My unsolicited advice: Don’t talk to property managers EVER. Everything discussed, do it via email. You will never regret it. Refuse to answer phone calls, everything goes through text or email messages. I do this with any property management and recently won $13k in a lawsuit with them and it was easy because I had everything in writing.

I used to watch you all the time and you were happy working from the basement. I was upset when you opened the bin store and knew it would be hard. Dealing with all those people, employees, landlords etc. Don’t let them take your sparkle away from you. It is NEVER a failure in anything we do and you can always take a step back. $3 day, sounds like a bargain.. a $3 shop.. sounds like junk. Take stock of what sells via walk ins, and if rent is covered by that. Consider: if the $3 items are just not selling online, but are selling in the shop.. BUT at the end of the day is not paying the rent, its sending you backwards, it'd be cheaper to not rent, and throw those items in the bin.

So sorry to hear all this!! This landlord may have deep pockets, but it sounds to me that this will change in the near future! With all of the businesses that have been pushed out, he’s going to have a HECK of a time filling those up! Those that have been watching the news see this on the horizon…businesses are STRUGGLING…a lot of commercial spaces are becoming available with no sight of filling it. My local bin store uses a model that I think is brilliant. Saturday (their busiest day) $10. Sunday $8, Monday $5, Tuesday $3, and Wednesday $1. They are closed Thursday and Friday. Their higher priced items are placed in shelfs next to their registers.

Do yourself a favor. Get out of that building. That landlord will continue to cause problems with your business. Even if you have to liquidate and start out of your basement again, you will be better off in the long run. You could always try a store again when the time is right, just not with that landlord.

On the $1800 from the first payment: this is why in business you always need everything in writing (text/email). If you had a single message to show them then you would have saved that $1800. Even if you sent a message in an email confirming your payment less the $1800 that would have been enough.

I did have all of that. The invoice for electrician showing the exact amount my rent payment was short. Text messages from the property manager telling me to take it out of my rent... i had it all in writing. Landlord said he didn't give permission for the property manager to authorize that so I owe it. The proof would have helped in court later but not with the current situation unfortunately

@@LindeyGlenn Legally the property manager represents the owner so any loses have to be recovered from him. Find out how long you have to sue them to recover all the money they bilked you out of plus interest and money lost due to their negligence causing you to lose revenue . Try to get out of that building before the time is up and then sue them. They'll lose because they were in control of the written contract and all ambiguities rule in favor of the entity that didn't write up the contract.

I would submit that $1800 bill to the property management company to reimburse you since that was their responsibility that they reneged on the agreement. Ultimately the previous property manager authorized you to have those repairs done and they owe you that money. The previous property manager was acting as an agent of the landlord and they had the power to authorized deductions from the rent. It was not your responsibly to get permission from the landlord, everything goes through the property management company. You should be fighting this but I understand if you don't want to. It also doesn't matter that they switched property management companies. You are not the one who chooses who you deal with, the landlord made a bad choice and is offloading all that on you and the other store owners.

There was a highly desirable shopping center in Phoenix Az and it started to become vacant… the original owners sold the center and the new co doubled rents and everyone left including the chilis, the big name movie theater… maybe the new landlord made money when it sold the place… it was eventually sold and another company re developed it… the original center was very charming and they sort of left that in tact and it seems like it’s doing ok but it’s not the same to those of us who knew it before, but its filled now… but yeah… best to let these landlords take a hit

I was so glad to get notification today. And was very sad to hear what you've been going through. I have been a subscriber of yours since you were selling clothes. Not sure if it's feasible but you might talk to your lawyer about a class action suit. And make it very very public. I know it's expensive but we cannot let these kinds of people railroad us. Retail space prices have gone crazy everywhere. I was looking into opening a store, but no matter where I looked I couldn’t find a space that wasn’t insanely overpriced. I had a small boutique in the early 90's and it was a lease year to year the landlord would come in a see growth in my shop and not surprisingly my rent went up about the same amount. After three years of this, I closed it down. Everyone but me was making money.

I was thinking about you the other day. Many Companies that are doing 1-5 mil can struggle its truly not uncommon. Bigger business means bigger problems. The main thing Lindey is your health. If it is good then continue however if it effects you health wise and I mean not just feeling burnt then IDK.
