Very few of them ever get confirmed. If they aren't confirmed ever, they aren't spoilers, they're just fun. The biggest one I can remember that was confirmed was Nagini, hut that was conformed in a trailer, so not exactly a major spoiler either. It just drums up enthusiasm for the product. I'm sure they love it. Well, maybe JK Rowling doesn't like it. She often hates fan theories that are wrong and has only mentioned a few she likes (like Dumbledore being death, she thought that one, while wrong, was poetic).

The fact that you and I both used the same example (and one that was revealed in a trailer, not even as a surprise in the film) shows that this kind of thing is rare enough for the studios not to worry about it. And given the number of theories that end up being refuted (not even counting the vast majority which have no chance of ever being addressed as they are not about future projects anyway), I think it is safe to say that there is little chance of these kinds of theories really spoiling anything. They are just fun and increase enthusiasm for the stuff they talk about. Nothing but up side for the studios.
