This was on Wednesday March 29th 2023 at approximately 1148, on Granite street in Quincy Massachusetts. Casey Affleck and Matt Damon Are producing a movie called the investigators in the Boston area. "C.M.G.A. the people's watchdog" and myself happened to drive past one of the movie sets in public, so we decided to stop and check it out. Within a couple minutes we were approached by one of the movie set personnel saying that they own the street and we could not walk down it. Soon after we were approached by a couple of police officers that also told us we could not be on the public median. Those 2 officers denied to comply with Massachusetts state law chapter 41 section 98D by identifying themselves properly. ​@@lynnsavoy9388 sort of like a guy with a camera who holds up a film crew that paid thousands of dollars to the town and businesses on that street, all because he doesn't want to stand on a sidewalk. Actions like that is why a film crew would decide not to return, and pay that money to another town for their cooperation.

Yes, and kiss that sweet, sweet film money that the film company paid the town and businesses to use that section of town goodbye. His refusal to get out of the scene probably only cost the film crew a few thousand dollars cause frauditor didn't want to get out of the shot. Film companies have a HUGE variety of options of towns they can use for filming, and delays and hassles like this are not quickly forgotten by location agents. At least maybe a town without a full of himself frauditor will enjoy the hundreds of thousands of dollars a film crew spends in, and on, a town. But I'm sure the town will enjoy the 'show nothing' KZbin video instead of money towards a new community centre or something of the like.

Yes you CAN control the public in public. The production company obtains filming permits that prevent public access to public spaces for a set amount of time. It’s literally the law. They didn’t just drag a film crew out to public and hope no one interferes. So ignorant

Failing to ID could be a red herring attempt by the KZbinr. He did quote 98D, however, that section does not clarify the circumstances surrounding what they deem a "lawful request" while verbiage in the section suggests it is for internal identification and leaves the forms of identification up to the secretary for the city or town. Section 98C states that a city or town in MA has the decision whether they wish to have officer's names on display, but they are required to have visible their badge number, which the street officer did give. I could also not find anywhere in Massachusetts law requiring an officer to identify themselves outside of the performance of their duties. Frauditors have this misconception that it is a law officers must abide to, to provide name and badge number to anyone who asks, but that is not always the case. Some police departments have identifying to the public when asked as a policy, but, as frauditors like to say, policy is not law.

@@JeremyDevries Nothing wrong with unions vigorously defending their members over frivolous claims. Like I mentioned, the ID policy for officers in Massachusetts is a fairly large grey area, as far as actual law goes. That said, the officer gave badge number, and that would be all that would be needed if there were any actual grounds for complaint. The whole asking for name and badge number is just an attempt frauditors use for their videos to attempt to flex some sort of imaginary authority that they don't possess.

You forgot, You don't have "special rights" if your a freeloading frauditor. It isn't about "special rights". The film crew pays the town and businesses THOUSANDS of dollars to rent a section of town and close it off for filming for a specific window of time. In basic terms, that makes them leasees for a duration of time, no longer making that section public anymore. Before you say it, the town council would have voted on the offer long before filming, and allowed any resident to state their objection at a town council meeting to the deal long before the deal was signed.

If they have a permit which I'm sure they do, they can own a street including the sidewalks. And by law becuase they have that permit, they can restrict your passage through. And since they r commercial not free press, they have to get a permit to film. So most likely they did own the street at that time.

Around year 2000, I was working in New York City and walking one morning to my job situated on the west side of Union Square Park. As I was crossing the street to enter the east side of the park and walk west through it (my normal daily route), a production assistant or whatever with a walkie-talkie came up to me and told me that the park was closed for filming. But, I was late for work and pissed off at the thought of being personally inconvenienced, so, I simply continued walking on my way, in the same direction. I got a chuckle out of hearing the PA speak into her walkie-talkie, "There's nothing we can do about it." I found out later the crew had been filming "A Beautiful Mind." Honestly, if the PA had caught up with me, earlier, I might have complied with the request; I wasn't trying to be intentionally disruptive, but, she came up to me when I was a stone's throw away from entering the park, and, you know how things go when it's early in the morning and you're stressed out, LOL.

I had a similar encounter last month. They were filming in front of the entrance to the train station and I had a train to catch. Hearing them yell cut as I walked right through the PA was fantastic.

@@joshuaregula7070 usually film crews feel they can block sections because they have a contract that costs them thousands of dollars paid to the city to do so. Think of it like renting an apartment in New York. You pay thousands of dollars per month to rent a space you don't own and expect the owner not to just walk through your door whenever they like. It isn't that hard to understand. You pay to rent space, and that rental allows you to control access to that space.

@Joel Graham because they didn't have a permit. Film sets in Boston are marked off by signage from the city and use police details to enforce them. There was none of that. They were using an adjacent private space and trying to keep people out of the background in an area they had no jurisdiction over. They were hoping people would comply out of the goodness of their heart. Trains don't wait for anyone.

Section 98D, nor anywhere in Massachusetts State Law, defines a lawful request or who can administer a lawful request. That law, given the verbiage contained, suggests more the ID in question is for use when entering controlled areas, such as a court house or police station, etc. 98C states that town or cities may decide whether they require officers to display their name or not, and only requires a number be displayed. No where does it say they have to verbally identify their name outside of their performing a specific duty. Most town and state police with any rule regarding verbally identifying is a police policy, not a law. Like frauditors like to say, a policy isn't a law.

A few years ago their was an auditor in California who visited a couple of movie sets that were on public streets. The movie set monitors were not happy when the open set was being filmed. One set had a couple of off duty LAPD officers and tried to have the auditor stop because he was violating copywriter laws by filming from a public space. In addition, one monitor alleged to the off duty cop that the auditor might be a sexual predator. The next set had a monitor aggressively block the auditor with an tablet computer and kept asking why the auditor was there. The last auditor was videoing from a sidewalk and caught an attitude stating we have paid for a permit to close the sidewalk that the auditor was filming in public. While I respect that the movie producers should be able to film unfettered, they have to get the right permits to do so. If they fail to do it, their fault was either from not paying for the right, forgetting to get right, or assuming that filming a movie gives them Carte Blanche. Great Freaking Job!

that's probably because it is a closed set the film crew paid the town and businesses thousands of dollars to close off. The other people walking are probably paid actors/extras, and signed releases to be in the film. The escort is so that frauditor doesn't sneak into a shot that they wind up having to cut out (along with the thousands of dollars it costs) all because a frauditor wants to be a star.

That does happen occasionally, because that $200 cost them less than the thousands of dollars every minute costs them waiting for someone like a frauditor to get out of a shot. Not a good gamble for a frauditor though, since legally speaking, the film crew leases control of that section of a city or town for a specified duration, and as a "tenant" of the property for that time, can have someone like a frauditor trespassed as they are the controlling tenants.

When I worked as a LEO for a police department in Indiana I was ordered to violate peoples rights everyday. One of the most laughable explainations was "we have always done it that way".

Unless their contract says that the sidewalks are closed to public they are open. Sign only says that the road is closed.

Film crews/sets are one of those artificial hierarchies where people begin to think their own little world applies to the rest of the world, so at the top you have the actors (the 'talent'), then working your way down you have directors, producers, DPs (director of photography) . . and so on, right down to the riggers and lighting people . . . in this world members of the public are - literally - nothing, they are inconveniences to be shoo'd away . . . but in reality, in law, the public have the same standing as the talent, it's very easy for people caught in these little echo chambers to forget that, they'll try and move you on like you are part of their hierarchy (and at the bottom of that hierarchy).

Cities or towns cannot rent or lease streets they are owned by the public just walk where you want. The only reason you cannot is if the street is taped off because of a crime being investigated or there is a risk of harm to the public.

The question is, if a commercial entity pays for the use of public property, is it still considered public. I bet the Supreme Court would side against the citizenry and would say during the time period of the permit it would be considered private.

Perhaps, but the film crew paid hundreds of thousands of dollars to the town and businesses to allow them to restrict access in order to film. Frauditor paid nothing.
