I was on a medical leave I was forced to take. I had a note from my doctor saying I was capable to work and my job denied it. They never fired me but when I came back put me back on as a "new hire". I lost my pto, my benifits, and my 6 months before that leave no longer count towards 1 year of work for a raise. At no point on file was I ever let go or terminated in any way. Did they break the law?

I’m thinking so because it’s sounds like a kind of demotion. I hope you sought help. I just returned early from LOA, with a doctors fit for duty. My manager said I’m not on the schedule for the next 7 weeks because that’s the original date set for the 12 weeks and she made the schedule already and she “can’t” change it. Lol what bs! I didn’t argue with her. I’m going to seek help and possibly file for unemployment, unless advised not to.

What if you were wrote up for taken a FMLA while my mother was terminally ill, they told me I was suppose to call in every single day while I was off for those two weeks and the kept calling me while I was off with my mother?

I work for the VA and I have a FMLA for my father. I was told by my supervisor that I won’t get promoted because of my FMLA.

Oh yes they call me in when I came back to work 3 times giving me formal letters harassing me stressing me out to the point where I felt like I was about to have a stroke or a heart attack and EMT had to come get me off the job they said I was close to having a stroke blood pressure was 148/121

I'm in court now for my fmla/ADA for my mother, finger surgery & Covid-19 long hauler each time they made it very difficult. It has been very stressful

So if I was threaten with continue use of my FMLA, and then retaliated against the next week after would I have a case?

Not a lawyer, but its not a threat. It is your right under law. I wouldn't use that term or maybe they would call you hostile.

I need to run 6 trips before taking my daus off... i used fmla 2 days last week and my employer stated that my fmla was not allowed. So I was not allowed to take my time off this week. I have worked 10 straight shifts besides the fmla days. Is this allowed? Do they have to have my fmla paperwork to consider it valid?
