As those on Patron found out... we were screwed over well and truly by the chassis supplier. What appeared a perfectly legitimate and an established company appears to be quite the opposite. It would be nice to trust suppliers and not have to spend hours digging in to companies house and reviews each time. 😔

First! 😉 Before everyone comments about what we could/should have done to avoid. Hindsight is great. But having spent a sensible amount of time checking over the company and it's work, talking everything through and seeing example chassis, we had no reason to think otherwise. Being custom fabricated and a proposed short lead time it also did not seem unacceptable to pay when ordering. Let's just hope we have learnt something here and be thankful it wasn't a £80k glazing package. I'm sure we will get back on track soon. ... (IF YOU CAN DIY!) 😬

Having been taken like this before, I only pay up front with credit cards, as then there is always the charge back option.

We did similar with a steel framed building 5 years ago, paid upfront, had it fabricated in Northern Ireland (just over the water from us) repeated aborted delivery dates, asked for our money back, blocked our numbers, luckily paid by PayPal but they showed PayPal tracking info for a recorded delivery envelope to my address to try and prove delivery, very stressful few weeks, tracked down the conman to a farm in Donegal and ready to board the ferry to give him a hiding and PayPal refunded us! People ask us on KZbin why we do everything ourselves and don’t use outside contractors?? 😂 this is why!!!!!

If you paid any of this on a credit card you can use a section 75 charge back for the full amount. Or as its under 10k go to the government money claim service online and claim it there. Good luck.

Unfortunately by not naming the company, others will get stung, while you are the nicest couple possible, you cannot always take that route. If the Company are still operating County Court them, (The small claims court is the low-hassle way to take legal action for up to £10,000 against a firm or individual in the UK) Inform the VAT office of fraud because some of that £8K will be VAT. You will sleep better if at least you take action against them, and by taking action that does not mean your are bad people, after all its your own hard work that has earnt that £8k in the first place.

I wholly agree with this. In the same way you said you spent time checking over the company, it's experiences like this which are important for others who might be checking and considering the company. That information needs to be out there. You have done nothing wrong. You do nothing wrong by naming the company involved. They made the choice to con you.

To name the company would be the right thing to do Jo & Tim, not for bitterness or revenge, but to make sure this doesn’t happen to other people. You are in a position to save someone else from this anxiety and upset, and it’s the right thing to do. I hope you get your money back, and that things move along as quickly as possible with the chassis now, sending lots of love and support! Xx

Libel and defamation laws in the UK put all the onus on the person making the accusations. Even with proof, you can still get dragged through the court system.

You HAVE to name the company. They don't deserve the respect of not doing so and your followers deserve the respect of knowing who to avoid. It is also the best shout of getting a refund.

We had similar delay after delay with our garage build. My wife went postal with the guy, and we saw a small amount of progress, she then had a very cold calm conversation with him, 95% complete, in the end I spoke to building control about what was needed to finish off and get sign off, builder miraculously turned up the next day and finished off, strange that! . Can’t fault the workmanship, but the communication was atrocious throughout. I will never engage the services of a trade again if I’m capable of DIY. My advice regarding your fabricator, send him a recorded delivery letter with a formal request for a full refund and include a photocopy of completed small claims court paperwork with a 14 day window. If he doesn’t refund, then post off the court papers. Reason for including the copy of the court paperwork, sheer brinkmanship! He will know all you need to do is stick it in the post with the fee rather than court action being an idle threat. Good luck!

A Section 75 claim via your bank / credit card company is much simpler and you never have to deal with them again.

I know that it is a difficult situation, but at least you should name the company and or owner you were speaking with to allow and ensure that others who watch your channel do not get ripped off. Your call of course, but it could be the right thing to do. Keep plodding on and i hope the farm progresses as you both hope! 🙂

Tim & Jo - Very sorry that your fabricator has failed. There is one person who can proide these and is 100% reliable . . . build them yourself One day practicing welding on scraps of steel until you are happy - take a week if your want better quality. Your temporary home is not a major structural item like a bridge - you could bolt the steel togther with some corner braces etc. If you want someone to someone to drill holes for a week I will help. I used to live in Malvern

Structural welds are not a diy gig. Running a decent bead takes enough practice on it’s own. Knowing you’re getting the correct penetration and not burning through take a bunch more time.

If you plan on taking him to court then do NOT name and shame on here as the courts don’t look at that action in a good light. Once the claim is settled then you have every right to name and shame. Hopefully you used a credit card and can claim back the money from the credit card.

agree, agree agree ... well said Paddy. .. fifty year in and around the construction industry this happens all the time. Keep it simple tell the guy what you are going to do , no arguments try not to raise your temper or blood pressure.

So sorry to hear this Tim and Jo. May I make a suggestion. Only ever deal with companies who accept payment by Visa. That way you will always get your money back, even if the company is fraudulent.

Tim, are they a Ltd company?, go to companies & check them out, if not Ltd, sue them personally, small claims court, don't let them walk away

Gutted for you guys - hopefully you do get some (if not all) of it back. Out of interest, what's driving the need for a proper chassis? Is it mobile home planning compliance, or are you fully expecting to sell it once main house is built and so it needs to move? Because given the size of your second hand floor joists, you really don't need much of a chassis - a simple box ladder frame up the middle will do it. Those joists are plenty strong enough to not need the arms. And if you're not intending to move it again, but dismantle it in 10-15+ years time - are you sure a wooden ladder chassis isn't legally compliant? Double up the ring beam and screw the wheel hub straight to it. Ring-beam could also easily be a DIY flitch beam if deflection needs limiting.

Well that is a complete nightmare........ Anything paid on a credit card? Even a small percentage could get all your money back Under Section 75 of consumer credit law you might be able to claim your money back? Money Saving Expert has some really good guides

This is why I always use my credit card for purchases. Having needed to use section 75 myself, it's a godsend. I submitted it and Barclaycard had the money back on my card withing 3 days.

try getting a Chargeback from your bank, you have proof via emails and texts that the product hasn't been delivered and it will then fall on his bank to chase him.

DO NOT name and shame..... Yet, especially if you intend on taking them to court. The key thing here is to get your money back first, keep your heads up you both are admirably honest and genuine people.

Put in a small claims court claim. Also serve a winding up order. There over a 100 more companies gone under this year in construction due to various pressures.

100% agree. Jo/Tim, please dox this company. If it had just been delays I would agree that you don’t need to shame them on your platform. But if they are stealing £8000 from you, then your community will get behind you! Presumably you have notified the police, and I am not suggesting that your community harass the company, and go on a witch hunt, but there are a lot of like minded people here who operate in the same circles and this company need boycotting. Being bad at time keeping is not worth outing them for, but if they are breaking the law, the company needs running into the ground.

100% disagree, naming and shaming rarely achieves anything, they should fight this through small claims, and then, when they win, they can name and shame, doing so now could affect any chance of winning in small claims.

2:17 - Jo - yes indeed it is! I literally trust no trademan. I will not have them on my property, apart from 3 very very carefully handpicked guys and even then, I cannot actually 100% trust them, their work is top notch but their arrival date and work hours is sketchy! I have tarred them all and most people I know do too. We have practically rebuilt a house and added an extension and built a detached garage, all on our own with the exception of gas man, plasterer & stove installer. This house is worthy of a magazine center-fold (if I do say so myself - like your old house Tim & Jo) and not a trade in sight apart from those 3 things.

On the last video you mentioned the chassis on I thought to myself, I bet they've not even built them. I'm sure you've got it in hand, but if the company say they haven't got the money to refund you, you need to submit a Section 75 claim with your bank / credit card company and they'll refund you and claim it from the seller. I had to do it last year after putting a 50% deposit down on new windows and door. The company knew they were going into administration but continued to take orders. I chased for install date as it was past the planned date and no response. Then days later got a letter from the creditors. Got my money back via the Section 75 and ordered elsewhere and explained the situation I'd been in. The new place were so much better and didn't insist on 50% deposit up front, let me put a smaller amount down, then the remainder to make up to 50% of the cost on install and financed the final 50%.

Sharing your frustration and pain here T&J. You should name and shame this company and the people/person you were dealing with. Likely if they’ve done it to you they’ll have done it to others, and will likely continue to behave this way in the future. It may not get your money back, but it may help other potential or existing victims. Tho not wealthy, I would be glad to chip in to the new ‘Chassis Fund’ ! Likely there are others who feel the same out here!

It’s sucks I hope it all works out. I know the feeling of waiting. I have waited since October to have a new heating system installed. The old system was taken out as the install date was agreed. We are still waiting and still don’t know when we are getting it. Life can be frustrating and it’s holding us back on many things. Luckily we have a big wood burner and a heat AC pump which has kept us warm for the winter.

Right…time to get tough. Get a solicitor involved and start legal proceedings through the small claims court. I feel your pain. Ive got a similar frustrating issue and lost it with them a week ago. My next target date is the 28th March….I’m not holding my breath!! It appears people are willing to lie and blame others instead of owning their mistakes and work to resolve things. When this happens it knocks your trust in all traders and makes the whole process so much more stressful. I hope you both get a resolution. I would definitely seek legal advice though.

Would you want them now? Let’s just say they did turn up on that Monday. You gave them a once over and they looked good. Then you started the cabin build and something goes pop or cracks and then a catalogue of errors and issues occur causing headaches and further delays. Yes it’s a heck of a lot of money lost but probably a huge amount of heartache and trouble avoided. It’s the big glitch of any build. I do feel your pain though as I had a dodgy builder in when we bought our wreck and I’ve had to spend the same over to put right what he did wrong. People said i should’ve got him back but I say I don’t give dodgy a second chance. Chin up and press on!

Tim and Jo, so sorry to hear this, was hoping it had now been resolved and your radio silence was because you were busy building. Have to say I agree with a lot of the comments, forget the hindsight, move on to a new supplier, county court them and name and shame. Don’t let their bad experience affect your energy - you will come back from this.

Those pictures of the chassis look like ones I’ve seen on a company’s Facebook page, I won’t name them just in case it’s not them, but would be a shame not to save others from the same issues. All the best for the ongoing journey and hopefully things will sail along once you get the new chassis from someone else 👍🏼

Hi Tim and Jo, it may feel like cold comfort now, but the small claims court can work. Some years ago I had to do this. The guy got very abusive on the phone when I rang him to give him one last chance, and I pointed out that it was not something that I wanted to do, as I was aware that it would make life very difficult for him as far as future loans etc., were concerned, but that he had forced me into this situation (which had gone on for 9 months). We had almost exactly the same issue and conversation on our build. Like Jo my wife said “he is lucky we are such nice people”. You are doing the right thing, no real advice except as Jo says you have to draw the line somewhere but you are also right to be pragmatic and not “cut off you nose…”

Hi Tim, Jo, sorry to hear of your predicament! You should definitely take the company to a small claims court, to have any chance of getting your money back, and what has already been said do it yourself. Lesson learnt never pay all the money up front, if a company can't make the product with out it, don't use them. Keep up the good work and hope you resolve the issue soon 👍

What a nightmare - how about - you have almost 200k people who love what you do. Within that number of people there will be people who can potentially fabricate what is required. Put a shout out for help and let’s see what turns up to reinstate all of our faith in people and help you get on with building your new life. If I had a fabrication business I would be on the phone to you.

What about getting static caravan chassis, they won’t be brand new but with a little bit of DIY refurb it’s a good option obviously back to the drawing board for the size of your cabin to match them but would be cheaper and would let you both get a start on your temporary home while renovations on the farm

😖😖😖 All of this just rang of déjà vu. Had the same problem when having my pad for the house addition constructed. Understanding, consideration were finally worn down to confrontation 😣 was fortunate to get 85% of my money returned. Hate to see this happen to anyone and yes I too had done my due diligence.

Have you considered checking the scrap yards for a couple of old caravan chassis'? I built a cabin on two that I bolted together. You just need a bit of DIY experience. I'm sure you know a good DIYer. 😉

Do you know of the KZbin channel, Wild Wonderful Off Grid? Together, Erin and Josh have built a house, and more, by themselves. Just recently, they contracted others to begin building a new investment property house. The first set of foundations and concrete walls appears to be faulty. It is misaligned and crumbling and cracking only days after the pour. (oh and the contractors have done a runner) Testing it still to be conducted to confirm if the concrete was substandard.

Best advice I can give you is send a formal letter saying you are taking them to court, get the ball rolling with small claims/county court and then once granted immediately escalate it to the high court (costs roughly £100). Once you have a high court writ then the bailiffs/sheriffs can’t be turned away and have the power to enter commercial premises and seize/remove goods to cover the dept. In the past they have walked into airports and seized planes from airlines that owed money to passengers. Personally I wouldn’t name and same until they are found guilty, once they have been found guilty it’s then public knowledge that they were in the wrong and effectively you are just highlighting people to the court papers that are publicly available. Also make sure on all court paperwork has the company’s name and the owners personal name (plus address if possible). This makes it easier to get the money back if the company goes into liquidation as they have a person to chase

Also on a side note, try and always pay by credit card as others have mentioned. This means your protected under the Credit Act and under section 75 effectively you can claim your money back from Mastercard and then they will go chase the debter. You don’t even need to put the full amount on a credit card to be able to enact section 75

that is a proper sting!! I think if it were me i would be driving to their workshop unannounced to find out the state of play. I would then be naming and shaming as well as going to the small claims court

Hindsight I know but in future pay by credit card then if services are not supplied you can invoke Section 75. Card will reimburse and go after supplier. It’s heartbreaking though especially as you have young children to take care of. Good luck. 🙏

I feel for you, the failed promises and us being too trusting allowed things to drag on too long. The uncertainty gave us more stress than simply walking away and fixing ourselves. If we had time we'd have done things ourselves but wanted to relieve that burden...lesson learned for me but hopefully it's only time you lose. Chin up

Poor service and broken promises are one thing...but effectively 'stealing' your money is unforgivable... I'm completely in agreement with the majority of comments on here that advocate 'rinsing this company online... use your platform to highlight the rogue traders and thus allow the legitimate ones to move a step up.

Just stupid question first. Assume Chassis to be mobile for planning. Anything say you can't make out of wood? Add more wheels? Why does it have to go round sharp corners. If you are selling them afterwards when all over, then make your own chassis? Were they galv? (Truck them to galvanisers?). Assume company far too small to put on Resolver? Jo needs to be in charge of due diligence, pay people visits etc. I wouldn't argue with her, just couldn't 😁. Anyhow with your energy and fitness you will overcome this.

Sorry you've been done over on this guys! It's a real kick in the teeth. I've been strung along in a similar way before. You can do all the due diligence you can reasonably do but some people are simply dishonest and are very believable liars. I think there is often a tendency to feel that somehow you should have known better and that some of the blame lies with you for not seeing through the scam. It dosen't. There's no shame in being a decent and trusting human being. All the best for the rest of the project. I'm sure you'll get this sorted soon.

Tim & Jo Same thing happened to us and the tactics ring so familiar to us. Just remember that these people will not benefit from their scam they will always be playing catch up. Decide between yourselves that this will not ruin your lives or you experience of the farm. Rise above it and move on with your lovely family. Like yourselves we are possibly too trusting of people, butt we got scammed earlier this year and emotional impact was terrible. Not as significantly as much as you've potentially lost, but that sick feeling is the same. I am a lot wiser now after the result and I am sure you will be too. I totally agree with Jo, and I see where you are coming from, I was lied to and as a result my company went under and I took him to court where he admitted that he had no intension of manufacturing the items I needed and had been playing us all the time, I ended up out of pocket by thousands of pounds and had lost over a year of production time and he just was not bothered or sorry about the lie. You are going to have problems getting any of your money back or see anything for your money, unfortunately the world is full of people like him, but you have one advantage, if you out him on your you tube channel other people may see this and give him a wide berth. The trouble is that if he declared bankruptcy, he could open another firm doing the same scam with a different name and nobody will know.

That’s just awful. There is a reason I now ‘do it myself’. That is that many tradespeople have let me down on quality, value or wasting time. Something like this would tip me over the edge. My thoughts and prayers for your mental well-being and hopefully recovering your money As a side note. I’m this instance it could be worth saying who this company were so that others avoid. Not a slating or anything as I know that would go against your values, but making others aware. Obviously you may want/need to wait until after any claims are settled though.
