That's the biggest issue with the copyright system right now. You can file hundreds of thousands of claim against any video on youtube, monetize them all against the video creator's wishes, and there is no punishment at all. The only thing that happens is the claims eventually get cancelled (or not) and you get to keep all the money you stole.

Game makers and/or publishers cannot, I repeat, cannot, legally file a copyright claim against a review of their game, or a news story about their game, using a video of their content. This is a first amendment protection of the press and is a violation of the law. These illegal copyright claims should be prosecuted to the fullest extent of the law. Just like KZbin bans a channel if it gets three copyright strikes anyone that makes three illegal copyright claims should be banned from making any future claims.

this wouldn't be possible as they have a right to have there content removed if it breaches copyright. However I think that youtube should make it much harder and time consuming to issue a strike for those that have abused the system and the strike should be reviewed by a member of youtube staff and a 24 hour period for the channel to try and defend themselves before the video is taken down. This would deter companies from issueing copyright claims falsely as if they are on this list it makes it harder for them to quickly remove videos actualy infringing there copyright.

Nothing would happen to them. And i don't mean in the 'life's just unfair' way. In the eyes of the law the strike was fair. Not because they talked about the leak. But because they posted links to the leaks. This made their video an accomplice to the leaked footage and it got struck down. The fair use claim only protected their comments in the video. When they started showing people where to find the NMS footage they stepped out of line and Sony tackled them like a linebacker.

Every strike should be manually approved by KZbin staff. Companies (well, anyone really) has the ability to issue a takedown notice on a video without harming the integrity of a channel with a strike.

Sony should be a very powerful money making machine because they make pretty much everything, however that company doesn't know how to get out of its own way. 80% of it's divisions are showing losses, and that would be fine for a quarter or 2 but it's been happening for like 5 years straight, at this point if they don't start selling off divisions they will very seriously go bankrupt.

It's only illegal if it goes to court. A false DMCA claim that goes to court can be ruled as perjury. But a claim made on KZbin is not, because it's not a true DMCA claim. It's just a company exploiting KZbin's internal system, which has no more legal status than reporting a spammer on a discussion forum. This would never go to court, because Sony wouldn't follow up on the counter-claim. They got what they wanted. They got the video down for a few days, diminishing its relevancy, using a system with absolutely no consequences to them. They could claim my vacation videos, and since it's KZbin taking down a video on their own service, it's legal.

This is how it works now: Everyone uses footage. Company that owns footage finds video that uses footage, doesn't like video, claims copyright. Video taken down. This means that companies can sensor whatever info they want, especially things that consumers should know.
