Hi Monish, The key think to understand about the builders is that they work in a nexus. So no builder is better or worse. They all have the same tactics and they all use them in varying degrees. The only way to deal with them profitably is to know more than them about building and construction. For example, if you are interested in this flat with SP, just request them to give you the documents related to the flat and land so you can check for any irregularities with a lawyer. If you see them willingly give you the documents as required by law without asking who is your lawyer and what type of papers you want or why do you want it, then you can trust the builder a little and further research on the flat. But if he doesn’t want to give you any documents or written information about the exact dimensions and the exact amenities then understand that this purchase will give you more pain than pleasure.

Hi Swarup, Layout of flat by builder was not provided to us. We were given brochures and some papers with specifications. These do not count as layouts as they do not meet the criteria for the sanctioned plan format approved by PMRDA. Their contract clearly states that such papers, brochures, etc. Are only representational and do not mean anything. The builder can alter plans as he likes. I have made a video about these creepy clauses of Kalpataru. The exact words from the contract are mentioned. I recommend you watch that video if you are planning to buy or have already bought a flat. Only after filing an RTI did we get the actual plans, the builder till the end did not give us the original plans. By law this is necessary to be included in your contract itself but they don’t. This is a very big loophole that the builder lobby exploits. People are unaware that they need to see all documents before buying. In fact, they also mention in your contract that you agree you have seen the documents. So in case you go to court, they will say you already saw them before buying and agreed that you don’t mind the builder making changes to what he promised in the advertisements or brochures.

@@swarupthakur3447 the Project is set to complete in 2021 according to the RERA website. Though they say they have OC and many owners have moved in, the official status is still under construction. Which is the truth. Many works are still pending. The reaction of other owners was disappointment and some were also outraged. But apart from a handful of people, many people are quiet and hoping to sell it to someone else or rent it. There is no water source there. The corporation doesn’t send water since the land is under gram Panchayat. Water tankers are the only way and when we checked the quality, it had cancerous elements.

I fought my case on my own Sudhir, I would recommend that you make every effort in understanding your case and then build it with a good lawyer that you trust. If I do hear of a lawyer who is self-sufficient and looking to grow his expertise I will surely let you know.
