It's worth pointing out that someone can be truly PHENOMENAL at what they do, and just F*** up royally that one time that you (personally) depended on them most... Even the long lived pro's at sports and superstars have their moments in "the big game" when they do something on the field that makes us all scratch our heads and say, "Dude!!! What the actual F*** was that?!" NASA's another one. Top notch engineers and at the times, THE only group to get people onto the moon and back to earth ALIVE... ever. AND then they blew up one of their flagship craft... AND they destroyed the first Hubble on its way to deployment... AND then when they finally got one up there... a lack of ground testing had let them get it up only for it NOT to work properly... ...ALL within about a year... Sure... Anyone's capable of just sucking hind tit's at their job... BUT there are also times when someone with a long standing record of excellence just "blows it"... AND every single thing they touch turns into a shit-fest. Nobody's immune to a bad day, a miscalculation, or everything just aligning such that not even ONE thing can possibly get any worse for the day than it is... It's not weakness. It's not fate. It's life. ...AND the best most of us can do is take a little time to ourselves to recover from the shock and horror... AND then dust ourselves off and cowboy up... muddle on with what we still have... even if it's nothing and nowhere. It's not fun. It's not easy, but if everything was easy, nothing would be quite as exciting or as much fun as it can be. ;o)

I had a friend, key word had, who wanted to be a therapist. He had struggled with depression his whole life. He went through all the education, certifications, and trainings to be a therapist. Unfortunately he had issues where he couldn't see himself as being wrong in any circumstance. It cost him friends, including me, and the only people that would stick around him were the ones that didn't offend him enough and could work around the glaring issue. Problem was that as a therapist that just isn't something that works, he'd offer advice and when the first thing he offered didn't work it was offensive and he would dismiss that patient. I have no idea what he is doing now, but like you said, the desire to be something doesn't give you the ability to be good at it. He was a terrible therapist, and unfortunately he isn't the only one.

The problem with this case is that Bill Cosby would never have been prosecuted in 2005 as there was no evidence and no metoo movement. The 2005 Civil case was almost certainly a gold dig, the prosecution sought only money from the start and never sought anything else. To achieve the 3.8Mil pay out they had to offer something (in this case a no prosecution deal) or the case would be thrown out. So as with many high profile cases the defense made a deal to save face or time or just to make 100% sure the client is safe. Using hindsight and social opinion on the case is pointless. Without the 2005 deal Constand would have got no money and no justice. And lets not be naive if you offered 3.8 Million to every sexual assault victim vs even a guaranteed prosecution I bet the numbers would sway towards the cash. Dont get me wrong, Cosby is almost certainly guilty and deserves justice. However based on the current US system he should neve3r have spent 1 day in jail, rules cant be bent or broken because of social opinion.

I mean, as a guy who Constantly screams about transparency, everybody being hypocrites, etc., his move was that of the Biggest hypocrite in the room, since when it came to His time to man up and just Tell everybody like it is, it took him 2 years... All of that said, I do hope he feels much better than before, because as a fellow suicidal depressive, I can totally empathize with the "Im a piece of shit and nobody cares about me, at best." mentality and how entrapping it is. BetterHelp brought me to an edge of the thoughts I was having of suicide, almost became a reality. Last year during quarantine I was going through horrifying panic attacks and thoughts of suicide stemming from having muscular dystrophy and recently ending up in a wheelchair. I was feeling as if I was a burden to my family, and would ultimately be the downfall of our family. A friend bought me a subscription to BetterHelp to try and pull me out. The first counselor was treating our conversations as a time-wasting exercise so I switched, the next counselor was more interested in me producing music and finding it surprising that I was employed, asking things such as "Why don't you get on disability and relax?". So no to me BetterHelp is not a good source of help, and maybe it is because a person in my situation they couldn't relate to, but it only takes patience to listen. Anyway, that's my two cents.

The former DA never filed anything official in court. He just released press statements saying he didnt intend to press charges. @@katiearcher4475 Yes, but they also made the choice to include Cosby's sworn depositions from the civil case, which was the bigger problem here. There were even a couple justices who said that Cosby could be retried, just without those statements, thought the majority of the court did not decide that way. The trial judge at the time allowed the civil case depositions into evidence, but the DA had to know that it would be a point that the defense might bring up on appeal because of the former DA's statements to Cosby and the order of events from that statement to the sworn depositions in the civil case. @Andreamom0013 жыл бұрын
@@Jack-kn1mr Did they cheat, though? If the deal really happened, why wasn't it brought up at the time of the trial? Nobody has any way of knowing the actual specifics of the deal...and it's easy enough to put a wad of Benjamin Franklin's in one guy's pocket to suddenly remember new details in a non-written deal. Not saying that happened, but this decision allows for that to happen in a lot of cases in the future. Such a far-reaching deal (no prosecutor ever can charge him with crimes in the future??) shouldn't even be legal.
@eleanoreliz3 жыл бұрын
@@Andreamom001 So, as outlined in press releases at the time, the DA's office declined to prosecute because there was a lack of evidence. On the DA's word that there would be no prosecution on the case, Cosby testified under oath in the civil case, and made incriminating statements. Ordinarily, if there was a chance of criminal prosecution pending, you could not be made to testify against yourself in a civil proceeding because it would be a violation of your 5th amendment rights. The DA told Cosby, and announced in the press release, that there would be to prosecution, with the intent that he would then be in the position to be forced to testify in the civil proceedings. A decade later, the old DA had been elected out, and the new DA essentially said this agreement was not done in the usual way immunity is done with official paperwork. They could have chosen to prosecute and NOT use Cosby's sworn depositions from the civil case. The judge ruled they could be included. However, the prosecution must surely have known that it would be a point the defense might contest on appeal. They chose to go ahead with the case, including the sworn statements from the civil case depositions that included the incriminating statements. The first jury was hung. After a second trial with included testimony from additional prior victims, Cosby was convicted. That case was appeal by the defense up to the PA Supreme Court on two points. 1. the inclusion of the incriminating statements from the civil case that Cosby only gave because he had been told the DA did not plan to ever prosecute the case and 2. the inclusion of testimony from additional prior victims. The PA Supreme Court declined to comment on point 2 and made their ruling on the basis of point 1 only saying, it is clear that Cosby made his decision to provide testimony in the civil case because he had been told by the DA at the time he would never be prosecuted. After that testimony was given, to use it in protection was to violated his 5th amendment rights. You don't get to do that just because the DA changed and just because the agreement wasn't made in the normal formal fashion. Constitutional rights are constitutional rights. (No matter how shitty the outcome of ensuring they not be violated). The majority of the court further decided he cannot be prosecuted on the charge again. A couple justices felt he could have been retried with the testimony excluded as evidence, but they did not make up the majority.
@eleanoreliz3 жыл бұрын
And when I say "lack of evidence," I mean that the DA at the time said there was a lack of sufficient evidence that would allow them to prosecute and hope to prove their case beyond a reasonable doubt in criminal court. He said the only way they would win their case is if they got a confession from Cosby. (Which they essentially did in the civil case depositions, but to turn around and use those after the fact was a violation of Cosby's 5th amendment rights as previously outlined). He did the "promise not to prosecute" bit so Cosby would testify in civil court where the standard is lower for proving and winning cases (preponderance of evidence rather than beyond a reasonable doubt).

One of the main criticism of this system I read about is that it artificially favours centrists. I'm wondering if Australia's experience confirms it.
@samuelhorsfall38623 жыл бұрын
@@collinea8300 Kinda, but it mostly favours our liberal party (our ‘republican’ party), as they control the news. But the system itself is a lot less corruptible than that of America. Still abused, but by people telling people HOW to vote, not removing your right to do so.
@jonsmith50583 жыл бұрын
@@samuelhorsfall3862 It seems every voting system has major propaganda around it trying to stop it from changing. In the UK people fear change to their archaic old system because they claim it makes weak governments, but ignore that a party can get more than 50% of the seats but only 30% of the votes, or that a swing in 2% from one election to another can cause hundred of extra seats to be won. There are even examples of parties coming 2nd in terms of national vote getting the most seats. Because of how secure a big party can get aswell they can get away with huge scandals, the government is rarely at risk of collapse when they mishandle something (I think this is a negative btw as it allows them to shrug off bad behaviour and then encourages it as a result). Yet they tolerate all of this in the name of a 'strong' government' cause the propaganda tells them that coalition governments are weak.... The US will pounce on this as an excuse to keep their old systems.

@@jonsmith5058 And then there's Germany where our voting system is really confusing because you get 2 votes that are distributed differently to the parties and we also have an entry hurdle and dozens of parties (most of which I don't even know what they stand for) and our government keeps adding seats every election because of our rules but they don't want to cut seats cause it would get even more complicated so yeah... There are always downsides to every system

@@collinea8300 Preferential voting in Australia means major parties here often criticise those voting for 'minor parties' as voting for radical action or instability. Despite this, the ruling conservative government is actually a coalition of two parties, and the previous left government involved a coalition with independents and a green. Comparatively in the US it seems no one ever talks about alternative parties for politicians to fear losing votes to them in the first place.

Man, I remember that show when you said you were ending your sponsorship with BetterHelp, but I had no idea you were going through all that at the time. I’m so sorry to hear that. I think the true “Nation” knows how mindful you are of the words you speak and how highly you value transparency on your platform. So to think people were accusing you of being duplicitous or misrepresenting something for the sake of money is absurd. Integrity does seem to be a quality that is exceedingly rare in this industry, and I respect you for maintaining yours in the face of such immense public ire. On a final note, caring about the emotional well-being of your viewers, even when it’s only a select few, NEVER makes you soft. The way I see it, even though we’ve never met, I would be devastated if something happened to you, and it’s nice to know the feeling is reciprocated. Keep being you, Phil, because you’re a true gem.

And it wasn't even a problem with the system. They counted test votes, but the public and opposing politicians will likely rhetorically construe this as a problem with ranked voting. From all of the voting systems I learned about in PoliSci 101, anything is better than what the US has now. Hope this failure doesn't seed doubt in other communities around the country, and that those communities can execute the system successfully.

Ranked Choice can be overly complicated and in some circumstances can still result into negative campaigning. The alternative to actually _seat_ third-party candidates is Approval Voting. Basically every candidate on the ballot is marked "Approve" or "Disapprove".

Geez, as an Australian who uses alternative vote all the bloody time without issue, that NY election story was so frustrating to listen to. It seems like the folks responsible just didn't bother to take an extra 5 minutes to stop and check what they were doing, and they've ended up causing a massive amount of distrust in the system because of it. The US really needs to catch up with the rest of the world and quit using "first past the post", and this could have been such a step forward.

@@NewYorksMostWanted What do Cosby's victims have to do with DiCaprio and Franco? Why should all complaints about one person's behaviour be pointed towards two others? All victims deserve justice. The justice system needs to hold all perpetrators to account. Your comment about white men introducing Cosby to 'ludes seems to indicate that you think his use of them is those white men's faults? What gives you the impression that @Celos is a young person? Because they fit with a stereotype of 'young person' in your mind. How is being upset at something that is upsetting virtue signalling? My knee jerk reaction was that it has nothing to do with race, but checking my white privilege for just a second reminds me that yes the justice system disproportionately affects people of colour, especially given the stereotype of the angry black man, so that obviously played a part in this case, but also he admitted doing it. The answer is t charge ALL perpetrators equally. I don't see Celo's comment as a hissy fit, it's a completely justifiable reaction to injustice and realising that someone in their life isn't how they thought they were.

@@ggoodd32503 Your dad was right about the first part. He had to be freed. The only reason he was convicted was because of prosecutorial misconduct. Hell, Drake Bell just plead guilty to endangering and speaking explicitly to a MINOR and yet that's barely making headlines lol! Most people I speak to didn't even know!!!! I'm glad that unlike most, you're at least reasonable enough to admit there's a cruel double standard in the justice system, but that's just not enough. If you and everyone else truly finds things like this to be "disgusting" without any racial bias, then you should be gunning after all the Caucasians that are quietly being exposed for sexual harassment. I don’t blame Better Help, but I had a horrible experience with the therapist they paired me with. I had the immediate response option, and one night I had a really bad panic attack. Instead she asked probing questions about my family, and didn’t even acknowledge the panic attack or apologize for not being able to respond.
