9:10 Usama must be blind if he says that cyclist came out of nowhere. He was maybe 1-2 car lengths behind him. He just didn't check his mirrors at all, especially because he definitely wasn't in his blind spot. Also Usama actually should be at fault, I pulled this quote directly from the Illinois Gov website: "Check for bicyclists before turning - Yield to bicyclists and do not underestimate their speed. Watch for oncoming bicycle traffic when turning left. Do not pass and then cut in front of a bicyclist when turning right. Check all mirrors and blind spots for bicyclists. " Along with this: "If a motorist is turning right and a bicyclist is approaching on the right, let the bicyclist go through the intersection first before making a right turn. Remember to always signal when turning.." The insurance company just didn't want to accept responsibility and hoped they could get the cyclist to pay instead.

Correct. I looked up the law and saw the same as you. Right turns do not have the right of way. They must yield to all traffic moving straight through an intersection, no matter if the traffic is behind them, to the right, moving perpendicular, etc.

That looked like a hire bike to me so its possible the rider did actually have some insurance, unless that particular hire company does not provide it. I know in London (UK) most of the bike hires (Santander cycle (Borris Bikes) or Lime) have limited liability insurance that covers you in the event of an incident.

If you were correct the biker wouldn't have been found at fault. He did check his mirrors, that biker was 3 cars away and Usama's eyes were probably looking right for pedestrians, as they should be in the middle of turning right. You only look in your mirror before the turn, not the whole time you're turning. You have to look at the road, duh.

Same with the t bone on the green light. Just because your light is green does not give you the right of way. You have to verify the intersection is clear before proceeding.

For #7, Usama is completely at fault here. Both in Wisconsin, where he came from and Illinois, where he was, you are supposed to yield to vehicles allowed to travel in bike lanes. I have no idea how the insurance found the cyclist at fault here.

@@neumatic This is not a recollection but an outright lie. If he said he had a green light and it was red, maybe, but not stopping at a stop sign and saying you did. If he rolled thru that would be one thing, but he was going fast in rainy conditions. Even if he stopped, he still has to yield the right of way to cars that don't have a stop sign.

I’m surprised the insurance believed the cyclist in Chicago was at fault because the video appears to show him coming down the road in the bike lane the entire time ( he definitely didn’t “come out of nowhere.”) in my opinion, it appears as if the car should’ve waited for the cyclist to clear the bike lane before turning.

Exactly, the cyclist was on a bike lane and you need to make sure it's clear before turning and passing it through (at least in the UE). I find really odd that the car has 0% responsability in this case since the bike was not going 50 km/h or smth here.

Bicycling faces the same risks or even greater than motorcyclist. They can have the law on their side, but most people are too inattentive to warrant the risk of doing either activity. I use a bike on trails and would never consider a motorcycle in the age of drivers using their cell phones constantly. Sucks, but mitigating risk leads to longer life. Breaking limbs assuming you survive leads to long term issues especially as you age. Just not worth it in my opinion. Can't tell you how many dead motorcyclists I passed in the years I have driven. Once had a relative in an ICU and most of the patients were head traumas of now disabled motorcyclist. You could not pay me to ride either on a high traffic road. Imagine if she had been closer and he went over her. I doubt he would have "noticed" as he drove over her.

13:00 That van is not road legal under EPA regulations. Under ' Clean Air Act ' no diesel vehicle is to exhaust black soot. At least $10k in penelty fines or 3yrs prison. Plus their behavior is ' Reckless Endangerment '

9:16 How is the cyclist at fault? Are you not supposed to yield to cyclists if you have to cross their lane to turn? Or is that a right only turn lane, then it would make sense?

That usually if you’re both stopped and waiting for the light at the same time. Here it seems the cyclist was still behind enough to have been considered having the ability to slow down and wait to avoid the collision.

he was totally at fault. Aren't you see the turn signal is already on? Also the cyclist didn't seems to slow down when he is approaching the intersection. If he doesn't have the turn signal on then he would be at fault, but this is another case.

I agree, when changing direction you always have to give way to people already in that lane. It doesn’t matter if that person is behind you, if he has to brake because of you changing lanes or taking a turn, you’re at fault.

@@DaveQZ85 the cyclist looks like he's on a cycling lane, the car is turning and crossing the cycling lane. These are two reasons to yield to the cyclist. The car driver is at fault for not looking into his blind spot.

@@DaveQZ85 this reminds me many illegal cyclists that runs on pedestrian road as well as car road choosing upon their need. It looks they tried to protect themselves in any case. Once you are on car road, at least follow the law. You need to stop at traffic light and stop sign, instead of passing.

That's the American system - whatever you can get away with, so that your premiums don't go up. In California, I was once rear-ended by a driver from Singapore(?). He instantly admitted fault. But a different (American) driver lied about his own involvement in the same crash.

On the accident with the cyclist: in the Netherlands the law would be completely the other way around. To me this is the car driver's fault for not yielding to a more vulnerable user of the road. Then again, NL is on of the most bike-friendly countries in the world

Yes, in the Netherlands a collision between a car and a bike is always by default 100% the car's fault. Only in extreme cases where a cyclist is hitting a parked car it is still the car's fault until both the driver and the biker sign forms stating that it was actually the bikers fault. And only after both sides filled those forms it can be different but unless the biker himself agrees it was his fault it is always the cars fault.

The law here actually puts the car driver at fault in this accident, as the cyclist was going straight in their (bike) lane while the car was turning across the bike lane. Some states require drivers to merge into bike lanes before turning, but few drivers actually do. Other states don’t allow merging into bike lanes at all. In general US bike infrastructure is extremely dangerous for cyclists. We could learn a hell of a lot from you guys. In particular, Dutch intersection design would make it much easier for the driver to see the cyclist in this scenario.

I completely agree the vehicle driver was at fault here in the US as well. Usama (the vehicle driver) should have first turned right (with blinker on) in the conflict zone before the bicyclist was even close by and the accident would have been avoided; or he should have properly waited. This is a very common accident between vehicles and bicyclists and is know as a “right-hook.” Wham Baam Teslacam should either correct this video or take it out because clearly the vehicle/ Tesla driver was at fault here.

As an European, I'm a bit curious about clip #7 - I think everywhere in Europe, the bicyclist would always have the right of way in this situation, as the car would be blocking off the bikelane. Does cars have the right of way everywhere in the US in similar situations or is that exclusive to some states? It's good to know if I ever decide to ride a bicycle in the US, as I would've done the same as the cyclist in the clip, completely expecting to have the right of way.

American laws are different - but as horrible as American bike laws are and as awful as general bike acceptance is in traffic - even here, that stunt is completely illegal, and Illinois statute law specifically prohibits that kind of "right hook" maneuver. But all his claims are doubtful - he had his turn signal on - a turn signal that the very shiny Mercedes in front of him never shows the reflection of. The bike came out of nowhere - but that's not what the video shows at all. Given how dubious his other claim are - I doubt the claim about the cyclist being found at fault.

In the first clip why would the police even consider taking the other driver's 'side'? Basic observation would show that the truck *CLEARLY* ran their stop sign simply due to the damage. Truck with the front end crushed and another car with the side caved in makes it pretty cut and dry. If he'd stopped the damage would have been dramatically different and considerably less.

White Tesla driver here. They knew he didn't stop. I mentioned to one of the first responders that he claimed he stopped and they just laughed. One of them said: "Yeah, right. He stopped and accelerated to 30mph in 20 feet in a pickup truck? Yeah, no." They said on their experience he had to have hit me going 30mph.

It looks like the cyclist was in a cycle lane so Usama was crossing a cycle lane, its his job to make sure that its clear before crossing it id say.

The person on the bike was not pedaling (using it as a bike). Since it is also a motorized bike, he was using a motorized vehicle (i.e. motorcycle) and should have been behind the car. If he was pedaling he would have been able to stop easily and avoided the accident.

Court case, who's lying? The best part, Tesla has all the cameras and data to 100% resolve the liability issue. Insures will absolutely love this clear cut resolution! Tesla IMO will be the best car to insure for this reason alone. If it's the Tesla fault you still pay,... but only when you rightfully owe

I know in The USA bikes might have a different role than here in Germany and I’m not sure if he’s going on a bicycle lane or not but to be honest if turn you have to check your mirrors properly just because your turning signal is on doesn’t mean you have the right old way! In Germany this would have been 100% the fault of the car… 9:23

Some people would argue that with the signal on and the distance before turning, the bike could have slowed down, does it make it right? No, but both people would have been better off if the collision was avoided.

Clip 7 / 9:13 I don't understand how the cyclist is at fault. It's the Tesla driver's job to check his mirrors to make sure everything is clear before changing lanes or turning onto a different street. A blinker doesn't give you the ride of way. You have to make sure it's clear before going.

I totally agree on that one. I would say Usama is 100% at fault, and that the insurance company made a huge error. At least where I live, Sweden, Europe, you are not allowed to turn without giving way to traffic crossing your way. The green light is for going straight, and as I see it, the cyclist has the rightmost lane, and should be given right of way. (This is unless the intersection is designed with protected right and/or protected left turns, which means green arrows right and/or left, in which case there is no crossing traffic.)

Some potential context into the second clip. When John slowed down to yield to the dump truck, it was probably enough to activate the brake lights, leading the trucker to think he'd just been brake checked (to say nothing of the fact that he slowed down in the left lane while being tailgated). Doesn't excuse the response, but it probably explains it.

@@e-curb It depends on how quickly the car is decellerating. Tesla does a good job of determining when to invoke the brake lights and when it shouldn't. The Tesla car on the screen UI will also mimic the brake lights when they do come on.

@@david-iam Thx, I did not know that. My mother had a Chev Volt. When driving that, if you are good at observing traffic ahead, you almost never need to touch the brake pedal. The regen braking slows you very effectively. I was wondering if the brake lights came on when you hit the regen braking switch, and never did find out the answer.

9:14 , Cyclist is not at fault, you are suppose to yield to cyclists if you have to cross their lane to turn. The Tesla has failed to turn on their right turn signal, which in this case they didn't do, no images/reflections are visible of any "right turn signals blinking" on the rear end (rear bumper/rear trunk lid) of the car that is in front of the Telsa. starting @9:14 - 9:18 .

Tesla is 100% at fault here. If you’re making a right turn you have to make sure it’s safe before you can proceed. Also, insurance companies usually waive your deductible if you’re not found at fault.

It doesn't matter. You are completely correct. A turn signal is not a free pass to do something illegal - and according to Illinois statute law, this type of "right hook" stunt is completely illegal. Of course - he does have a magic turn signal - the kind that is never reflected in the very shiny Mercedes in front of him. I bet if we had the previous ten seconds of video we would have seen the Tesla passing the cyclist that "came out of nowhere".

I drive for a living and have for nearly 30 years, from big trucks to little cars. I will never understand why some drivers can't seem to handle things like someone tailgating them or someone merging in front of them without creating a situation that could be life threatening. It's almost like people are stupid.

You're not wrong. Illinois statute law specifically prohibits this kind of "right hook" maneuver. All Usama's claims are suspect - he had his turn signal on - but the very shiny Mercedes in front of him shows his front lights - but apparently has special Mercedes wax that blocks turn signals. The bike came from nowhere - but that's the opposite of what the video shows. Given how sketchy his first two claims are, I kind of doubt the third claim - that the cyclist was found at fault. If we had the previous ten seconds of video, I bet it would show the Tesla passing the cyclist just before illegally cutting him off.

@@47f0 It's extremely hard for a cyclist to "come out of nowhere". As the much, much slower moving vehicle it's almost impossible to over take a car supposing the cyclist from a side street.

The bike one has always confused me. Does the bike lane count as a lane ? Like if you’re turning and cross over the bike lane beside you in the process. Is it not your responsibility to check first for bikes coming up beside you ?

You are completely correct. Generally, anytime your vehicle crosses or merges into a lane, you are responsible for ensuring the lane is clear. Illinois law goes a step further, clarifying that this type of "right hook" is specifically illegal for bike lanes. ALL this guy's claims are dodgy - the video he submitted claims he had his turn signal on (doesn't matter - turn signals don't void all other laws) but the very shiny Mercedes in front of him shows his front lights - and doesn't show a turn signal. Must be a special kind of Tesla turn signal blocking Mercedes wax. He also claims the bike came out of nowhere - precisely what the video doesn't show. The video shows the cyclist legally riding in the bike lane. I bet if we had the previous ten seconds of video, we'd see the Tesla passing the cyclist before illegally cutting him off. He also claims the cyclist was found to be at faults - given his first two dodgy claims, and Illinois statute law, that's just one more thing I have trouble buying.

Re: Episode 7 (the cyclist) I am no lawyer, but I think in Denmark the car driver would have been responsible since he was the one changing lane/direction, regardless of how many green or orange turn lights was active. Or maybe this was a dedicated right-turn green?

There was no dedicated right turn arrow. Driver was in the wrong in US states too. They should have yielded to traffic moving straight.

The cyclist didn't "come out of nowhere" ...the driver of the Tesla must have previously passed them so should have been aware of the cyclist when making the right turn. I see the driver of the Tesla at fault.

Usama is totally at fault here, He was ahead of the cyclist but apparently did not cover (block) the bike lane when he made his right hand turn. This allowed the cyclist to catch up to him when he was making the turn. Turning traffic has to yield to traffic going straight. In my town there was an accident in which Usama's role was a semi tractor and long trailer. Yes the cyclist was crushed to death by the rear wheels of the trailer. The bike is one of those rental bike and I'm sure they have insurance. This is a very preventable accident on Usama's part.

I think it's because the bicycle lane ended before the crossing, so the cyclist had to behave like a car - they can't overtake on the right and had to wait for the car to turn. The pedestrian's light was also flashing, meaning you can't start crossing..

@@MrPomo2 in some states (eg CA) drivers are required to merge into the bike lane to block it before turning right. In others (eg OR) they’re not allowed to do that. I don’t know Illinois law on this. Either way turning cars are required to yield to traffic in the bike lane, as you pointed out.

In Australia, when making a turn which goes over a bike lane, you are required to head check and give way to the bike. So, it's the reverse of what happened in your video. We have well marked green bike lanes, and cars are required to give way to any bike traffic on them. It's annoying as hell, especially on this one road where 50+ bikes all love to ride, and the traffic is all taking a left turn at a roundabout. (we drive on the left, so think of it as a right turn similar to the one in the video)

Make sure "Data Sharing" is turned on. I believe it's in the Safety menu? Not sure though. But that's all I had turned on to get the video.. Tesla also supplied a ton of other data, including a really nice incident report with a bunch of charts (things like accelerator position, manual brake position, master cylinder position, areas of impact and airbag status. It's pretty amazing.

That first Story (ADAM) Unbelieve the lengths people will go to get out of a being at fault. How in the world would anyone believe the guy in the truck. The speed and power in which he hit the Tesla. You cannot stop at a stop sign and hit something that hard from a dead stop.

#8, the cyclist: The dashed lines separating the bike lane from normal lanes at a light are there for a reason. The way the law reads in CA you are *required* to take that space before making a turn specifically to prevent this. Also...."they came out of no where" is the laziest excuse possible and I hate how often people use it. It wasn't a wizard materializing himself, it was a guy on a bike. You just didn't look.

I don't see that Illinois statute law has the same "occupy the lane" notion - but it does specifically prohibit this type of "right hook" maneuver. And I wish I could remember the state - not one I'd expect, maybe Tennessee or Kentucky, but "I didn't see him/her" is no longer a "get out of jail free" card - it's an admission of guilt.

That right lane, whether it's a bus or bike lane, is considered a straight-through lane, and before merging into or crossing another lane of traffic, the driver is responsible for ensuring those lanes are clear.

@@btfoaccounting2902 There's a lot we are missing from the clip, like what the traffic was like on the right lane next to and ahead of the Tesla, but the narration does say he was intending to change lanes when the driver realized the other car was coming way too fast to actually do it. No matter how wrong it might be anyway, trying to pass that way on icy road is gonna result exactly in what happened, and you might even win the insurance battle, but is it really worth risking your well being and that of everyone around you just because you are right?

Usama, in Denmark, as a motorist, you have a duty to give way to cyclists. Violation of the right of way for cyclists results in a fine of $290 and conditional suspension of the driver's license.

9:18 clearly shows how far back the cyclist was. There is no requirement to make sure the bike lane is completely clear. Where does that end? What if someone is half a mile away? You have to wait for them to catch up and pass first? Your argument makes no sense. The driver signaled, there was no cyclist in his blind spot area, so he turned. Cyclist has to yield

@@kuruptzZz not sure what your highway code says but all traffic moving forward, especially vulnerable traffic such as pedestrians and cyclists have right of way in the UK, I'm assuming it's the same in other European countries too. From what I've read in comments it's the same in America but could be wrong. In this case the car should have yielded. The cyclist wasn't many car lengths back when the driver started the turn, having a turn signal on doesn't instantly mean they can turn without checking for incoming obstacles. you should only ever perform the manoeuvre when it's safe to do so. Not without properly checking your mirrors. He would have failed a driving test I gaurentee this.

When it comes down to policing in Redmond Washington…Don’t hold your breath. I called 911 as we got onto I-90 from I-5 I followed (safely behind) a severely impaired driver from downtown Seattle east on interstate 90 for almost 30 minutes before they got off the exit to stop at another Bar. They parked and went in….(Presumably)had another Drink while I was waiting outside in the parking lot for police. I literally gave them 30 minutes heads start and the Redmond police still couldn’t show up until the severely intoxicated driver was able to drive away freely with zero idea of what was transpiring around them.🤷‍♂️🤦‍♂️

Some are allowed on the sidewalks, some require led lights on front and or on the back, some require helmets. and if the state allows you to be on the sidewalk some cities in that state have their own city laws that says you can't have a bicycle on the sidewalk. It's very confusing. Not to mention some states say bikes can have the full lane and some states say you only have to be 3 feet away when you're passing them. Its very confusing

I think it is that way in most civilised countries (which would exclude the USA). In general, every time you change direction/lane, or go from one type of surface to another (e.g. crossing a section of cobble stone, sidewalk, bicyclist road, the vehicle crossing has to unconditionally give way to other traffic.

U.S. is pretty barbaric compared to much of Europe when it comes to cycling, but.. No - Tesla was 100% wrong here, and Illinois statute law specifically prohibits exactly this kind of "right-hook" situation. The video is pretty fishy. The Tesla guy lied about a couple of things - the cyclist absolutely did not "come out of nowhere" as the Tesla cam clearly shows. He claims he had his turn signal on - (doesn't clear him of a violation, but) - his turn signal is the kind that is magically not reflected in the very shiny Mercedes in front of him. This whole clip makes several very dubious claims. Enough so that I doubt that any finding of guilt actually fell on the cyclist.

My thoughts exactly. Other comments here say the cyclist is supposed to stop at the intersection too and to yield to the telsa with the active turn signal. But that's not how it is in Oklahoma. Can't speak for other states. As for coming out of nowhere... No he was clearly visible in the repeater cam and therefore probably in the mirror.

Third - The mysterious inter-dimensional bike from nowhere - which in the side camera, appears to be a cyclist properly riding in a lane where you might reasonably expect to find cyclists. Sort of like finding a bus from nowhere in a bus lane. Given his other sketchy statements - I doubt the cyclist was found at fault, anyway.

Usama who hit the bicycle with his blinker on turning right, shame on Tesla. On my 2021 Kia, at a stop sign with my right blinker on, when a bicycle came up on my right, the Kia sounded an alarm that it was unsafe to turn. My nephew, who has a model 3, said Teslas should do that, but do not.

It's true. Vegas drivers run red lights all the time. All the time. In fact, car insurance in Las Vegas is more expensive than in Los Angeles. My agent told me it is because there are more accidents and also because of how expensive it is to get a car repaired properly.

Ok, I haven't seen anyone else bring this up in all of the Teslacam videos I have watched, but it is the elephant in the room. WHY are Tesla cams so crappy? The contrast, color (and sometimes resolution) is far worse than even a cheap dashcam. It is like looking though Vaseline and cataracts combined. If I had to pay the premium price for an EV (and I will concede that Tesla's are about the best, if not THE best, of current EVs out now) I fully expect the built in cams to be of much better quality than these currently are. And we KNOW that quality imagers (the heart of all electronic cams) are very inexpensive now. C'mon Elon, you can make reusable space vehicles but a decent quality camera isn't in your flagship product line? Edited to add: I do love this channel, and the concept of the Tesla cams is great, just fix the damn image quality!

I often wonder this myself. I think it may also be partly due to original resolution is much higher but when uploaded or saved it decreases in resolution and or gains artifacts from any conversions or uploading processes. Plus then you have the channel creator may also need to change resolution to match his video base standard before editing and merging all of this content into one video and uploading to KZbin.

I dont want a Tesla car (maybe a truck, if they'd ever do a compact ev truck) but respect for the quality and level of recording they can provide! It will reduce the insurance claims for sure! Well before I had a dash cam (and why I later got one) this lady ran a red light and smashed the front fender of my car, pushing the front suspension in. And then tried to run, I was able to drive with three good wheels in my Subaru and caught up to her in half a block- her car was starting to fall apart, so she accepted defeat. She said, "OMG, I was just trying to beat the yellow and you went early!" Well, she 100% failed that one... and I had a green for a bit, because the coworker behind me saw the whole thing, but also she would have t-boned me if I didn't come to a complete and kept going! When the cop got there, he said, "She claims you jumped the green light AND didn't make sure the intersection was clear. I mean, the guy behind you said the same as you, that the female ran the red, but since you both work together... well, you see what position im in. I think you didn't make sure the intersection was clear when you entered." I nearly laughed at him. I had NO damage on the front of my car, I had the green light and she steered straight into me. I got a call from her insurance company like a week later, they offered a 50/50 fault split. I said NO WAY should a person running a red light (one which was long red) be only kinda at fault, especially when she was trying to flee! I said, she might have been drinking and didn't want to deal with the police either and I have a witness! So I informed my insurance company they were looking to pin half on me and what I told them. Her insurance paid out, but only 6 months later. it would have been so much clearer with a dash cam. Fast forward 15 years and a distracted driver ran into my side on a roundabout (didn't see me already on the roudnabout) and because I'm an immigrant American in Ireland, he blamed me and the police officer said, "with what the other guy said and without the footage, it would be likely a 50/50 fault, but your dash cam makes is very clear he wasn't looking or signalling... I love it!" He rang me a couple months later to ask what model it was and what my configuration was. He wanted it to upgrade his cruiser! haha

Number 8 with the peugeot is interesting, and illustrates exactly why I prefer the way the traffic lights are setup here in Europe, even if they are harder to see when you are in the first spot of the waiting queue. Over here traffic lights function as a 'gate', situated at the end (or start - depending how you look at it) of the lane they are intended for. You pass under or next to them as you enter the cross section. So there is no doubt what so ever for which lane they are intended.

I'm not a convert of Teslas but the footage obtained by the cameras used for auto pilot are definitely worth it

I'm 65. I had to take a test to qualify for a driver discount. I support Senior Driver Safety Exams. Elderly (65 and older) cause 19% of all fatal crashes in America. That's HUGE!!!

Yeah I'm from europe, the netherlands actually(we have more bikes per person here) and i was thinking it was strange the cyclist is at fault or that he "came out of nowhere". Here, and generally europe it's taught when turning to check your inside mirror, outside mirror, and blind spot before turning even before putting your indicator on and then once again when you're about to turn, just to be safe.

America actually has more bikes than people. Oh wait a second - I meant guns. However - as barbaric as America is, especially when considering bike laws and bike acceptance in general, Illinois statute law specifically prohibits this kind of "right hook" violation. The whole video is sketchy - he claims his turn indicator was on (doesn't matter - a turn signal is not a free pass to do anything illegal), but the very shiny Mercedes in front of him only shows his running lights - no trace of a turn signal. His claim about the cyclist coming out of nowhere is definitely doubtful - if we had the previous ten seconds of video, we would have seen the Tesla passing the cyclist, legally riding in his lane. Given how weak his first two claims are - I doubt the cyclist was found at fault.

12:45 I think the van was at fault. Its not good to let impatience get you to preform dangerous act but the situation would have been much safer if the van didn’t react in such a way.

@9:05 I did that not long ago. Luckily the guy who had the green was making a left so I immediately just made a right turn. Craziest thing and happened so fast. I knew what I had done I was just so surprised I caught on so late! Nerve-wracking moment for sure. I'm just happy no one got hurt. 🙏🏿

If I were a cop I wouldn't even need the video. Common sense tells you that the Tesla driver has no stop sign and the truck driver did because he even said he stopped, thus confirming the direction of travel of the truck. Not sure how the truck driver would argue that the Tesla somehow slide sideways, defying the law of physics, and hit the trucks on the front with his side door.
