Mr Gai Eaton was my gate to Islam. Many years ago when I got his two books, "King of the Castle" and "Islam and the Destiny of Man" I thought if I ever converted it would be Islam. How deeply impressed I was by the author and his books, I cannot overemphasize. Later, the works of many greatest Muslim scholars and theologians from the classical era were just as helpful for my eventual embracing of Islam. But I will always remember the role Mr Gai Eaton played in my life.

@@theseeker-yv6fi The following luminaries are my favorites: Al Ghazali (any work by him is precious), Ibn ata illah al Iskandari (al Hikam is a stellar piece), Ibn Arabi (any work is superb) , and Ibn Qayyim al Jawziyya, my special love. My dear, once you have digested these great minds, after 10 years or so, you can move further to Sufi mystics, or great Persian Sufi poets like Hafiz, Saadi or Rumi, and others whom you will encounter along the way. Good luck on your journey through the works of the greatest minds the world has ever known!

@@theseeker-yv6fi You are most welcome! Have you noticed in my very first comment that I mentioned that I was investigating Islam through the works of scholars from the classical era? In my next comment I gave you the 4 names of the scholars from that time. [9th-13th century]. How did I find their works? well either online or in the bookstores. As for contemporary authors that you now ask me about, sorry, but except for Gai Eaton I do not consult others, I stick to the classical Islamic scholars and theologians.

try reading Sahih Bukhari, Sahih Muslim, Sunan An-Nasa'i, Sunan Abu Dawood, Sunan At-Tirmidzi, Sunan Ibnu Majah. all of those are the title of the books that compiled recorded ahadith. all the hadith mentioned by Gai Eaton are recorded in those books. and i believe Mr. Eaton had also finished reading all those books. lest he won't know what to quote.

Take adultery for example. The punishment might be the most severe in islamic law, death by stoning. Only an islamic state under an islamic court carries the punishment. A verdict is virtually impossible and is mainly there as a deterrence and to prevent people from being outspoken, careless about adultery and to prevent the normalization of adultery or it becoming rampant. There are four ways to get there. The first is four eye witnesses should give an exact account of the incident. They should see the explicit act of intercourse. If they come forward for testimony and one gives a different statement or three only appear for testimony or one didn't see the explicit act of "penetration" or doubt himself, the eyewitnesses get flagged instead for slander. At the time of the prophet he ordered stoning twice. Non where with eyewitnesses but the adulterers confessed. This is the second way to get punished for adultery. But people are discouraged to confess and actually encouraged to deny accusations in islamic court. Police or court have no bussiness interigating a person due to sheer suspicion of adultery. So the first time a person approached the prophet and told him he committed adultery, the prophet (peace and blessings of Allah be upon him) kept pushing him away, "maybe you [are overreacting] and you just touched. The man confesses full intercourse. The prophet says, "maybe you [are overreacting] and you just kissed. It was not until the guy confesses three times that the punishment carries. The other incident is the third way for court to give a verdict. It's when a woman with no husband gets pregnant- a different color baby gives no ground and is bad for husband to doubt wife. So a pregnant woman approaches the prophet. He again pushes her away. Then when she insists he gives her time to deliver the baby. Then she comes back and he asks her to go and breastfeed the baby for two years, as to ask her to change her mind and not come back. She comes the third time and the baby is walking. Then she gets punished. The fourth and final route for a guilty verdict is person who catch their spouse in the act. They are enough of a witness- no need for three more- but the defendant can push away the punishment from themselves by simply taking four solemn oaths that they are basically not guilty.

I used to be against these "harsh" punishments too until I started seeing how society is falling into degeneracy and corruption without them. Nowadays I feel like they should be even harsher 😅 Imagine if some sleazy politician who's robbing millions off of us all right now was punished properly, would anyone else dare steal again?

You should know that all the mercy you got from that story is from (allah swt) and what he gave his prophet is nothing to remember compare to his swt,, if you truly fallow the prophet and admire his mercy,, you should love god more the maker of that mercy,, the originator of all mercy,, the most loving the most merciful.

One aspect that people completely overlook is the nature of the Hudud/Penal codes. It's a High Evidence Bar - High penalty system so obviously those "harsh" punishments have extremely high bar of requirement, unlike the low bar - low penalty system in the Secular laws which allows people to accuse anyone without proper evidence.

yup, we learnt this in religious studies (which also covered sociology and philosophy at the time). One of the main parts of keeping people civilized was method of detterance. Though people can dislike it, it most definitely stops people from doing things. Deterring people from crimes by instituting harsh punishments like corporal punishment or lengthy prison times. If the punishment for murder was changed to 2 years in prison today, murder would double by sundown

Longer, harsher sentences don't actually tend to deter - it's a lot more effective to increase apprehension of getting caught, by making crimes harder to get away with, than actually punishing them harsher

There are 6,236 verses in the holy Quran, and only 236 verses are about Sharia Law. However, out 236 verses only 9 verses are hudud (punishment) the other 227 verses are about other forms of Sharia such as Mu'amalat ( Dealings) and Akhlaaq and other forms of laws. What most people don't realize is that Tazir is the most common penalty. It's rare to apply Hudud due to the strict standards.

It's basic human psychology. You'll run faster if you're being chased by a dog rather than just to reach the finish line as a motivation. It's the same as hudud law. People will be motivated more to not be involved in any crime if they know the punishments are as harsh as beheading or amputation.

hi paul, great video as per usual! just a quick recommendation: im guessing youre not using an actual DSLR to shoot video, the video quality looks great, i think itd look way better and more natural if you were to turn cinematic mode/ portrait video off as the subject separation messes up frequently and can sometimes be distracting

Just a quick note! Vigilantism is *NOT* part of Islam. We cannot take the law into our own hands. This is against Sharia. However, under an Islamic state, there are severe punishments. For example: It was narrated from Ibn`Abbas that the Messenger of Allah (ﷺ) said: _“Whoever you find doing the action of the people of Lut, kill the one who does it, and the one to whom it is done.”_ Source: _Sunan Ibn Majah 2561_ | Grade: _Hasan_ There are 2 extremes. The first extreme is to focus heavily on Hudud punishments by taking the law into your own hands and the second extreme is to completely ignore these laws, as if they don't exist in Islam. As Muslims, we need to strike a balance here. We acknowledge that there are Hudud punishments in Islam but they can only be carried out by an Islamic state (Khilafa). May Allah (عزَّوجل) keep us firm on His religion. Ameen!

It would be great to have a public discussion where you and I show the actual Muslim legal texts, reading the laws to the public. We can show the doctrine in detail from the major works available to us, with your commentary as we go through the various laws that disturb Westerners. This way we have it direct from the legal sources, rather than second hand. This should set everyone's mind at ease, since they will have the facts. The laws of apostasy, the hudud punishments and amputation, commanding the right, marriage and infants, jihad and others that cause concern could be shown in detail to set everyone's mind at ease.

Ma'aiz was sentenced to be stoned for adultery. When the companions started stoning him, he tried to escape but they caught him and finished stoning him. When the companions told the prophet that Ma'aiz tried to escape, the Prophet replied: "Why didn't you let him go?" Narrated by Ahmad. It's classified as authentic. It is worth mentioning that capital punishment in Islam can't be enforced if the victim doesn't press charges. So we have to remember that capital punishment is set for the victim's benefits and legal rights, not the Shariah.

Well spoken. When those who interpret Sariah are kind hearted it's implementation will be equally kind. For me the elephant in the room is about interpretation. What I'm going to say next is with the utmost respect to Islam and to Mahsa Amini, who died in Iran recently at the hands of the morality police. This is scary for many people... We all need of Allah's guidance, especially when imparting justice. My condolences to her family and friends. Also to those killed and injured during the protests for such incident. 👍🏽😘

@@mukricraig1914 Look they were all Arabs mostly and already have good Muslim names like Abu Bakar Omar UTHMAN ali Muaz Abdullah etc.Please guys remember Islam comes from Saudi Prophet Mohammad..or Ahmad as in Quran etc.Yes need to change name at least first name to be known as Muslim and even born Muslim who gave bad names need to change to good meaning Muslim names not kufr names..

I appreciate your concern but the scholars of Islam have dealt with this issue 1,500 years ago and you and I don't have more concern for the religion of Allah than Rasool Allah sallahu alayhi wassallam and the Sahabah.

Read the hadith about Ma'iz ibn Malik where he asked to be stoned. You will see that the Messenger of Allah has asked him many times to avoid stoning. The Messenger of Allah said to him, "Perhaps you only kiss her, or just touch her, or just see her naked?" But Ma'iz still insisted that he sleep with the woman. The Messenger of Allah even asked another companions if he (Ma'iz) had a mental disorder or was drunk. All because he wanted to avoid stoning, but Ma'iz himself forced him.

These punishments are not meant for the purpose of tormenting an individual physically and mentally, it does but that's not the aim. If one would consider the extensive list of requirements for the establishment of such punishments, it would become fairly obvious to understand how hard and nearly impossible of a task to accomplish. These requirements would be easier to gather only when society loses the virtues of shame, taqwa and replaces them with degeneracy and moral decadence. It is only when society becomes morally compromised that these punishments can be easily carried out by the jurisdiction.

Whenever we talked about Syariah law, my non-Muslim friend always said that cutting a hand of a thief would be cruel so I asked him whether he was thinking of stealing. This is the essence of Syariah. It is more for prevention. It is not there to punish people unless they are crazy enough to do it. The law also allow for mercy as mentioned in the video. If a person steals because of his needs or he is underaged etc. , he would not be punished. I am sure a lot of people would be happy to see the criminals, who rob homes and hijacked cars for fun or money, have their hands chopped off.

one of my favorite reference is that of salauddin al ayubi. many of his haters often point that the ppl of jerusalem were taken as slaves based on the laws of war captives when the actuality of the matter was that they were allowed freedom for a payment separate for the rich and poor and the poor who couldnt pay for it were let go of anyways

Mashallah Paul you are doing a great job. In Islam the conditions for punishment for adultery are very strict. Like to implement adultery hadud on someone who is alleged for adultery there must be four witnesses. In all others hadud only two witnesses are needed but for adultery four witnesses are a must. One should think about the logic behind this. Allah pardon me if I am wrong and show me the right path but I read somewhere that this is because adultery is not that good that someone will do it in front of four witnesses or people. So those who are doing adultery in secret then Allah is enough for them to punish them for that sin in life after death. And anyone who did adultery in secret and asked Allah for forgiveness then Allah will forgive him. The harsh punishment for adultery is basically to stop adultery openly or undisguised and save relationships in community and stop some bad intention people from spoiling people's dignity or honour.

The principle and not the mechanism itself is at the core of the revealed laws. Unfortunately a large number of people cannot distinguish between the Substance vs the Surface. This has triggered several unnecessary complications throughout our history. First, the problem of so called abrogation. There are conflicts only at surface level, not at normative level. Basically there are no abrogations. Second, the problem of anachronism. Verses commanding freeing of slaves as atonement or urging to keep horses ready for battle are totally anachronistic today if we continue to ignore the substance. Third, the qyias or analogy should be with the principle or substance, not with the form or surface mechanism. This was not explicitly mentioned by most scholars of the past. Fourth, some people mistakenly started to think that theocracy could be establshed just by literally implementing the commandments. No, theocracy is not possible to implement unless God starts to send verses directly to us again today. The Caliphate was NOT a theocratic rule. The Caliphs had used their God given intellect to apply the moral principles underlying the commandments. Fifth, failure to distinguish between the substance from the surface leads to incompleteness of the Quran. God has explicitly mentioned that He has not left out anything out of the book. If we only think of the surface or mechanism, then where are the laws for every and all possible scenarios? Where are the laws about foreign policy, international trade, and myriad other contemporary situations? Sixth and finally, the emergence of ISS and similar groups are the direct result of the failure to distinguish between substance vs. form. May Allah reward Paul to bring this important matter to our notice.

A purnishment for adultry is indeed a repentance. When some of the Prophet's companions derided the conduct of a woman who was stoned to death for adultry, The prophet said to them; "Leave her alone, for indeed she repented, such a repentance that if it were subdivided for the inhabitants of Madina, it would have been enough for them".

Regarding the punishments. For sure it does sound good to justify a harsher punishment than some of the laws we have now. However, shariah is touted here as being merciful so my question is. Countries like Saudi Arabia and a few others that I still stonings and cutting off hands etc. is this justified under shariah or, is it more of a dictator level that the punishment is applied and carried out?
