That trucker was behind the Tesla at one point even when in the left lane. The Tesla would have been visible then if the trucker was paying attention. Trucker is clearly at fault. Was it even legal for the trucker to pass? Some states have stretches of highway that forbid truckers in the left lane.

It looked like the video started in a construction zone and some places will forbid trucks from the rigiht lane in construction zones, so it could have been once the construction zone ended the truck wanted to get over. Either way I've never seen it illegal for a trucker to pass when there's only two lanes. When there are three or more sometimes trucks are forbidden from the left-most lanes. (They go over there routinely, anyway.) The trucker should have confirmed they had cleared the cammer's vehicle first no matter the lane situation.

As a truck driver myself, the clip with Aman's Teslacam footage and the truck, that was 100% on the truck driver. There is no debate on trucks hitting other cars. It is the job of any vehicle to pay attention to the vehicles around them when they change lanes. A truck is no more or less responsible for their actions than any other car, but as a professional driver, they should know how to keep track of the vehicles they cannot see and are responsible for whatever they hit. This does not excuse reckless driving that puts a vehicle in a blind spot of a truck because they were driving too fast, swerving, or any other foolish actions. Every vehicle should have a camera and trucks should have multiple.

The trucker’s side mirrors would have shown that the car was there. My husband, a safety administrator for a trucking company (he’s responsible for viewing these types of videos), has told me that most of these incidents can be avoided if the truckers checked their side mirrors. It is better if the truck has extended mirrors. This truck didn’t have the extended mirrors, but the car was forward enough, and the trucker should have seen the car before changing lanes. Also, the trucker is responsible for making sure that their mirrors are positioned correctly before hitting the road.

The payout depends on how much the car was worth at that moment (cars values depreciate the second you leave the lot). Insurance adjusters go by Kelley Blue Book values and will go over your car with a fine toothed comb to find any and all defects that aren't related to the accident. A few normal wear and tear paint chips, maybe you drove too close to a bush and it lightly scratched the side of the car, but in all reality, the scratches were super light and can be buffed out by hand, etc. They'll take all of that and give you the lowest payout possible. How do I know? It was done to me. The final report said "multiple scratches along passenger side," and that deemed my car as "Fair Condition." That would have been the difference between new and junkyard parts and at least $2K in payout. The body shop fought it and made the adjuster watch an apprentice buff out the scratches.

@jacobcarlson4010 Жыл бұрын
I would strongly advise caution there; doing that could open the door to the trucker claiming an act of aggressive driving or road-rage. In fact, the vast majority of states would classify that type of maneuver as both “failure to yield the right of way” and “improper lane use.” Which combined are usually around $200 in fines. But again, some states will also classify it as aggressive driving/road-rage. Really, Aman did just about everything he could have correctly. His position in the truck’s “blind spot” (because he was likely visible in the truck’s convex hood-mounted mirrors) was not by his doing, and lasted only a few seconds before the trucker started that lane change. It’s not like they were side-by-side for more than a mile, which would have pointed to Aman being somewhat to blame.

But 100% from a defensive driving perspective should one NOT remain where the Tesla driver did. Saying that the driver of the Tesla did not avoid the semi truck the truck driver would be at fault for any damage to other vehicles primarily since the driver of the truck has seen the Tesla. As per usual this could be incorrect or could be correct the law may correct me if I'm incorrect
@Mika-ph6ku Жыл бұрын
Was anyone saying that the cars in the semi blind spots are actually at fault though? That would be a stupid claim. I agree that it is good practice to keep out of a semi's massive blind spots to avoid a collision/being run off the road, but it is still always the responsibility of the merging driver to yield to traffic already in their desired lane. Being in a semi-truck does not change traffic law.

I think one of the problems with cars, and especially EV's, is that the brake lights come on when braking. They need to remake brake lights for vehicles that use engine braking and regenerative braking to show following vehicles that the lead vehicle is slowing down.
@freak3dot Жыл бұрын
It can be a problem with ICE vehicles too. If someone is following at the recommended 2-3 seconds following distance, they do not have to hit the brakes to slow down a little. Of course, a vehicle tailgating another will have to hit the brakes every time. Also, someone might not have to hit the brakes to slow down going up an exit ramp or hill. Always watch the distance between your vehicle and the one in front of you rather than the lights. When the distance closes, you act accordingly. Leave enough distance so that you can see it shrink and have time to react.
@Hunty49 Жыл бұрын
@@freak3dot That's one of the problems with the mix of large vehicles and smaller vehicles. If you have a big 4WD or towing a trailer and you can't see through ahead to further traffic, you are relying on the vehicle directly in front of you to work out the traffic flow, if the traffic is slowing of coming to a stop. Big cause of freeway rear end accidents.
@freak3dot Жыл бұрын
@@Hunty49 That's the other problem with lights. They don't tell you if the vehicle is slowing down a little vs an emergency stop short situation. One has to be ready for both and the only way to do that is an increased following distance.

Its the driver who pulled out was at fault. Its important to ALWAY ALWAYS ALWAYS make sure to stop and pay attention when a car waits for you to pull out in a multi lane to avoid those sorts of accidents. A few months ago a few of us random motorists gave this lady a nod of approval and thumbs up because she pulled out in front of 1 car waiting for her and made sure no other car was approaching. She just smiled at a couple of us and continued her journey. Edit: that trucker is also at fault and potentially pulled an illegal move (depending on state and location) where I live truckers can get some real trouble for using the passing lane at all let alone merging without paying any attention to the driver on the right.

I know that stretch of i81 from Aman's video. The stretch from the Shenandoah valley in Northwestern VA down to Bristol in Southwestern VA is notorious for being one of the most dangerous stretches of highways in the US, specifically because it is too narrow for all the truck traffic and has way too few lanes. I have been hearing about how dangerous that road is my entire life. Things get especially dicey when students move back to Virginia Tech in the fall, or when major events occur in Roanoke. Thankfully, they have been adding truck lanes through the mountains and additional third lanes elsewhere. Interesting fact. i81 was built in an effort to relieve traffic from US 11. Unfortunately, US 11 still gets heavy traffic due to the frequent accidents, when US 11 is fortunately a separate road. Unfortunately, some ignorant planner decided that in one seven mile mountainous stretch, US 11 and i81 should merge. This small area ends up being a huge bottleneck full of wrecks that creates havoc for the rest of the state. Btw, before it was US 11, US 11 began as a private toll road in the 1800s. It became a US 11 after the toll road quickly failed and the state took over. Also, the trucker in the vid could also be extremely tired as Virginia has banned truckers from sleeping at exit ramps for more than two hours. There are simply not enough truck stops along i81. Also, because this is a mountainous stretch the trucker had little control over how they were slowing down in the video. This stretch of highway is notorious for truckers racing past the speed limit on downslopes so they don't slow to 30mph by the top of the next hill or mountain. Unfortunately, they still end up at that slow speed because some mountains on i81, particularly just beyond (south) of where this video takes place.

The Rt. 11 / Rt. 81 corridor goes through some pretty good countryside and passes along to the west of Massanuttan Mountain for many miles -- was once the "Great Wagon Road" which many (pre Revolution) immigrant families followed after coming off of ships near Philadelphia having left from Ireland or Northern Ireland (Ulster- Scot) (Massanuttan is to your left and mostly out of sight further to the left is the Blue Ridge as you go south along the big highway which seems to have become too small for the massive truck traffic that runs it seemingly all day and night Harrisonburg/Bridgewater VA area exits area gets a little crowded or backed up sometimes? Actually far to the north that same corridor passes near Harrisburg PA also. A bit chillier than Harrisonburg VA.

As a truck driver myself, its really difficult to actually be in the truck's blind spot when they have that third hood mirror. Blind spots are probably still there, but they're not as bad as people say they are. The tesla was nowhere near the truck's blind spot, unless his mirrors are completely out of whack.

Trucker is 100% at fault and Aman was driving perfectly. The semi not keeping its speed is the truckers problem just like the blindspot. That is why truckers are always found at fault in such situations. Not seeing is never an argument if you are entering someone else’s lane and do not have priority. There are just too many kids or people who don’t have licenses or are from third world who defend trucks not seing a car, just educate yourself, there is nothing remotely debatable here.
@Bako751 Жыл бұрын
There is no debate. Anyone who thinks it's not the truckers fault really needs to shred their drivers license. Being in a blindspot does NOT make you liable at all. It's the trucker's responsibility to know their blind spots and drive accordingly.

Another collision caused by someone leaving a gap for another car coming out of a parking lot. It amazes me people continue to do this. It's a sure fire way to create an accident because the person coming into the road falsely (and stupidly) thinks the gap means it's clear to come out. By taking that option away from them and not leaving a gap, they have to wait... hence, no accident.
@raymondfranko2894 Жыл бұрын
By not leaving a gap, in many states you are committing a traffic infraction. In this instance, California law specifically states that you must leave the intersection of the side street clear.

if your the one changing lanes and an accident happens. its your fault. (edit to add) he could have Defended his lane, kept his place and let the semi hit him. in this case he can submit the video to the police as he was 'run off the road'. where i am, that is sufficient enough to get the driver of the semi a reckless driving ticket.

So many lane shifts. You have to keep watch on,,, everything around you. I try to judge what the traffic is doing far ahead of me. You have to look past the vehicle in front of you. No wonder what we see here happens. How can we keep track of everything everywhere all a one? Yeah that was a bit of movie title humor but it does apply. Who do I think was in the wrong? The semi.
