This woman is misinformed! The Employment Services Act makes it an offence to employ undocumented foreign nationals. Home Affairs and Labour both have dual jurisdiction over this matter and Department is correct to have these offender arrested by SAPS. Next we must have all the temporary exemption permits cancelled, that alone will create nearly half a million jobs for South Africans. The Department must focus on the construction sector next, that's where they will find alot of undocumented Zimbabweans eating South African jobs!

To a point. The passport immigration issue has been postponed a few times now and people are still in pending mode. We need some clarity on that. Bargaining council happens differently in each province. The licenses and non compliance issues are very important that each restaurant needs to adhere to. I think what Labour needs to do is maybe find a place on there website on the important documents one needs to have in order for restaurant owners and managers to tap into which could help manage and regulate the industry better. It is out there but not in one piece and sometimes a few licenses doesn't get address which needs to at same time.

What she is saying is that the Zim workers were given a deadline of visa renewal. Think it was Dec 31. That concept has been postponed 2wice to a later date. Definitely agree with her that this idea needs to be sorted out. Can't be in pending mode because now you create situation where staff members who are of foreign national has visa application on pending mode. Can they still be employed or they can't. Needs some clarity.

The truth of the matter is that most restaurants are hiring and exploiting illegal foreigners in South Africa. This further exasperates the life of the unqualified South Africans, who desperately need those jobs. One thing to note as well , most restaurant's cooking standard and food taste has substantially declined, especially those with big numbers of foreigners in their kitchens.

Most restaurants that I've visited in the Western Cape of recent have illegal immigrants as waitrons, particularly Zimbabweans and Malawians. Don't agree with this lady, Wendy. She's "talking up" the industry. For example, my grandson has been working at restaurant on basis of tips only and the owner refuses to give him written contract. The owner has at least three illegal aliens working at the establishment. The practice is widespread in the industry.

Does all these foreign aliens like you said have pending documents with home affairs to work but still waiting on clarifications by home affairs to approve it or not. Still pending since July 2023. That valid question. The other valid point is the non compliant licenses and all the checklist goes with it. Also very important and alot of don't always have that in place. The 3rd one is bargaining council which differs from province to province. With you been in western cape. That bargaining council has been scrapped to a lower surface compared to jhb. The paperwork needs to be sorted out from business to staff. Totally agree with you on that point.

Is it legal to take card fees from waitron's card tips? Is it legal to make waitrons hand over almost all their cash tips. Is it legal for no basic wage. Is it legal for waitrons to pay R200 each to the kitchen staff. Is it legal for waitrons to be told they can only go to the toilet with permission. Is it legal for waitrons to have to pay breakages if customers do the breaking. Is it legal for waitrons to have to buy their own customer cutlery?

If the paperwork of foreign national is legal binding. They can be hired. The issue that Wendy touched on is valid where there is a pending documents on the Zim workers. That contract was valid till July 2023 and then it got moved to a different date. Currently it still on pending mode. So my question is. Are they still legal to work even if the documents are on pending mode.
