The same man was almost arrested the very next day! Should have covered tht part of the story too. The cops drove to his house and waited outside, so the man played an NWA song (you know the one) and the triggered cops tried arresting him for it!

I can understand police officers getting sued the first time and being able to claim that they didn’t know that they were committing crimes! But for them to do it a second time, I think criminal charges are more appropriate than lawsuits!

Good point to err is to be human. One repairs the error and not repeats it. Yet, cops do not have any working brain cells in their heads and to expect a cop to not repeat the same mistake - is like expecting a pregnant whale to birth a flea and then nurse said flea .

I always walk my dog with a trailer full of law books, because you never know when and why the police stop you. But is it MY duty to inform the police about my rights, or is it THEIR duty to know them? Why are my rights ONLY valid, if I take time, effort, patience and noble politeness to calmly educate THEM BEFORE they violate my rights? This madness only exists in the US, and nowhere else in the western world.

Your honor, during the interaction the officer stated plainly, in fact INSISTED, that he knows the law yet he acted in violation of it. He cannot now claim that he did not know the law because he's facing penalties. Qualified immunity cannot be applied.

@@Wintercide Many Law Enforcement Agencies assume full responsibility for you once you are under arrest. They foot the bill for your medical care. Also, remember it's rather hard to sue for damages when you do not demand medical attention. It also buys you time to clear your head and get legal representation coming. Bet $ your are ever likely to spend.

The officer commited a crime asking other officer to " step it up" without suspicion of fear. There was no officer safety condition, you don't need to break the law and "step it up" for no crime and endanger citizens.

If you let words get you emotional you have zero business being a cop. I've been a fire fighter for many years. Every now and then we get someone flipping us off or cursing at us. Usually someone with mental issues or thinks we're police because of the uniform. We just laugh and ignore it.

That's not what "clearly established," means. Clearly established means there is a case on point in the same federal circuit (or by SCOTUS) that, for the relevant civil rights violations, is functionally equivalent. The officer doesn't have to know about it, but if a reasonably well trained officer would know about it, then it's clearly established.

They know what they laws are, but at the same time, there are virtually no consequences for police actions. So they just do whatever they want. The more people they violate, the faster they get promoted.

Look at Indiana where the ACLU lost the challenge to a 25 ft rule have journalists be arrested if closer and was decided it is none of medias right to know what is being said during arrests ! I would assume The Constitution has been clearly established some time in the last 200 years. I would also assume a cop with ten or twenty years on the job would know the laws he/she is paid to enforce. I don't know why judges don't agree with these two ideas.

QI isn’t in the constitution, it’s not even a proper law, it’s just a concept from a court ruling, it’s a super-thorny issue that can turn on minute differences in past rulings and the current case. I’d love to see it dumped, or at least limited what it was originally intended, but you have to get state legislatures to pass specific laws to get rid of it. Even then, it probably won’t be as easy as it should be.

When a cop claims he didn’t know the law they will uphold his immunity unless you can prove that you clearly invoked your right and informed the pig of the law. If you have it on camera that you clearly invoked your rights (Salinas v Texas) and informed him of the law, you will eliminate any chance of him getting immunity. But if you get a corrupt judge they will side with the pig so it will be a long process of appealing lower level decisions to get to the right court. They depend on people giving up and not being able to afford the lawyer. Don’t let them win

I don't understand why it is the responsibility of the citizen to educate the police officer as to the law. "Clearly established constitutional rights" means they have already been "clearly established" means just that even if the cop hasn't educated himself or herself. Last I knew "Ignorance of the law is not an excuse"

The law states 'If their conduct clearly violates ESTABLISHED statutory or Constitutional rights. ' I take that as any laws and Constitution that have been clearly established. NOT that the officer had to be properly trained and aware before he she is held accountable. Only that the laws and Constitution has been clearly established. It is their RESPONSIBILITY to ensure cops are properly trained and informed of the laws and Constitution that has been CLEARLY established.

Every time a department is sued for an illegal act against the people, the city should be summarising the case and circulating it around all police departments with a signing sheet attached so that they have to sign it to stop this from happening again. We used to do this where i used to work. Simple rules and regulations lead to complex and intelligent behaviour. Complex rules and regulations lead to tyrants and stupidity

The inventory search before a tow must be conducted for the primary purpose of an inventory. When the search is clearly only for the purpose of finding more evidence against the individual it is STILL a de facto search. What they call it, doesn't change the reality of the situation.
