Everything is stacked in favour of the woman - the more corrupt she is the more money she can extort. India has the most useless blood sucking court system where the judges consider it a 9 to 5 job and they do as they please. If the judge had done his job I wouldn’t have lost access to my kid and lost everything financially. But I wasn’t important enough for the judge to waste his time in doing his job. Prenup agreements do not have any force in India as no two parties can get into a contract to give/take away any rights granted to them by a law. More particularly, nobody can take or sign away the right to initiate a suit in a court of law for obtaining remedy against a wrongdoing. I hope this answers your question. But prenups are considered invalid because of the lack of precedence of such things in our law. Also it is very difficult to navigate a divorce case as a man. The best advice is to know someone very well, before marrying them, because your marriage is a contract you are breaking in a divorce. Parliament of India is more at fault for keeping such one sided laws despite multiple requests from supreme court to amend the 498a and even calling it legal terrorism. This shows that Parliament alone is not acting for the welfare of people of India and not sure why they are there for and what are they doing in the first place ? We can not bring Congress because Congress was the one to bring such laws under Sonia Gandhi, a foreign person who lacks Indian Tradition and value system. BJP is the only hope to make some changes however they are also going after votes instead of doing the right thing. They are afraid to make the law more balanced in the fear of losing women voters and women NGOs making it an issue. People in powerful places like MP and MLA never go to jail for such crimes because IO knows that they will be out soon and it is not good for them to send them to jail for couple of weeks. so these laws may be same for everyone on book but very different on ground. Police will never dare to arrest a MP/MLA for anything matrimonial however they will always try to arrest innocent middle class men in order to extract money from both the parties involved.
