Two possible reasons for them to drop the no insurance claim. 1: The cop that pulled you over knew his argument was BS but counted on you pleading guilty but when you didn´t he knew he couldn´t back his claim up and adviced the prosecution to drop that or 2: The prosecution checked when the ownership switch on the car was dated and saw that the cop was full of shit and dropped it.

Lee, well done for sharing this. A lesson to many. Having been through the court process following a moment of stupidity behind the wheel. Whilst having a heavily pregnant wife and my job hanging on the courts decision. I can empathise with your feeling through this process. It’s super stressful and the prolonged wait for a court date is a complete joke. Unfortunately the police are allowed to use discretion, however many have either a chip on the shoulder or are completely blinded by power to be responsible with discretion.

The insurance issue is massive. I was insured when I was 18, the insurance company was sold, the new company didn't insure anyone under 25.long story short the insurance company failed to send out any notice and cheekily kept on collecting premiums.ended up in court but luckily got thrown out. I feel the relief.

As an ex court clerk I can tell you it is quite common for the prosecution barrister to drop certain charges on the day of court mainly due to the fact it will be the first time the prosecutor has seen the case and will have made a judgement call that the evidence for that charge was not sufficient to continue.

so as an ex court clerk are you an ex because of hailsburys law 2011 which was the downfall of the uk know that the UK was bankrupt and a lawless society and carry on as business as usual to stop mayhem riots and murder, thats what terrifies me when the real hardened criminals work it out we will all be in one hell of a ride

Mate I feel you! Some div in an old Citroen AXGT smashed into me and ran away on foot, I called the police and waited. When the driver turned up with his dad, his dad then went through MY car, I asked the police to get him away from my car as he could be doing anything like leaving drugs, the cop then literally threw the book at me and dragged it on almost 2 years! I needed my licence for my job and this cop took ME to court for Dangerous Driving and driving without due care!! WTF??? I had a clean licence and never been in trouble with the police ever! Turned out the guy who hit me….was his dads car taken without consent, no license, no insurance etc etc. All thrown out of court eventually after he failed to show 3 times!! But had to suffer 2 years of anxiety. Some cops are power hungry flexers and ain’t interested in listening. So glad it’s all sorted for you pal and you have my sympathy.

Mate, I read this as a I noticed the AXGT... my first car. I'm shocked! The guy went through YOUR car! I once fixed my car for a MOT and took it for a spin to see if all was OK. It was midnight by time I finished and got pulled with my MOT expiry 6 mins past midnight. This totally messed with My anxiety while all that was going on too.

He was racing and smashed me into a roundabout, the cops saw my XR2 (yes I’m a little older now haha) and as I was the only one there to tell off he went in on me. I questioned why he was allowed in my car and the cop took that as admission of guilt and off he went. The court eventually apologised to me for what had happened but you can’t undo 2 years of stress. 6 mins??!! Wow, they really will do anything for numbers won’t they. Once upon a time communication worked, seems a thing of the past now, not all cops are power hungry idiots but they really don’t help themselves. How else was you supposed to check before the MOT ??? Ridiculous, feel for you pal

I guess they dropped the no insurance claim because it had no legs and wouldn’t stand in court. I completely agree with the gaps you’ve highlighted in the insurance status sector. Thanks for sharing mate 👍🏼

My dad got 9 points for overtaking what he thought was a parked car at broken temporary traffic lights, there was no accident and no injuries. The car behind him pleaded not guilty to the same charges and lost their license. I've had traffic cops pull me over and nitpick, it's like they haven't got anything better to do or they haven't fulfilled their monthly quotas.

Horrible story - sorry to hear that this happened, sounds like you got incredibly unlucky in the circumstances. Can't imagine how difficult it was to live through, but good to be out the other side of it now!

I had a similar experience. My previous insurance policy on my A45 Amg had expired, and *auto renewed* at midnight into a new policy. Driving to work and police pulled me. The arrogant officer pulled the keys out, asked me why its showing as no insurance. I explained it auto renewed at midnight. He just said "so you are driving with no insurance" And before he would let me speak, he told me I have 6 points, he's seizing the vehicle, and placed me under arrest. I argued my case with him at the roadside while he called a tow truck for my car. While they were rigging my car up, they finally called my insurance who confirmed I was infact insured. At that point they started nitpicking the car, and officer told me he is still reporting me for many defects on the car. They then pretended to be rushing to another emergency and jumped in the police car and sped off.

Section 165 of the traffic act which your vehicle would of been seized under for no insurance is not a arrestable offence so I doubt that part of your story happened. What would happen is you would be reported for the offence, vehicle seized and then you would be sent on your way. Once you can prove your vehicle has insurance you can then pay to have your car released. You would then receive a summons in the post for the no insurance.

I don't believe many of their actions were correct at all, why would that one be any different? I don't have much reason to make up stories for KZbin comments, this happened a while ago and no one can suddenly change the outcome lol

The reason your story stood out to me is I'm a ex traffic officer in the UK and your version of events dosnt add up both on how the law works or what the policy and criteria is for seizing a vehicle. You get cautioned by the way not read your rights, hence why I've asked if you're in America. The officer has to be sure you have no insurance before they seize your vehicle. Database checks, phone calls to insurance are all done before requesting recovery. What where you arrested for?

This was kind of the whole point of me sharing the story about of this negative encounter with the police. Do you honestly believe the police act 100% to the law everytime lol? I am watching the footage back now and this is exactly what is said: Police: Why do you think I've stopped you? Me: Sorry? Police: You're on camera, why have I stopped you? Me: Ummm I'm not sure. Police: You were coming from Shenley, so what's the speed limit there? Me: Ermmm.. 50 / 60? Police: 30. So, you're in a high performance car, you're speeding in a 30 mph limit. That's your liscence gone, I'll stick you on for driving without due care and attention that will be your liscence gone. *I later checked google maps, and he was wrong. The road has a clear national speed limit sign. I do this route every day. The 30 he's talking about was waaaay before I went passed him, and my Blackvue dashcam shows my speed before and after that sign, so he would have been sorry in court.* Police: Just because you're driving a high performance car, doesn't mean you drive it how it's supposed to be driven on a public road. Me: No ofcourse not. Police: Have you got any ID on you at all? Me: Errmm yeah I should do Police: Is it your car? Me: Yeah. Police: Have you got insurance for the car? Me: Yeah. Police: Why is our system showing that you don't? Me: Errrrmm.. it renewed today. Police: So, you haven't got insurance. Me: No, it should have automatically renewed. Police: Right, you haven't got insurance so I'm reporting you for not having insurance on this car, *you do not have to say anything but it may harm your defence if you do not mention when questioned anything you later rely on in court. Anything you do say may be given in evidence* Police: So your car is going to be seized under the 165A of the road traffic act. Me: Ohh my god... Police: You'll be reported for the offence, you'll have 6 points on your liscence, a fine, and then you'll have to pay a fine to have your vehicle recovered aswell. 2nd Police Officer: You said it renewed today, have you got anything to prove that? Me: I've got the renewal letter but it's at home. 1st Police Officer: Right, you need to be able to prove something at the road side now. Me: I don't have anything 🤷🏻‍♂️ (who the fuck carrys their documents in their car dickhead). 1st Police: Okay so we will be seizing your car under the 165A of the road traffic act. And your number plate is also illegal, so I'm reporting you for a number plate that doesn't conform to DVLA regulations. Me: What's wrong with the number plate? 1st Police: It should look like them (points at parked cars) so it should have spacing in between, it's not illegal to sell them, but it breaks the regulations to display them, and you should be displaying the blue GB mark which you do not have. Tow truck then arrived, and he began circling my car taking photos before rigging it up. I called my brother who was at home, and told him to read out the information from my insurance documents. I then called my insurance company who confirmed with the police that I was infact insured. So now I was insured, and there was no evidence of alleged speeding. So he now had nothing on me but a dodgy liscence plate. That's when they handed me back the keys, and ran away faster than they arrived. I recieved no fine, no penalty, no report, no court, absolutely nothing. This happened on 14/09/2020 - 14:19 The police car was: KW69JUK Does that make anymore sense or do you really need to see the footage lol

I also got done for no insurance. I sold my car and was driving a friends car on my insurance till I picked up my new car the next. The police said because I sold my car my insurance was void. I took it to court and won. Dressed smart fresh hair cut and spoke nicely. Definitely made a difference sitting in court with jakeys lol.

@@itsleelockwood Lee I’m so glad you got off with the insurance mate and I tell ya what that cop had a grudge either with you or the person who you bought it from because he was an animal for the way he treated you totally unprofessional should have been sacked from being a cop because now he has made his place of work look bad and I know all cops are not the same there’s a lot good genuine cops all over it who take their seriously FairPlay to them!!!! Well done for sharing Lee What annoys me is that it’s always honest people like us who are genuine, law abiding citizens who get treated like crap and then there’s people out there selling drugs and committing crimes and they never get caught The police aren’t good anymore, the standards have dropped massively

The gap in between police information and dvla information sounds quite dangerous. I always disliked when you tax a car and it still comes up untaxed even though you can prove you've done it.

2 months and a day before police seize your car for no tax, so this would mean the small time delay wouldn’t result in you having your car seized in these circumstances

Got caught by this. Almost didn't get a tow home after I broke down shortly after buying a lemon (my fault). But Pickup couldn't take me because I had no proof of tax. Basically had to say I'd be stranded until Monday (50miles from home). Nothing I could do but they luckily were understanding. Got taken home in the end. Other may not be so lucky.

Mate, thank you for sharing your experience. I was pulled over for reporting my front plate stolen. They assumed that I was the theft and boxed me in in South London too. Sorry this happened to you, some of these officers take the law into their own hands. This video has been informative to those who don’t know.

Had a similar thing myself a couple of years ago with arrogant police I, bought a house locally and about a month after we settled in there was a knock on door around 12am, opened the front door to find 4 police officers shining their torches in my face, asking "where is he?" "Where's the magic Man?" I said, "what? Who you after pal?" "You know who, the magic Man, don't play games with us lad!" I ask "Do you mind lowering your flashlight?" At this point 2 of them are leaning in, basically in my front door looking around the hallway.... "Where's he at Ladd? Don't play games with us!, We know he's here!" I took a step back and said," look I don't know who you're after, but you're welcome to come in and have a look about..I've only just bought the house a month ago, I've nothing to hide here" One steps in, asks my name which I give, then says the address.....except it isn't my address its about 3 properties away..... "No that's not here,nrhats down the street I think" and I gesture with my thumb pointing down the road. Officer walks out the door, says nothing, the other 3 follow him down my drive out the gates, leaving them open and not a word from any of them. Turns out his cars parked on the street outside my driveway, so they assumed it's his house, that's despite the house number both on my gates and my house. Not a sorry sir, or an explanation just 4 dumb cunt police on an ego trip.....and worset of all I still don't know what they wanted the guy for or if they found him. It's only the fact a neighbor told me it was his car outside a top of the range BMW 5 series.

I work for a insurance company and have done for 6.5 years. MID takes 48 hours to update(worst case), max is 5 working days in the instance of reg change/imported car which were manually added to the insurance database. Its not unheard of that MID has historically gone offline, showing no cars are insured when the actually are.

If your buying and selling cars, your a trader, get traders insurance then your automatically covered regardless if insured or not. Simple.

@@itsleelockwood I'm pretty sure a solicitor would have plenty to say about that. It's got to be right up there with witness tampering 🤔 It's effectively the side of the prosecution directly influencing the defendant's decision making process which I'm pretty sure is the sort of thing that can get cases thrown out. It honestly might be worth speaking with a solicitor as you could have a case against the officer and might even be able to appeal?

You're lucky they withdrew the no insurance, because at court, they would've said you could've asked the woman for proof of insurance. Solid advice in the video about trailering cars like that. Also I don't think the handbrake thing was a viable thing for them to say, you can't really test handbrake efficiency at the roadside.

Try a handbrake turn? I wonder how that officer would react to that 'I was just checking it worked before driving home' :) I guess you could try to move the car with it still on, but obviously that doesn't work for an electric handbrake that automatically disengages. Otherwise you'd have to drive it to a hill to try it, on the journey to which you could get stopped, or you'll get there, find it doesn't work, then have to drive it back to where you got it, then you could get stopped with the knowledge it doesn't work. The defects, indicators not displaying on the dash, main beam not working and the handbrake not holding the car sufficiently should have been a warning. The missing wheel nut could have also been a warning, check the rest are all tight, 4 of 5, and drive carefully to somewhere you could get a replacement nut, exit the motorway at the next exit with police escort (if they're going to go considerably slower than other traffic, 30+mph difference, 40 mph in a 70 mph zone, etc). For main beam, even at night, you can just drive slower with fully working dipped headlights, outside indicators working means be much more aware of the position of the stalk, and even if bulbs have failed, demonstrate you know the highway code arm signals, also applicable if brake lights fail, arm out and signal slow down, while doing so sooner so not to catch anyone off guard. You'd have to drive with the window down the whole time, but you'd still be able to signal. And leave the car in gear if parking. Those defects aren't serious, unlike little, dirty or leaking brake fluid equalling no brakes at some point in the future. If one of the defects was something serious like that, then I'd agree with handing out points for it in addition to no insurance. You'd feel that from using the pedal.

It's different here in NZ. A friend of mine had his car stolen and he reported it. It was insured and he got compensated. A year later I was at a steel merchant buying a sheet of steel and I looked through the fence where there is a self storage yard and I saw the car that got stolen. I went to find my friend who lost the car and we went to the police station to tell them that I found my friends stolen car. The police took three weeks to get around to investigating. My friend eventually got the car back but the insurance company took it because he had been paid out for it.

You can buy cars back if they're written off stolen if you contact the insurance company. They will usually sell them back to you for less than market value (auction reserve value)

An interesting story, well narrated, Lee. I'm not a legal expert, but after the reason for the stop ( no insurance) was dropped by the prosecution, the vehicle defects were only observed as a result of an unjustified stop. I think there might have been grounds for your legal defence to ask for all charges to be dropped.

Lesson here, is never believe what anyone says when it’s that important. Even if they say it’s insured, get your own, even if you have to temporarily get it in another insurer, even if it’s third party. Might have been better to wait till next day to collect it and trailer it

Really respect you for making this video, Lee. Whilst the guy who pulled you at first was clearly an absolute spanner - it was great (and reassuring) to see that the police were fair from that point onwards and (hopefully) that first officer received the bollocking he deserved!

As a professional who deals in vehicles, good, bad and the downright ugly, it's your DUTY to do a full and thorough vehicle inspection, every time you get into or are about to drive a vehicle for the first time. yes, these vehicle checks are drilled into HGV drivers, but that's because they drive heavier vehicles that if the worst were to happen, would cause either severe damage to other vehicles or potentially kill multiple people. As a car dealer, it's also beneficial to do a reasonably thorough inspection for any faults that could identify serious costs to you as the dealer. Call it a lesson learned, the expensive way. But if you had done the proper inspection and research beforehand, it may have prevented this issue in the first place.

Tricky situation but you do have to follow the book with insurance and police are very hot on uninsured drivers because it can ruin someone life if they’re seriously injured but an un insured driver so I can see why they threw the book at you… I do agree people should be able to easily access to see if a cars insured but also you shouldn’t take anyone’s word as facts in life because people are idiots like that woman getting her dates mixed up!

I got asked to drive from lancaster to London in a works van… asked if I’m insured they said yes and made out like I was being a dick. I asked what the minimum age was on the policy… it was 25. I was 22, I didn’t look so stupid after that haha

@@user-ue6iv2rd1n yeah i got offerd it when i renewed mine after turning 25 with the company i was with (hastings) for a small fee, was something like £20 on top for the year for fully comp to drive other cars. unfortutly my current policy im only 3rd party as they said they dont do it (brentacre) even when i asked if they did. which seems odd to me.

The traffic officer was sat outside the compound waiting for you to drive out with a car marked as unroadworthy. They do exactly the same with people attending court who get disqualified, who then drive home and get pulled over immediately and prosecuted for driving without a licence (to be fair, they deserve that). I suspect that even without the registration error they would have pulled you over in the Merc as they would be looking at you as an easy mark for more convictions.

They dropped it, because, they couldn't prove it as you were insured. If they could have proved conclusively that you were not insured, they would have pursued it in court & you would have left with 9 points. They are the typical enemy who smiles in your face whilst stabbing your back. He kept phoning you, because, he needed you to just accept his word to make it stick. None of them are your friend, none of them! Tell them nothing!

I had a similar incident with the police/CPS. I got caught driving a van without a seatbelt. The van was a hire van and when the fine was received by the hire company they contacted me and I agreed for them to give my details to the police and admitted the offence. 8 months past and I received a letter in the post with a summons to Oldham Crown Court for the offence(s) of, driving without a seatbelt, withholding information and perverting the course of justice with committal to prison for the offences. Long story short, I got legal advice and they asked where the summons was posted to. As it was posted to my home address and the van was a hire van how did the CPS have my details. I still had to go to the crown court and was the single most scary day of my life knowing the CPS wanted me sent down for not wearing a seatbelt in effect. I was found not guilty for withholding information and perverting the course of justice but guilty of no seatbelt but let me off with a warning due to the inconvenience that was caused.

Last year whilst filming a KZbin video I was pulled by a traffic officer in a unmarked car. I was issued a section 59 for causing harm and distress to the public. He was stern as he approached my car but his attitude changed towards me because of how respectful I was towards him, he also asked my date of birth 3 times as he couldn’t believe I was that old, must of thought it was a fake one. My point is the same as yours Lee I respect them always have and always will do and some have a massive chip probably because of the amount of abuse they take. Mine could of carried on being arsey with me and I still would of talked to him with respect.

Most insurances now state that to drive another vehicle that you don't own using your comprehensive insurance (that actually covers third party use)..... THAT vehicle has to be insured AS WELL !!

What’s to grey about it? The onus is on the driver to prove they’re insured. You would be the first to complain if you got hit by an uninsured driver.

Fair play I remember many years ago getting a similar officer who literally tried to do me everything wrong with the and was under the car. I went to court and they did a similar thing and dropped all but 1 charge which was just a fine

As someone who works in Insurance. You actually can’t even look that up. You can’t look up your own policy or even a random policy unless the customer has called. Its a breach and could lose your job over it. Just another point to add!

Great video buddy, I was recently asked to do a video on how "driving other cars" works but it sounds like you got shafted by the first traffic cop and Police prosecutors obviously agreed. Let's hope someone has a word with the first cop - what a waste of time and money for everyone and so much unnecessary stress for you! Check MID is a great piece of kit but isn't always super quick to update.

Thanks for the vid, was useful to see your experience. You should not have to thank anyone for dropping charges of no insurance 23:59 - though I get why you felt that way. You really were not treated well at all by the initial police officer and they clearly dropped the no insurance as they knew it wouldn't stick. How horrible to have kept you stressing all that time and then dropping it during the hearing. Makes me sick that people out there like you follow things and try and do things the right way and there are hundreds of people who don't but always get away with it.

I got pulled once and the officer admitted that even their systems aren't 'live' and are prone to not having up-to-date info. That was around 10 years ago now, it may have changed since though.

What your talking about here is just common practice. Mid (motor insurance database) check has been around a for a number of years. youll find police use this and have a direct access the database which is linked to their ANPR device. So basically never ever believe someone who says " oh yeah mate the car is insured" Just no! Do not listen to them, just get the car insured which ever possible and get the right cover. But lee your young and its valid lesson you've learnt and potentially sending this message too all of your other young lads who idolise and follow you. So fair to you talking about this and letting other know. ( especially the younger gens)

I feel for you mate , I’ve had the odd situation police over the years , used to play in a band and got pulled over regularly on the way back from gigs , most police officers where great but the odd ones where not nice at all , so it depends how lucky you are who stops you and what mood they are in lol but I can’t imagine how you must of felt going through the two episodes must of shook you right up .

Years ago I used to buy cars and use the 3rd party insurance. Documents never used to state only covers you if its insured elsewhere etc. So even more of a grey area. No way would I risk it these days.

they most likely dropped it because you had a valid reason for the no insurance claim its really difficult when buying a car for the main reason you stated, you cannot check insurance to the minute, i have a friend who has traders insurance and we use it to purchase new cars for this exact reason glad you got it sorted!

Buying a car at midnight off of someone that “needs it gone that night” was surely the lesson that needs to be learned. Motoring offences in this country is the bigger problem because they try to criminalise ordinary people that in normally have no experience dealing with the police, they then shit themselves and just pay whatever to make it go away. I’m surprised they didn’t do you in court regardless because you kind off proved their point you can’t check if the car is insured therefore you shouldn’t have drove it.

I got pulled once and had my car impounded because my car was uninsured. I had been with my insurance company for 7 years and I moved house and forgot to update my address for about 6 months. Somehow they found out I had changed address and cancelled my policy. Didn't have any phone calls or emails from them and I always carry a copy of my insurance certificate with me which still showed it was in date. I got 6 points for it and my insurance price shot up and cost me an arm and a leg for the next few years

The only point I can raise here is that the original seller could have shown you their proof of insurance and emailed it to you When you insure a car you get a confirmation email saying: this car (make model reg) is insured to this person from this date to this date. That could have saved you all the hassle with the power of hindsight … Glad you got it sorted lee

The policy could have been cancelled even if you had that email. Ultimately you still have to take someone’s word for it, or; don’t go making hasty purchases unprepared at silly’o’clock at night.

You can check if there's insurance on the car. Ask the owner to show you the current insurance certificate and take a picture of it.

For your 3rd party insurance to cover a car you don't own, it also needs to be insured by the owner. Whe you say 'take a wheel nut off the other wheel'. Wouldn't that leave you with a missing wheel nut on that wheel??

For extra peace of mind, ask the seller to login to their insurance online or show a certificate of motor insurance. Take a pic with your phone if they're okay with it. That might have helped (in hindsight)

I had a similar thing a few years ago regarding a traders policy. The jobs worth coo said I wasn't insured as it was private use. We went to court and I made them look like a bunch of clowns. The problem is some cops are great but there are some proper bullies who have nothing better to do.

F**ked up that mate, I've always had 'premium' but older cars (could never afford them new) and they generally have a few iffy quirks but never been pulled by police thankfully, I'd imagine I'd be exactly like yourself - I do everything by the book so if I was told I'd done something wrong I'd be shocked too.

Also to note, when buying a car, it’s not covered 3rd party end of. Only if you borrow a car etc then it’s covered 3rd party, soon as you said you just bought it, that told me straight away that your not covered unless you insured it yourself, weather it’s insured by other person or not, soon as you buy a car, ie sale date then it’s simply not covered 3rd party like you think. As a car guy, I know this and I’m sure many others do, so unfortunately your fault

I feel your pain with the court stuff, currently going through a bogus court case as I apparently hit and run a car, no recollection of hitting anyone, no damage on my car and it went to court??? Been driving a year and if I get 6 points I'll have to redo my test. Fully expecting it to get thrown out but it's costing me hundreds for a solicitor and court fees.

Few things buddy; The car DOES NOT need to be insured in its own right by the owner to drive third party on your own insurance, regardless of what wording your own insurer uses, and however much pressure the officer at the time places on you. Don't take accept any pressure from the police or prosecution to plead guilty for offences you haven't committed. Don't waste your money on solicitors for simple motoring offences, their fees will be disproportionate to the fine you would ever receive. Don't spend your life with cars trying to keep the police happy, it's a money generating service, which is their number one priority. It's was a magistrate not a judge, a solicitor not a barrister. These are very minor offences dealt with in a minor court, to which a guilty verdict can always be appealed to a judge at a trial if you disagree with the outcome. You now need to claim the recovery fee £150+ along with a day's loss of earnings directly from the police force dealing with the prosecution. Take care

Good story, at least it wasn't too bad in the end. I got pulled for no insurance when I was. Because I'm busy I didn't shop for a better deal just left it at more money. Turns out if you do that it takes 3 days to update on the ANPR system so shows no insurance. The officer was desperate to take my car off me but we phoned the insurance company who said I was covered. If it had happened at night and I got a jobsworth they'd have taken my car for no reason and then you've got a headache. Something else to think about.

The irony is, the temp cover would've gotten you home. You'd have an insurance certificate to show the police officer and many don't know the mod car scene, so the chances are you would have been let on your way.
