, he was the type of defendant representing himself that Justice Blackmun predicted in his dissent in Faretta v California. Blackmun concluded with the following: "If there is any truth to the old proverb 'one who is his own lawyer has a fool for a client,' the Court by its opinion today now bestows a constitutional right on one to make a fool of himself." Fortunately, the Faretta decision also ruled that he cannot appeal based on ineffective counsel.

I have followed the trial so far and will do that. He is absolute aware, what he has done. He just denies that any of this applies to him because he's claming that there are no charges. And no, he is not a souvereign citizen. He is just prentending to be as he hopes to delay

If the jury doesn't come back with a verdict tomorrow I will be upset. He is guilty with intent. He needs to spend his life in jail. He is not safe to be in society. I don't say that often. I don't like jails, I don't like solitary, BUT he is truly a narcissist and a danger to everyone including his own kids. Also the only time I wished the guards would rough someone up. He's probably their worst inmate.
