Oh, my #1 takeaway was that you confirmed I do need a Privacy Policy on EVERY page of my website. My consultants were telling me it was not necessary, but that just didn't sit right with me. So I hopped on KZbin and found this video. Thank God!

Hi Sam, thank you for your great information. I am a woman business owner and I do appreciate your expertise. I have two questions for you: 1) As a service do you ever review privacy policies, Website disclaimers, or Terms and Conditions that a business owner has drawn up? 2) If offering a Service online, through a Service enrollment process, is it required (legally) that a business have the customer accept the terms of the Privacy Policy prior to enrollment completion (at the time the customer is accepting the Service Agreement during enrollment)? Typically speaking you don't have to have someone agree to your privacy policy -- it just has to be made available to them and you have to follow it :) Of course you can always chat with your own attorney if you're looking for advice on this or to see if you're doing it the right way. Thank you for the video. In your personal opinion, is it a good idea if I use my Wix provided Private Policy and Terms/Conditions templates? Then, have an attorney review it before posting it on my website? I am an emerging California artist/painter and my plan is to do it correctly and to same some money. Thanks for any help

Hey Jo! If you had an attorney review them, then it might be fine! But those free templates are usually VERY bare bones and don't have what you need to protect you. So I'd recommend either going straight to an attorney OR purchasing website policy templates (like the ones I offer) and then having your attorney review them, because that will be much faster (and therefore cheaper ☺️) Hope that helps!

This was super helpful. I have a question about the privacy policy. I use Wix for my website. Do I need to create an additional privacy policy, on top of what they already have?

Hey Erin! Great question. Ideally you’d use your own privacy policy instead of theirs! You really want to have something that’s customized to you, your business and your site. Ideally you’d want to know how and what edits you need to make to the policy to make sure it actually covers you. Typically the free ones are super basic and generic - so they don’t actually cover what you do. I have a privacy policy template you can customize in my template shop! Hey there! Great question :) So an LLC would be really helpful for protecting the business overall (including your website), but you'd also want all 3 website policies on your website, too. They don't just protect you from lawsuits, but also people stealing your content, asking for refunds, sharing your content improperly, blaming you for bad experiences with third-parties, etc. Hope that helps!

I'm confused about the "website disclaimer" I am an e-commerce store. I get the privacy policy. But is the website disclaimer the same as an "about us" page? I see templates online for generating my privacy policy or plug-ins on my WordPress. But I don't see anything for website disclaimer.

hey! No the website disclaimer is not the same thing as an about page. It's a legal disclaimer to disclaim liability for people's use of the site and consumption of your content (& more!)

Ignorant question here. Is there a difference between those disclaimers at the footers on websites versus those pop up banners? I'm reading how it is required by law. But I am confused when I look at other websites for examples and clarity. I don't see the pop banners on e-commerce websites. I see the privacy, cookies, etc... at the bottom. Likewise if I am reading an online article I typically get the pop-up banner. Are these different and separate? Also, what is the difference between terms and conditions versus terms of use?

Hi there! That's not an ignorant question at all - that's a good one! So yes, there's a difference. The disclaimers that I'm talking about (the ones that are entire pages and are links on your footer) are robust policies that cover many different topics and disclaim liability for a number of different things you do in your business. Usually the ones we have in a post, or at the bottom of our site, are sort of quick, highlighted versions of a disclaimer stating something that you really, really need people to see right up front. At least for me, terms & conditions are a website policy that you use on your website to set the rules of use of your site. Terms of Use is a contract that people agree to and acknowledge when purchasing a course or digital product of yours. I Hope that helps!

I really enjoyed this video. I am in the process of hiring an attorney to construct a privacy policy and terms of use for my website before I officially launch my website. Now I see that I also need a website disclaimer. I am a new start-up nonprofit organization. I do plan on selling merchandise on my website in the near future as a fundraiser tool. Should I have something indicated also to indicate that information that will cover me when I start selling merchandise?

Hi Sherry! I don't recommend generators or free templates, since they tend to be pretty generic and bare bones. You'll want something more specific to your business. If you can, contact a local-to-you small business attorney to draft those for you.
